Official Rules & Regulations
By participating in the Raffle, you understand and agree to the following:
The Mason Band Boosters 2024 Car Raffle (the “Raffle”) is a fundraising activity conducted by the Mason Band Boosters, Inc. (hereinafter “Mason Band Boosters” or “MBB”), a 501(c)3 organization (FEIN#31-1060187) in support of the Mason City School District Music Program, grades 6 -12th. These Official Rules and Regulations govern the conduct of the Raffle, together with the decisions of Mason Band Boosters Executive Committee, these rules are binding on everyone who purchases a raffle ticket and/or who is named on a raffle ticket, Mason Band Boosters, Mason band committee members, and all individuals selling raffle tickets. It is the responsibility of the ticket purchaser or person named on the raffle ticket to review these official rules. No modification of these official rules shall be enforceable unless made by the Mason Band Boosters in writing and approved by the Mason Band Boosters Executive Committee.
*Grand Prize: A 2024 Audi Q5 S line 45 TFSI quattro with all standard features plus the following upgraded features: Summer of Audi package, Audi Guard protection kit, Audi beam rings, Cargo cover, Audi cargo box valued at $53,175 + applicable sales tax, to be purchased at Audi Cincinnati East in Forestville, Oh or $30,000 cash, in lieu of car, if the winner so chooses. Depictions of cars shown in informational materials on the Mason Band Boosters, website and elsewhere can be found on www.audicincinnatieast.com. The vehicles shown in Raffle promotional photos are only representative of the make and model available for selection as the Grand Prize; the actual car to be made available for selection by the Grand Prize winner may be viewed, if available, at Audi Cincinnati located at 8639 Beechmont Ave , Cincinnati, Oh. 45255.
Second Place Prize: means a $1000 cash prize
Third Place Prize: means a $500 cash prize
*Grand Prize Qualifying Exceptions: If fewer than $107,850 worth of tickets are sold, the Mason Band Boosters, reserves the right, in its sole discretion, to substitute the Grand Prize with a cash payout based on a percentage of total gross ticket sales revenue, ranging from 25% to 50% of total gross revenue, up to $30,000, according to a predetermined escalating payout schedule based on the gross revenue from the tickets sold as of the time of the entry deadline, in lieu of the car. The odds of winning the Grand Prize is 1 to 5,500 if all of the tickets are sold.
GRAND PRIZE DRAWING: The Grand Prize drawing for the Mason Band Boosters Car Raffle will be held on the evening of Saturday, November 9, 2024 at the Mid States Band Assocation Championships at Atrium Stadium Dwire Field in Mason, OH. The winner will be announced the same evening as the Raffle drawing, except this date and all other dates stated in these rules may be extended at the absolute discretion of the Mason Band Boosters Executive Committee. Ticket requests by mail must be received before 5:00 PM EDT Monday, November 4, 2024
In the event the Mason Invitational is cancelled for any reason, the raffle winner will be drawn at Mason High School, 6100 Mason Montgomery Rd, Mason, OH, 45040 on Sunday, November 10th after 5pm and the winner will be notified by phone or email as soon as possible.
Tickets may sell out before that time. The Mason Band Boosters will conduct all drawings in accordance with these raffle Official Rules. The winning ticket will be drawn at random from a drum containing all eligible raffle tickets. The winner does not need to be present to win.
SECOND AND THIRD PRIZE DRAWING:
In addition to the Grand Prize drawing, the Raffle will include second place and third place prize drawings immediately after the Grand Prize winner is drawn. Second place and third place winning tickets will be drawn consecutively and at random from the drum containing all remaining eligible tickets purchased after the Grand Prize is drawn. Each winning ticket will NOT be placed back in the drum prior to the next prize drawing, and all remaining tickets in the name of a winner from each of the previous drawings shall be null and void for subsequent drawings during the raffle.
TICKET SALES: The price per one (1) ticket is $25.00; for five (5) tickets sold to the same person is $100. For sale of multiple tickets (5 for $100) to individuals, the individual’s name, as purchaser and all contact information must appear the same on all tickets and be purchased in the same transaction. A maximum of 5,500 tickets will be sold. Ticket sales will cease at 5pm on Friday, November 8, 2024 or when the maximum number of qualified entries is reached. Ticket requests by mail must be received before 5:00 PM EDT Monday, November 4, 2024. Any mail-in requests and payments received following the cut off time or after the sale of 5,500 tickets will be returned to the sender.
All entries must be fully completed in order to be eligible including the printed name, address, phone number, and email address of the entrant. Purchase of the ticket serves as purchaser’s agreement to be bound by these Official Rules. Must be at least 18 years of age and residents of the state of Ohio to purchase tickets.
Mason Band Boosters does not undertake to give advice on the legal or tax consequences of the Raffle, or its winner(s). However, the IRS position is that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions.
GRAND PRIZE:
The Grand Prize winner assumes and must pay all fees and charges (including, but not limited to, tags and license), income taxes (local, state and federal taxes) when the car title is transferred to the name of the winner. In addition, all costs of car ownership, including but not limited to insurance, are the Grand Prize winner's sole responsibility. Mason Band Boosters assumes no responsibility for a prizewinner's tax obligations and recommends you consult your tax advisor. Forms W-2G & 941 will be filed with the Internal Revenue Service to report the value of the prize won and income taxes paid/withheld. All required forms will also be filed with the state of Ohio Department of Revenue. The winner will also receive a copy of these forms. This offer is void where prohibited by law and all federal, state and local laws and regulations apply.
THE GRAND PRIZE WINNER IS STRONGLY ADVISED TO SEEK PROFESSIONAL
LEGAL TAX ADVICE. AWARD OF THE GRAND PRIZE COULD HAVE MATERIAL
ADVERSE CONSEQUENCES ON THE GRAND PRIZE WINNER INCLUDING WITHOUT LIMITATION, WITH RESPECT TO TAXES, INCOME, GOVERNMENT ENTITLEMENTS OR OTHER BENEFITS, OR OTHER LEGAL, FINANCIAL OR OTHER MATTERS.
By participating in this Raffle, all ticket purchasers and the person named on each Raffle ticket accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here, and (2) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used by Mason Band Boosters, for publicity purposes and naming of the prize winners to be published in area newspapers or other media including television, radio, web and print. The prize winner will be published on the Mason Band Boosters website (masonbands.com). Names of the winners may be obtained by sending a written request plus a self-addressed, stamped envelope to Mason Band Boosters, P.O. Box 310, Mason, Oh, 45040. Mason Band Booster’s interpretation and application of the rules and regulations shall be final.
By participating in this Raffle, each participant releases Mason Band Boosters, and each of their respective directors, officers, contractors and agents from any and all liability for injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use or misuse of any prize, and each winner agrees to indemnify and hold Mason Band Boosters, Mason City Schools and each of their respective directors, officers, contractors and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising as a result of participation in this raffle.
ELIGIBILITY: Raffle ticket purchasers and the person named on a raffle ticket must be at least 18 years of age at the time of purchase and must be a resident of the State of Ohio. Raffle tickets may not be purchased in the name of a business, trust, corporation, or other entity, or wherever prohibited by applicable law. Members of the Mason Band Booster Executive Board as well as the Band Directors, or persons related by blood or marriage living in the same household are not eligible to win the Raffle. Prizewinners may be required to sign an affidavit of eligibility. Offer void where prohibited by law.
In order for the Grand Prize winner to receive the grand prize (subject to the other provisions in these rules), the Grand Prize winner must elect to receive the prize by delivering written notice of that election to Mason Band Boosters, by 4:00 p.m. on December 9, 2024 (about 30 days from date of original drawing). If the winner is not present at the drawing, Mason Band Boosters will contact the winner by phone or email as soon as possible. If unable to make contact with the winner the Mason Band Boosters, shall notify the winner by certified mail within seven (7) days of the drawing. In all cases the winner will be notified that they shall claim the prize within thirty (30) days of the original drawing at the event or if not claimed, an additional drawing will occur and each time a winner is drawn the thirty (30) day timeframe will be granted, should the winner decline for any reason. The original 2nd and 3rd prize winner would also be entered back into the drawing and eligible for the Grand Prize.
If a winner does not wish to claim the prize but wishes to donate it to the Mason Band Boosters, the winner shall provide the Mason Band Boosters, a written and notarized statement within the thirty (30) day period stating that the winner wishes to donate the prize to the Mason Band Boosters. The donor will then be required to sign a Donation Document created by Mason Band Boosters.
If a Raffle winner does not claim the prize or elect to donate it to the organization within thirty (30) days after the date of the drawing, the Mason Band Boosters shall draw another ticket from the remaining ticket entries, including the original tickets for the 2nd and 3rd prize winners. The tickets shall remain under the control of Mason Band Boosters until a winner is identified and accepts the prize.
Should the Grand Prize Raffle winner choose to purchase the “car”, Mason Band Boosters will issue a check made payable to the Grand Prize winner AND “Audi Cincnnati East” for the value of the Grand Prize, less the required IRS withholding (24% of winnings, less cost of ticket, over $5000) by Mason Band Boosters on behalf of the winner. The purchase contract for the “car” will be between the winner (Purchaser) and Audi Cincinnati East (Purchasee). Mason City Schools and Mason Band Boosters do not provide any guarantee or warranty, expressed or implied, in connection with the car. Mason Band Boosters accepts no liability or responsibility regarding the manufacturing or condition of the car. No warranties expressed or implied, of any type or nature are made or offered by Mason Band Boosters or Mason City Schools.
GRAND PRIZE VALUE: The grand prize value of the selected 2024 Audi Q5 automobile is the amount negotiated by the Mason Band Boosters, not to exceed $53,175, the negotiated price of the vehicle, before taxes and fees. The Grand Prize cash payout, if applicable due to low ticket sales in lieu of the Grand Prize car and in the sole discretion of Mason Band Boosters, will be a percentage of gross revenue ranging from 25% to 50% of gross revenue up to $30,000 according to a predetermined escalating payout schedule based on the gross revenue from the tickets sold as of the time of the drawing. The Internal Revenue Service and the Ohio Department of Revenue will accept a Grand Prize cash payout value for the purpose of determining any income tax that may be payable by the Grand Prize winner.
REFUNDS: All Raffle ticket sales are final. No refunds will be made except any ticket request with verified payment received after 5,500 tickets have been sold or after the deadlines set forth herein above will be returned or destroyed with notice to the purchaser. No other refunds are available. Mason Band Boosters assumes no responsibility for lost, late, misdirected or non-delivered email, mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. A Raffle participant's sole and exclusive remedy for Mason Band Boosters breach shall be limited to the return of the purchase price paid for his or her Raffle ticket(s). In no event shall Mason Band Boosters, or their respective directors, officers, contractors, members, committee members, agents, advisors, or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.
TICKET ENTRIES: You have not entered the Raffle until your entry submission, with full payment has been accepted by the Mason Band Boosters. If a submission is accepted it will be deemed to have been accepted on the date and time on which the submission was received by Mason Band Boosters regardless of the date that Mason Band Boosters notifies you of the acceptance of your submission. Once a submission is accepted, you will receive an email (online ticket sales) with your assigned ticket numbers from carraffle@masonbandboosters.com to the email address indicated in the online entry form as acknowledgement of the acceptance of your raffle entries. Mason Band Boosters is not responsible for emails undeliverable due to incorrect email addresses provided on tickets or online entry form.
Tickets are $25 each (5 tickets sold to the same person or household for $100) and may be purchased solely from Mason Band Boosters. You may buy as many tickets as you wish up to the deadlines set forth herein, subject to availability, until all 5,500 are sold.

Ticket requests must include payment by check, made payable to “Mason Band Boosters”, to be eligible along with all information required on the ticket including printed name, address, phone number, email address, and a signature acquiescing to all rules of the Raffle. All sales are final. If for any reason a check or debit card payment is rejected for lack of funds, the ticket purchase is null and void, the purchaser will be notified of the problem and provided an opportunity to cure to the transaction up to the date of final ticket sales and processed in the order received.
When a Raffle ticket order is placed by mail or online and funds have cleared, Mason Band Boosters will complete the raffle ticket for the purchaser by filling in the name, address, email address, phone number. Mason Band Boosters will then place each completed raffle ticket stub in the secured raffle barrel or other secure container and mail the ticket(s) to the purchaser. The purchaser will receive a letter or an email from Mason Band Boosters, confirming the ticket purchase. Questions on ticket entries can be directed to carraffle@masonbandboosters.com.
TICKET AND PAYMENT VERIFICATION: Mason Band Boosters reserves the right to reject any ticket request form that is submitted with payment that does not constitute "good funds". All defective or physically altered request forms are subject to disqualification at the discretion of Mason Band Boosters. Prior to the Grand Prize drawing, Mason Band Boosters will make a reasonable effort to notify any individual who submits such an entry form, that the entry has been rejected. All requests for tickets for the drawing must be received and/or purchased by the indicated deadline(s).
GRAND PRIZE WINNER: In order to claim any prize, including the Grand Prize, the winner must provide proper identification to the satisfaction of Mason Band Boosters and in accordance with the requirements set forth by the State of Ohio. A representative of Mason Band Boosters will assist in administering the Grand Prize documents and distribution, including an agreement to Grand Prize election and amount. Winner agrees to the use of his/her name, photograph or video likeness and statements for publicity purposes by Mason Band Boosters and Mason City Schools and agrees to sign a publicity release without any further compensation.
GRAND PRIZE AWARD IN EVENT OF NON-SELLOUT OF TICKETS: A maximum of
5,500 tickets will be sold. A minimum of $107,850 worth of raffle tickets must be sold for the Grand Prize winner to receive the Grand Prize value of the car. If fewer than $107,850 worth of raffle tickets are sold, Mason Band Boosters reserves the right in its sole discretion to substitute a cash payout that is a percentage of gross revenue ranging from 25% to 50% of gross revenue up to $30,000 according to a predetermined escalating payout schedule based on the gross revenue from the tickets sold as of the time of the entry deadline as the prize in lieu of the car.
RIGHTS OF CANCELLATION
Mason Band Boosters reserves the right to cancel this Raffle at any time, in which event liability is limited to the refund of the ticket price to all participants.
This Raffle is conducted for the Mason Band Boosters which is a 501c non-profit organization whose mission is to support the Mason Band Program in Grades 6-12 in Mason City Schools, Mason Ohio.
