Dream Seeker Neighborhood Covenant

Neighborhood regions are those regions in the Dream Seeker estates that are have been developed to support residential communities.  These regions are either directly adjacent to other regions or have more than one resident leasing or renting the land, resulting in having neighbours.  All commercial activities on Neighborhood regions are prohibited.

THIS LAND IS ZONED RESIDENTIAL. CLUBS, CASINOS, YARD SALES, AND OTHER HIGH-SCRIPT, HIGH-TRAFFIC OR OTHER COMMERCE ACTIVITIES ARE NOT ALLOWED ON THIS REGION.  YOU DO NOT NEED A PREMIUM ACCOUNT TO OWN LAND ON THIS REGION.  OWNERS MAY RESELL THE LAND THEY PURCHASE HERE.

In order to maintain a quality living experience in the region certain terms and conditions apply. All tenants, residents and guests must abide by the rules stated below. By becoming a tenant in this region, you are agreeing to ALL terms and conditions outlined here, as well as any future revisions of this document that may from time to time be released. Any such changes will be communicated to all tenants and will become effective on the next tier renewal date or 30 days from the notification date, whichever comes first. Use or possession of land in the region on or after the effective date constitutes acceptance of the new covenant.

ESTATE RESIDENTS ARE ULTIMATELY RESPONSIBLE FOR THE ACTIONS OF THEIR GUESTS, VISITORS, TENANTS, OR CLIENTS.  BY BECOMING A RESIDENT OR TENANT OF ANY DREAM SEEKER ESTATES REGION, YOU ARE STATING THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THE TERMS, CONDITIONS AND GUIDELINES CONTAINED IN THIS COVENANT.

  1. VAT AND OTHER TAXES
  1. Dream Seeker Estates and Linden Labs will not charge VAT or other taxes on top of the land purchase fee or the monthly tier fees spent towards your land in Dream Seeker Estates.

  1. TIER FEES -
  1. Current tier prices are listed at http://www.dreamseekerestates.com/prices.
  2. Tier fees are due immediately upon purchase.
  3. Tier fees are payable in Linden currency in-world into a rental box, or using PayPal in US$ currency.
  4. Tier fees are not refundable under any circumstances.
  5. Overdue fees will result in land being immediately reclaimed by management and may be sold or removed from the grid without further warning.
  6. You do not need to have a premium account to own land in Dream Seeker Estates and the land you own in Dream Seeker Estates will not contribute to your land tier obligations to Linden Labs. Linden Labs will not be charging you tier fees.
  7. Dream Seeker Estates reserves the right to change tier or rental fees at any time and for any reason.  In such cases affected residents will be notified and new rates will become effective on next payment date.

  1. OWNERSHIP, LAND RESALE AND PARCEL MANAGEMENT
  1. All parcels sold in Dream Seeker Estates must have one specific individual registered as the person responsible for tier payment. That person is the individual that the estate recognizes as the owner of the parcel, regardless of who at the time is listed as the owner of the parcel (individual or group), who paid for the initial purchase, and regardless of any other dealings that may have occurred. In the event of a breakdown of a relationship or another dispute, the land will be returned to the person who is currently registered as the party responsible for tier payments and has made at least one tier payment.
  2. As a tenant of Dream Seeker Estates, you must maintain membership in the Dream Seeker Estates group as that will be the primary vehicle for the Estate management to contact you with any information pertaining to the Estate.
  3. You may sub-divide or merge the parcels you own. See Subdivision / Subletting section for restrictions.
  4. Any sales you make without notifying Dream Seeker Estates will only be considered as sub-rentals. You will still be liable to Dream Seeker Estates for your tier fees and failure to pay these fees will result in the land being reclaimed by management.
  5. If you wish to sell your land, you must sell it in the exact same parcel configuration (size / shape) as what you have originally purchased from Dream Seeker Estates. Any such sale MUST be communicated to Dream Seeker Estates in order to transfer tier fee obligations to the new owner. Although not required, if you have previously subdivided or joined your parcels in the region, you should contact Dream Seeker Estates before you sell the land to ensure that it is again partitioned properly before new owners take possession.
  6. At the time of sale, any tier fees paid to date expire and the new owner is required to immediately start paying tier fees to Dream Seeker Estates. If only a portion of the land is sold, Dream Seeker Estates will consider that transaction as a sub-rental and will not accept tier fees from the new tenant.

  1. ZONING
  1. Neighborhood regions are zoned strictly for residential use.
  2. Commercial activity is not allowed.
  3. Maturity rating is dependant on the region and all region content and activities must comply with this rating, as further defined in the Linden Lab’s Maturity Ratings Policy.

  1. SUBDIVISION / SUBLETTING
  1. In order to keep open space and maintain the beauty of the neighborhood, land may not be subdivided into parcels less than 4096m2 and no more than 1 building per such land area may be placed.
  2. No building can be rented to more than 1 paying tenant.
  3. Tenants must agree to abide by the rules of this covenant. Violations of the covenant by any tenant may result in banishment from the estate.

  1. WEATHER
  1. Weather systems allow creation of various weather conditions in Second Life. These systems are meant to cover large areas.
  2. Weather effects must not extend outside the perimeter of the land parcel.
  3. Weather systems are only permitted on parcels 16,384sqm in size or larger.
  4. Dream Seeker Estates will periodically change the region scenery to reflect the change in seasons as per the following schedule.  You are required to make any changes to your parcel as necessary to reflect the current season during the same season change schedule and no later than one week after the end of the change window.
  1. RESTRICTED ACTIVITIES
  1. No high traffic locations such as dance clubs, casinos, yard sales or multi-store shopping centres, unless explicitly permitted by Dream Seeker Estates management. Small, private dance floors are allowed.
  2. Camping for money in all areas is not permitted.
  3. Due to their controversial nature, political or religious centers, gathering places, as well as activities or presentations (billboards, signs, etc) intended to convey religious or political opinions will not be permitted in any Dream Seeker Estates region.
  4. No combat areas or weapon testing are permitted. You may wear your weapons but are only permitted to draw and use them in the context of a family role play activity such as police force, and only with express agreement from all participants, which include all persons who may observe or be aware of the activity. Damage is globally turned off in all Dream Seeker Estates regions.
  5. Griefing neighbours is strictly forbidden and may result in immediate reclaiming of the land and banishment of the offending user from the Dream Seeker Estates. No excuse shall justify a griefing activity.
  6. Although travel throughout the estate is permitted, private ownership of land and buildings must be respected. All residents and visitors are expected to treat other residents and private land properties with the same respect as would be expected in a real world.
  7. Up to 1 animal/pet (breedable or non-breedable) allowed per 1024m2 on a Full Prim region and 1 per 4096m2 on a homestead region. For example, if you rent an 8192m2 Full Prim parcel, you will be allowed up to 8 animals/pets. Residents found with more than the allowed number of animals/pet will be asked to reduce the number of animals/pets or move to one of our Farm Regions which allows a higher number of animals/pets. 
  8. No floating structures of any kind below 1000 meters.

  1. SIM PERFORMANCE
  1. For the enjoyment of all residents, lag on sims in the estate is monitored and the estate management team responds to lag complaints and endeavours to maintain acceptable levels of performance in all sims.
  2. No lag intensive scripts should be used. Please use your best judgment as to which scripts are necessary to accommodate your living style, while also respecting your neighbors in regards to simulator performance. If the performance of the sim drops below 40 FPS you may be asked to make the necessary changes to restore performance back to a manageable level.
  3. Textures and heavy use of particles cause client-side lag. Many individual textures fill client side cache and take a lot of bandwidth to load when initially teleporting in. Because of 3D image rendering, sculpted textures are particularly taxing on the client's video card CPU performance. Please keep this in consideration when designing your parcel.  When an avatar teleports to a new location, all textures within the draw range will be downloaded to that avatar, even if those textures are on your neighbor's parcel.  
  4. Physics can also cause a lot of stress on the sim CPU in some situations. For example, two physical objects in constant contact with each other may trigger countless collisions which must be processed by the physics engine.
  5. Residents are expected to limit the usage of scripts and collisions in their parcel. Full Prim regions are considered to run best with 15ms or less of script time and Homesteads at 4ms or less. If the parcel is a Full Prim 8192m2 then it would be allocated 1.8ms for the script time usage with additional allocation if the region has a prim bonus. We, also, expect the resident will limit the number of collisions caused by the animals by turning off their movement and animations. Taking the steps above will help to maintain a more stable region performance.
  6. Pets or physically moving items should be limited only to those items that are essential for the design of your parcel. When you leave the parcel they should also be able to detect this and stop movement or be set to not moving when not in use. This is to further help reduce strain on the region.

  1. PARCEL ACCESS, SECURITY AND PRIVACY
  1. Out of respect for the neighbours, sound and voice must be limited to the parcel.  In parcel's Media configuration window, please ensure that the "Restrict Voice to this parcel" checkbox is checked if Voice is enabled.  Also make sure to check the box to "Restrict gesture and object sounds to this parcel".
  2. Ban lines are allowed, security orbs are not.  All parcel access restrictions are to be managed through the parcel’s ‘About Land -> Access’ tab.
  3. Recommended Security Settings:

    In order to enhance everyone's experience in the Dream Seeker Estates regions and at the same time establish adequate security to protect the land and the region from most griefer attacks, the following security settings are recommended (you will find them under 'About Land -> Options tab'). 
  1. TERRAFORMING, ARCHITECTURE, STYLE
  1. A number of distinct regions exist within the estate. Architecture and landscaping must fit the theme of the region. When in doubt, ask the estate management. Temporary exceptions may be granted to allow decorating for special occasions.
  2. Architecture and landscaping must resemble contemporary residential styles in upscale neighborhoods found in real world neighborhoods of developed countries and must have a tidy and up-kept appearance.
  3. Land can be terraformed -10 meters from default terrain. Raising of terrain is disabled to keep within the theme of the region.
  4. Editing of terrain within 10m of parcel boundary requires estate management approval and may require our assistance. Terrain needs to look natural throughout the estate and so land formations need to connect smoothly between parcels.
  5. The minimum distance of any structure from the parcel edge must be equal to or greater than the height of the structure. For example, a 50m tall tower must be placed at least 50m from any parcel boundary.
  6. Parcel walls are not allowed.

  1. MATURE CONTENT, ADULT CONTENT AND LEGAL
  1. The region rating is determined by the region setting.  Regions which are rated as Adult permits content and activities defined as adult content by Linden Labs.  Restrictions will be placed on regions in the Adult estate to only allow age verified adults.
  2. You are expected to comply with applicable legislatures of your real life place of residence, your current real life location, any legislature applicable to Linden Lab, and the legislature of Canada and the province of Alberta.
  3. You are expected to fully comply with all provisions with the Second Life Terms Of Service (TOS).
  4. Dream Seeker Estates or any officer thereof shall not be held responsible for any losses of any kind, direct or indirect.
  5. Dream Seeker Estates is also not responsible for the objects returned or lost for any reason.

  1. DISPUTES AND MANAGEMENT AUTHORITY
  1. Dream Seeker Estates management has the final authority in making judgments in any disputes.
  2. Dream Seeker Estates management has the authority to remove, with or without warning, any structures, landscaping, objects or scripts, or take any other action that it in its sole opinion deems necessary to maintain or restore the intended atmosphere of the region, to restore or maintain the performance of the SIM, or to enforce compliance with this covenant.
  3. If a resident threatens or carries out action that has a hostile intent to inflict direct or indirect financial losses upon the Dream Seeker Estates group, any partner estate, or any officer thereof, the estate management will immediately reclaim any land owned by that resident without refund and the resident will be muted and banned from all affiliated estates. Linden Lab will be notified of the incident.
  4. Dream Seeker Estates staff works hard to make your Second Life experience as rewarding as possible.  Verbal or other abuse directed towards any member of the Dream Seeker Estates staff will not be tolerated and will result in immediate muting and banishment of the offending avatar from all Dream Seeker Estates regions.
