I am in receipt of your letters of the 27th[1] and 31st. ultimo.

 

In regard to the copy correspondence with which I furnished you, I beg to refer to my letter of the 1st ultimo and to say that the bundle is what it purports to be.[2] But in view of your observations, I withdraw the suggestion that there should be an agreement as regards the correspondence.

 

I think it is fair to point out that I have been to considerable trouble to obtain your client’s letters to his brother,[3] Baron Forster[4] and to Madame Van Riemsdyk;[5] and that whilst this course has interposed much delay in the matter, it was taken at your request and in the interest of your client.

 

The papers in the case have been laid before Counsel and the opinion of the Attorney General[6] has been invited. Until I have had advantage of this advice, I am unable to give you particulars of the matters to which the attention of the Committee will be drawn, or to deal further with any question of discovery.

 

In regard to the mode and date of trial, I am desirous that the Inquiry should be held at some date during the month of July next if the committee are willing; and subject to the convenience of the law Officers of the Crown I would agree that this be done. The question whether the Inquiry would be held in public will be determined by the

Committee, but I concur in your view that it should, and shall be prepared to support your request.

 

If it is still your intention to apply to the Committee on Wednesday, next, the 4th. instant, I shall be glad if you will inform me sometime tomorrow.
