Contempt Petition (C) No. 27 of 2016

The Contempt Petition with applications except Interlocutory Application

Nos. 7-10 were listed before the Hon'ble Court on 29.06.2016, with Office Report

dated 27.06.2016, when the Court was pleased to pass the following order:-

“In terms of the letter circulated on behalf of learned counsel for the petitioners, let the matters be listed after four weeks.”

It is submitted that Mr. Satyajeet Kumar, Advocate for the Petitioners has

on 26.08.2016 filed an application for impleadment as petitioners on behalf of

applicants viz. Ashok Kumar Prajapati and others and an application for

directions alongwith Vakalatnama/appearance. The said applications have been

registered as Interlocutory Application Nos. 7 and 8 respectively and stand

included in a separate volume with the Paper Books.

It is further submitted that Mr. Satyajeet Kumar, Advocate for the

Petitioners has on 07.092016 filed an application for impleadment as petitioners

on behalf of applicants viz. Gyan Chandra Saroj and others and an application for

directions alongwith Vakalatnama/appearance. The said applications have been

registered as Interlocutory Application Nos. 9 and 10 respectively and stand

included in a separate volume with the Paper Books.

It is next submitted that Mr. Satyajeet Kumar, Advocate for the

Petitioners has on 16.09.2016 filed Rejoinder Affidavit to Reply of Mr. M.R.

Shamshad, Advocate for Contemnor No. 1 with permission of the Court and the

same is being circulated before the Hon'ble Court as a separate volume.

It is again submitted that Mr. Satyajeet Kumar, Advocate for the

Petitioners has on 16.092016 filed an application for impleadment as petitioners

on behalf of applicants viz. Shashi Kapoor and others and an application for

directions alongwith Vakalatnama/appearance. The said applications have been

registered as Interlocutory Application Nos. 11 and 12 respectively and are being

circulated before the Hon'ble Court.

It is further submitted that an unserved cover containing the Contempt

Notice has been received in respect of Alleged Contemnor No. 2 with postal

remarks, “No such person residing on the address.” Hence service of Contempt

Notice is not complete in respect of Alleged Contemnor No. 2.

Contempt Petition (C) No. 464 of 2016

The Contempt Petition was listed before the Hon'ble Court on

08.08.2016, with Office Report dated 05.08.2016, when the Court was pleased to

pass the following order:-

“Issue notice to the respondents-contemnors, fixing a returnable date within six weeks.

The personal presence of the contemnors is dispensed with for the present.

Tag with Contempt Petition (C) No. 27 of 2016 in W.P. (C) No. 631 of 2004.”

It is submitted that pursuant to above Order, Contempt Notice returnable

for 19.09.2016 was issued to the respondents-contemnors by way of registered

parcels on 22.08.2016. As per tracking report of India Post, all the items stand

delivered on 27.08.2016, 02.09.2016 and 05.09.2016 respectively.

Hence, service of Contempt Notice is complete.

It is also submitted that the instant Contempt Petition has been tagged

with Contempt Petition (C) No. 27 of 2016 in W.P. (C) No. 631 of 2004 vide

Court's Order dated 08.08.2016.

The Contempt Petitions above-mentioned alongwith applications are

listed before the Hon'ble Court with this Office Report for Orders.
