According to Secretary McMahon, offices handling billions of dollars in grants for K-12 and higher education programs are being moved to the Department of Labor. There have already been attacks on the Office of Special Education and the Office of Civil Rights that will significantly impact the ability of students to get the free, appropriate public education that federal law mandates. These moves bypass Congress and appear to be illegal because only Congress has the authority to reorganize or close this department. They could disrupt essential services to students, especially those identified with disabilities, and remove recourse for students and their parents who have been neglected or discriminated against, especially those in sensitive groups. By moving programs to agencies that may lack relevant expertise, we are setting students, teachers, and schools up to fail.
