CALL FOR THE LAUNCH OF AN EXTERNAL INVESTIGATION INTO THE OFFICE OF THE DEAN OF ARTS’ HANDLING OF COMPLAINTS AGAINST FACULTY MEMBERS

We are writing this open letter to bring attention to the increasing concerns amongst undergraduate and graduate students over the mismanagement of sexual violence allegations against professors in the Faculty of Arts.  Year after year both the SSMU, Faculty and Departmental Student Associations, specifically History, Philosophy, Political Science, Psychology, and World Islamic and Middle Eastern Studies (WIMES) hear  concerns students have about professors who are known by students to be abusive.  In the interest of our commitment to our members, we are no longer willing to stand by while the administration cites red tape. These professors continue to teach and to supervise, in some cases teaching mandatory first year courses, leaving vulnerable the students who have not yet been warned about the predatory behaviours of certain professors.  It has also been the case that student representatives over this past year have brought up these concerns multiple times to many different members of administration. It was clear that the majority of the administration who were met with knew which professors students are concerned about. And despite our expressing anxiety over the safety and well being of a particular student in one case - no action was taken.

The administration has made no attempt to address abuses of power in a meaningful or significant way, instead consistently citing lack of formal complaints or ongoing committee work as reason for not immediately addressing concerns. Relying on students coming forward with formal complaints and/or testimonies in order for action to be taken when there is an acknowledgement of a systemic problem is unreasonable and shows the inherent misunderstanding of the reality that many are afraid to come forward and risk their academic careers, fear being subject to legal action from mobilized professors, or do not believe the administration would do anything with their complaint. Despite this, admin expects high standards of disclosure with precedent showing that these procedures may be unnecessarily re-traumatizing.  As it stands, the Office of the Dean of Arts has failed to address serious concerns and has thus failed its students – violating 11, 13, and 16 of the Fundamental Rights outlined in McGill’s Charter of Student Rights. Although we recognize that the faults are institutional, it is also important to acknowledge the individuals involved that have not responded appropriately to complaints.

While we understand that administrators have a legal responsibility to keep much of the information in these cases confidential, we cannot continue to pretend a problem does not exist while students have  had cases mishandled or dismissed, and others continue to experience violence on campus.

Our demand to McGill University is the following: we call on the University to launch a third-party investigation into the Office of the Dean of Arts on the handling of informal and formal complaints directed against faculty members. The investigation's mandate ought to concern itself with:

  1. Gathering testimonies from students, with a focus on the students in the departments listed above, who have either tried to come forward or who have not been able to because of the inaccessibility of the current complaints system (while also guaranteeing the full anonymity of those who speak to the investigator);
  2. The ways in which the Office of the Dean of Arts has handled incoming (in)formal complaints about Professors in the last 5 years;
  3. Whether or not the Faculty of Arts has taken proper measures to address concerns, specifically when it comes to working with Department Heads and Departmental Student Associations to address complaints;
  4. Whether or not the University is able to (a) ensure that informal and formal complaints against faculty members are able to be presented to their tenure committees and (b) tenureship status can be reassessed following formal complaints against a faculty member ;
  5. Assess the role the Associate Provost (Equity and Academic Policies) plays at both the departmental level and at the level of the Deans in assessing and addressing complaints;
  6. To conduct interviews with students, student representatives, faculty, and administration throughout April and May, and to submit a report to the university as to the results of their investigation by the end of June 2018. This report is to include their recommendations both for appropriate next steps and changes are needed in the current complaints system in order for students to be able to have their concerns taken seriously. This report is also to be made public to students.

The goal of an investigation is to document transgressions and responses on all institutional levels, to hold those involved accountable for their actions, and for the University to be able to respond more appropriately to the needs of its students. Besides this report being shared with students, we also ask that the University commit to working with students on the implementation of the recommendations from this report.  

We at the SSMU will also be consulting with our members who have been working on the issue of sexual violence in the academy, and will be producing a report with our recommendations for what needs to be changed in the current policies and procedures in order to have them reflect the prioritization of student safety and well-being. This report will be completed and presented to the administration by the end of our mandate, and we ask that they agree to go through these recommendations with us and together we develop a plan on how to begin to incorporate the recommendations. We are tired of sitting and discussing the same problems in different rooms, seeing little to no movement while our members continue to be hurt and exploited by faculty who abuse their power.

We understand that the Faculty of Arts is not the only Faculty that has a problem with professors who abuse their power, and we hope that an external investigation into Arts will set a precedent so that in the future McGill will act when they become aware of departmental issues and that above all they will begin to prioritize the safety of their students’ before the legal liability or reputation of the institution.  In light of what happened at Concordia this year, as well as recent societal movements to hold people in powerful positions accountable for their abuses, we ask that the university take a proactive rather than reactive stance on these issues and launch an investigation into the handling of complaints against faculty  from within these departments and others in Arts in order to identify the problems within the current complaint systems.
