Artist Commission Terms of Service
Prior to requesting a commission, the commissioner must read, understand, and accept the Terms of Service outlined below. Any failure to comply with the Terms of Service during the commission process may result in a refusal to begin or continue the commissioned work and/or a blacklisting from future commission opportunities.
Any questions, comments, or concerns should be addressed by direct messaging me either through FA notes (g472y or g471y) or through Discord (g472y) or Telegram (incongoat)
The artist reserves the right to amend the Terms of Service at any time.
In commissioning g472y/g471y/Inconspicuous (hereinafter referred to as ‘the artist’), you (hereinafter referred to as ‘the commissioner’) are purchasing the artist’s labor only. The artist will retain full publishing and commercial authority over the work produced by the commission unless otherwise stated in a written, formalized agreement.
The services with which these terms apply:
-Digital Artwork
-Story Writing
-Animation
- At any indication that the commissioner is below the age of 18, the artist reserves the right to immediately terminate the commissioned artwork and refund the payment.
- Requests for commissions may be made with any form of private direct messaging. The two available means at the moment are via FurAffinity notes or through private messaging on Discord or other platforms. Discord is the preferred means of communication.
- The artist reserves the right to refuse a commission based on subject material as well as interactions during the commission. Such subject material includes but is not limited to:
- Underage Characters
- Scat
- Excessive Gore
- Snuff
- Feet
- The full payment for commissioned artwork is required upfront from the commissioner unless otherwise specified. Commission work will not begin until the artist has received the full payment.
- Payment should be conducted in USD via Paypal or Commiss.io only.
- Due to recent policies enacted by PayPal, the link to the artist's PayPal has been removed from their FurAffinity page. An invoice will be provided after discussion and approval of the commission through direct messages only.
- Payment prices are listed on the most updated commission prices chart and are subject to change.
- The additional $10 fee for “Complex Backgrounds/Scenes” is up to the artist’s discretion based on the requested subject material from the commissioner.
- All changes to commission prices will be posted publicly as an updated commission prices chart.
- Refunds and commission cancellations can only be requested prior to the artist sending the first Work in Progress sketch.
- Any refunds that take place will have the cost of the processing and handling fees imposed by the third party broker subtracted from the refunded amount.
- Any commissioner who issues a chargeback after a Work in Progress sketch has been received will be immediately blacklisted from future contact and commissioning opportunities.
- The artist will always provide an uncolored Work in Progress sketch once the artist has finished the lineart.
- At the commissioner’s request, the artist will always provide a status update of the commissioned work prior to finishing the artwork.
- The quality of lineart and shading are final upon receiving the full payment.
- The artist does not claim ownership of any intellectual property (characters, locations, etc) unless otherwise stated (intellectual property created by the artist and explicitly requested by the commissioner)
- The artist reserves the right to post the commissioned artwork publicly to social media unless requested by the commissioner. The artist also reserves the right to deny such requests should they be unreasonable.
- Once the artist has finished the artwork, the commissioner will receive the full-resolution image to use for personal use only. Commercial use of the artist’s work must be agreed upon and delineated in a separate written contract.
- Any attempts to remove the artist’s signature from the final artwork as well as any attempts to pass off the artwork as the commissioner’s own will result in immediate blacklisting from future contact and commissioning opportunities.
- The commissioner reserves the right to request anonymity when the artist posts the artwork online. The commissioner will instead be referred to as “Anonymous.”
-For works which the commissioner wishes not to be distributed by the artist as outlined above, the artist reserves the option to issue an additional fee no more than 10% the cost of the commissioned work.
- The commissioner may upload any version of their commissioned artwork online as long as the artist is explicitly credited with a link to the artist’s social media page(s).
-Any edits made by the commissioner should be indicated clearly that they are done by the commissioner themselves.
- My work may not under any circumstance be used in the generation of or as a template with any artificial intelligence tools.
