RELEASE AND DISCLAIMER AGREEMENT
YOUR AGREEMENT WITH GOURMET SYSTEMS LLC
Your contract is with Gourmet Systems LLC dba Michael Graham & Associates \ Graham Tours \ MGA Travel \ World Cruise Desk \ Cruise & Travel Expo, referred to in this document as “MGA Travel” and on the websites mgatravel.com, grahamtours.com, takethetrip.com and other domains. Booking travel with MGA Travel will signify your agreement with the following:
MGA Travel acts merely as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, motorcoach operator, or other service provider named in your itinerary (“Suppliers”). MGA Travel is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules. MGA Travel acts merely and strictly as the agent in the travel transaction.
MGA Travel has no special knowledge of health hazards such as the risk of contracting disease, either during travel or at the client’s destination. MGA Travel has no responsibility for travel restrictions, or disease related requirements that travel suppliers and governments may impose from time to time, such as health affidavit forms, health screenings prior to departure or upon arrival, face coverings, or quarantines. MGA Travel assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers including chartered ground transportation or group hotel lodging ; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers including chartered ground transportation/group hotel lodging ; (3) any wrongful or negligent acts or omissions on the part of any other party not under MGA Travel’s control; and (4) any Supplier price drop after your travel arrangements have been confirmed, deposited, paid in full, or ticketed.
MGA Travel has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. You hereby RELEASE MGA Travel for any recommendation of future travel credits with suppliers that may be out of business by the time the client tries to use the credits. If requested, we may assist with obtaining any refunds due or rebooking trips using future credits, but we will charge a nonrefundable fee for such services. For other information concerning possible dangers at destinations, MGA Travel recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or their website. For medical information, MGA Travel recommends contacting the Centers for Disease Control at (800) CDC-INFO or https://wwwnc.cdc.gov/travel. You agree to RELEASE MGA Travel from liability for travel cancellations or your personal financial loss; if you or your group or any group does not travel for any reason; or the actions of travel suppliers; in the event of an act of God, war (whether declared or undeclared), terrorism, accident, natural disaster, outbreak of disease, pandemic, epidemic, force majeure, or other event or circumstance out of our control. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). MGA Travel has no liability for a supplier’s failure to honor future trip credits nor any liability for recommending a future trip credit. You hereby release MGA Travel from all claims arising out of any problem covered in this paragraph. You agree that the courts in Horry County, South Carolina will be the exclusive jurisdiction for all claims brought by you or MGA Travel, and you hereby submit to the personal jurisdiction of those courts. All claims for refunds or damages must be filed within 30 days of your return.
For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. We especially recommend Cancel for any Reason type policies for travel insurance. However, no representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.

You hereby release MGA Travel from all claims arising out of any problem covered in this document and all paragraphs, and related documents as shown below.
Travel arrangements involving airline and cruise components are subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms. By accepting this itinerary or invoice you hereby consent to those terms and conditions.
