6. Disclaimer
This data is provided on an "as is" basis. The Right Holder does not warrant fitness for a particular purpose of use, non-infringement of the rights of third parties, absence of defects, or matters arising from laws and regulations, culture, business practices or processes of use. The user assumes all responsibility for the use of this data and shall indemnify the Right Holder. The Right Holder is not responsible for any damage caused by the use or failure to use this data. Even if the Right Holder is liable, the Right Holder's liability shall be limited to direct and ordinary damages up to the price of this Data provided, unless the Right Holder has committed no intentional act or gross negligence and is prohibited by law.
7. Attribution of rights
The intellectual property rights and other Rights including the copyright of this data and parts (regardless of form, whether in whole or in part) belong to the Right Holder. Except as expressly provided in these Terms of Use, the Right holders do not grant any rights to the User.
8. Cancellation of permission
If the user violates these Terms of Use, the Right Holder may terminate this permission. In this case, the Right Holder shall not be liable for any disadvantages caused by such cancellation.
9. Liability for compensation
If the User causes damage to the Right Holder or a third party by violating these Terms of Use, the User shall be liable for all damages, whether direct or indirect. In addition, the User shall take measures at its own responsibility and expense to minimize such damage. Also, if there is any instruction from the Right Holder regarding the method of the above-mentioned measures, such instruction shall be followed.
10. Dispute Resolution
If a dispute arises between the Right Holder and a third party due to a user's violation of these Terms of Use, the dispute shall be resolved at User's own responsibility and expense. Also, if there is any instruction from the Right Holder regarding the solution method, such instruction shall be followed.
11.Governing Law, etc.
These Terms of Use shall be governed by and construed in accordance with the laws of Japan only. The Tokyo District Court shall be the exclusive jurisdiction of the court of first instance for all disputes arising in connection with these Terms of Use.
