Our privacy policy is designed to provide transparency into our privacy practices and principles, in a format that our guests can navigate, read and understand. Petgotchi Pte. Ltd. and its subsidiaries (collectively, “Petgotchi”) is dedicated to treating your personal information with care and respect.

This privacy policy describes how Petgotchi collects, uses, and discloses information from players of its games (“Petgotchi Games”).

1. Information We Collect

We collect information about you and your use of the Petgotchi Games. Information about you may be required to provide you with the Petgotchi Games and the failure to provide information may result in our inability to provide you with certain games, features, or services.

By downloading, accessing, and/or playing the Petgotchi Games, you consent to the collection of information about you, by us. Most of this data comes directly from you or your device, such as device information, country and region, and game play information. We use this data to provide our games and services to you, including for the purposes of optimization, preventing fraud, customizing in-game offers, verifying purchases, and, with our third-party advertising partners, delivering you targeted and/or contextual advertisements.

Our Petgotchi Games may collect certain behavioral game data from users whose age has been properly verified as over the age of 16 and users able to share such information. This game data is used to better understand how users access and engage with Petgotchi Games and for other research and analytical purposes, such as to evaluate and improve our Petgotchi Games, develop new features, products, or services, and to otherwise improve our Petgotchi Games and user experiences. To collect behavioral game data we use a number of analytical services, such as Tenjin, Adjust, Unity Analytics & Google Firebase.

We collect and use your device location information as you play our games, including events that occur during gameplay. Parts of our games are location based in which the core feature is to provide a gameplay experience tied to your real world location, so we need to know where you are to operate these games for you, and to plan the location of in-game resources. We identify your location using a variety of technologies, including GPS, the WiFi points you are accessing the Service through and mobile/cell tower triangulation.

The information we collect falls into three categories: (1) information collected directly from you; (2) information collected automatically, and (3) information collected from third parties.

(1) information collected directly from you

When you download our game, we collect your age as indicated by you.
If you subscribe to our newsletter, which we periodically email with updates about our games.
If you submit information to the Petgotchi Games customer service team via email or via our website.
If you communicate with Petgotchi through our presence on third party platforms such as Facebook, Twitter, or Discord.

(2) information collected automatically

We use in-app analytical tools to collect unique user ID, IP address, device IDs, hardware or operating system based identifiers, identifiers we assign to your account, and other similar identifiers (collected from your device).
Information on your activity in the Petgotchi Games (for example, your game progress or your interactions with in-Game ads), Internet, gaming or other electronic network activity information – such as information regarding your interaction with an advertisement (collected from your device). Your gameplay records are stored in the cloud if you opt-in to Cloud Save.

(3) information collected from third parties

Petgotchi collects user information through the third-party advertising networks on the Petgotchi Games. This information includes your device ID, a unique advertising ID associated with your device, and your approximate geographic location. For more information, see the “Advertising” section below.
If you use a third-party platform to connect with Petgotchi Games, we collect third-party platform account information and information made public in connection with that service (including your name, your unique Facebook user ID, profile picture, age range, gender, and your friends). Please keep in mind that when you post information on a third-party site or platform, the information you provide may be separately collected by the third-party site or platform. The information we collect is covered by this privacy policy and the information the third-party site or platform collects is subject to the third-party site or platform’s privacy practices. Privacy choices you have made on the third-party site or platform will not apply to our use of the information we have collected directly through the Petgotchi Games.
If you make in-app purchases, we collect your ZIP code or postal code and information regarding your virtual items or currency in the Petgotchi Games, including the amount of the transaction and records of purchases you have made.

2. How We Use Your Information

Petgotchi will use your information for the following purposes:

To sell advertising on the Petgotchi Games, as described in the “Advertising” section below.
To provide you with the products and services you request.
To allow you to log in to Petgotchi Games on multiple devices via Cloud Save.
To contact you with updates about Petgotchi Games (if you have subscribed to our newsletter).
To ensure consistency with local law and choices and controls that may be available to you.
To detect, investigate and prevent activities that may violate our policies or be illegal.

In addition, Petgotchi may use your information for the following purposes because these purposes are in Petgotchi’s legitimate business interests:

To optimize or improve our products, services, and operations.
To improve the Petgotchi Games and user experiences and to increase the functionality of the Petgotchi Games.
To monitor and analyze the Petgotchi Games usage and trends and otherwise measure the effectiveness of the services.

3. How We Share Your Information

Petgotchi will not share your personal information outside Petgotchi except in limited circumstances, including: will use your data for the following purposes:

When you allow us to share your information with another company, such as directing us to share your information with third-party sites or platforms, such as social networking sites.
When we contract or partner with a third party to provide services on our behalf, including Petgotchi Games development and maintenance.
When we share information with third parties in connection with the sale of all or part of the Petgotchi business, to enforce our Terms of Use or rules, to ensure the safety and security of our users and third parties, to protect our rights and property and the rights and property of our users and third parties, to comply with legal process or in other cases if we believe in good faith that disclosure is required by law.
As described in the “Advertising” section below.
When we are legally required to disclose information, including to comply with a legal obligation or processes, enforce our terms, address issues relating to security or fraud, or protect our users.
When we share information with companies within the Petgotchi corporate group who process your personal information in order to operate the Petgotchi Games. All related group companies may only use your information in accordance with this privacy policy.

Information Shared with Other Players: When you play our games, use social features within those games, or take part in live events, we will share certain Personal Data with other players. This Personal Data includes your in-game profile (such as your username, your avatar, your online status, and your team), your in-game actions and achievements, real-world locations associated with your gameplay, or with gameplay resources you interacted with when playing the game, and your in-game messages and related content you share with other players. Additionally, certain games link to third-party sharing features on your device that you can use to disclose Personal Data to others outside the Services; Petgotchi does not control and is not responsible for the practices of these third-party sharing features.

In addition, we may share aggregated information with third parties, however you will not be personally identifiable from such information.

Please note that once we share your information with another company in any of the circumstances set out above, the information received by the other company becomes subject to the other company’s privacy practices. However, when companies perform services on our behalf, like customer service, these companies are prohibited from using your information for purposes other than those requested by us or required by law.

You may request a notice disclosing the categories of information we have shared with third parties, and the names of those third parties. To request such notice, please contact contact@petgotchi.com.

4. Advertising

Petgotchi relies on advertising to fund the development and distribution of the Petgotchi Games, most of which are available to play at no cost to you. Accordingly, when you play the Petgotchi Games you may see third-party advertising. This advertising is delivered to the Petgotchi Games by advertising networks that sell advertising to interested third parties. Advertising networks collect a unique device ID or advertising ID (Apple Identifier for Advertisers (“IDFA”) on Apple devices and Google Advertising Identity (“GAID”) on Android devices) that enables the delivery of advertisements that are relevant to you. Your advertising ID is consistent across all apps and thus allows for cross-app tracking and interest-based advertising. Advertising IDs are non-permanent, non-personal identifiers uniquely associated with your device. Similar technologies include tracking pixels within ads. These technologies allow companies (including marketers and advertisers) to recognize your device when you use websites and applications. Advertising networks may use your device’s IP address to determine your approximate geographic location to enable them to deliver more relevant advertisements.

Some Petgotchi Games reward you with in-game currency (such as coins or gems) for watching advertisements (“Rewarded Ad”).

Please see the “Your Controls and Choices” section, below, for information on how to limit advertising tracking.

5. In-App Purchases

Certain Petgotchi Games may allow you to make In-App Purchases. All In-App Purchases are processed by a third party payment processor that may collect information directly from you (for example, they may request your billing address and credit card information) in accordance with its own privacy policy. Petgotchi’s third party payment processors do not share your financial information, like credit card number, with Petgotchi. We receive summary information about all purchases, including the amount of the transaction and your general location (such as your ZIP code).

6. Your Controls and Choices

We provide you the ability to exercise certain controls and choices regarding our collection, use and sharing of your information. In accordance with local law, you may be able to request access to the personal information we hold about you and request that we amend or delete it. You may exercise your controls and choices, or request access to your personal information, by contacting contact@petgotchi.com.

You may limit advertising tracking by changing the settings on your mobile device. On Apple devices you can opt out by choosing the “limit ad tracking” option in the privacy settings. On Android devices you can opt out by choosing the “Opt out of interest based ads” setting. Changing these settings will impact your ability to view Rewarded Ads.

7. Children

Unless stated otherwise for a particular game, our games do not address children, and we do not knowingly collect Personal Data from them. We define “children” as follows:

Residents of the UK: anyone under 13 years old.
Residents of the EEA: anyone under 16 years old, or the age needed to consent to the processing of personal data in your country of residence.
Residents of the Republic of Korea, anyone under 14 years old.
Residents of other regions: anyone under 13 years old or the age needed to consent to the processing of personal data in that region.

If Petgotchi discovers that we have inadvertently gathered personal information from a child under 13 years of age, we will take reasonable measures to promptly delete such personal information from our records.

If you are a parent or legal guardian of a child under the age of 13 (or under 16 in certain jurisdictions in the European Union) and you are aware that your Child has provided us with Personal Data, please contact us at contact@petgotchi.com.

8. Data Security, Integrity and Retention

The security, integrity and confidentiality of your information are important to us. We have implemented technical, administrative, and physical security measures that are designed to protect your information from unauthorized access, disclosure, use and modification. Please be aware though that, despite our best efforts, no security measures are perfect or impenetrable. We will retain your information for the length of time needed to fulfill the purposes outlined in this privacy policy unless a longer retention period is required, or for the establishment, exercise or defense of legal claims, or for legitimate business purposes, or as provided by law.

9. Data Transfers, Storage and Processing Globally

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside Singapore and choose to provide information to us, please note that we transfer the data, including Personal Data, to Singapore and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Petgotchi Pte. Ltd. will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

10. Changes to this Privacy Policy

From time to time, we may change this privacy policy to accommodate new technologies, industry practices, regulatory requirements, or for other purposes. If we make any material changes to this privacy policy, we will post the updated privacy policy here and notify our users. Please check this page frequently to see any updates or changes to this privacy policy.

11. Comments and Questions

If you have a comment or question about this privacy policy, please contact contact@petgotchi.com. The Petgotchi Games may contain links to other sites not owned or controlled by us and we are not responsible for the privacy practices of those sites. We encourage you to be aware when you leave our Petgotchi Games and to read the privacy policies of other sites that may collect your personal information.

12. Your Data Protection Rights under the General Data Protection Regulation (GDPR)

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Petgotchi Pte. Ltd. aims to take reasonable steps to allow you to correct, amend, delete or limit the use of your Personal Data.

If you wish to be informed about what Personal Data we hold about you and if you want it to be removed from our systems, please contact us.

In certain circumstances, you have the following data protection rights:

The right to access, update or delete the information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you.
The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
The right to object. You have the right to object to our processing of your Personal Data.
The right of restriction. You have the right to request that we restrict the processing of your personal information.
The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.
The right to withdraw consent. You also have the right to withdraw your consent at any time where Petgotchi Pte. Ltd. relied on your consent to process your personal information.

Please note that we may ask you to verify your identity before responding to such requests.

You have the right to complain to a Data Protection Authority about our collection and use of your Personal Data. For more information, please contact your local data protection authority in the European Economic Area (EEA).

13. Disclosures Specific to California Residents

California law requires that we make certain disclosures about your data. We do not sell your Personal Data. The information listed in Section 1 falls under the following California Consumer Privacy Act (CCPA) categories: identifiers, commercial information, Internet or other electronic network activity information, geolocation data, and visual information.
