Terms and Service Agreement

Borrowing Rules & Disclaimer for the Rockwood Common Tool Library

Rockwood Common Tool Library may also be referred to as Rockwood Common or “the tool library”.

Only residents or business owners within the service area and who are over the age of 18 years are eligible to borrow tools from the tool library.
Borrowers must be a member of the Rockwood Common Tool Library prior to borrowing tools. Registration includes verification of the borrower's identity (valid government-issued photo ID) and home address (utility bill or other such proof of address). Additionally, the borrower must sign the Terms & Conditions (Borrower’s Agreement and Waiver).
By taking possession of any item, the borrower is certifying that he/she/they is capable of using that item in a safe and proper manner.
Only the borrower is authorized to use tools from the tool library. The borrower shall not permit the use of items checked out to them by any other person.
Tool library tools are for personal use by owners or renters to repair or improve their own residences or businesses, and may not be used for commercial purposes.
The tool librarians at Rockwood Common Tool Library are your neighbors, we are not in any way tool experts. By signing the Borrower’s Agreement and Waiver, you are agreeing that neither we, nor our assigns or successors, can be held responsible for any injuries, deaths, property damage, or any other consequences of the use, or the transport, of our tools.
The borrower agrees that the tool library is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed tools.
The borrower agrees that if any borrowed tool is or becomes unsafe or in a state of disrepair, the borrower will immediately discontinue use of the tool and notify the tool library of the issue.
All tools borrowed are to be returned to the tool library one week from the day they are checked out. Tools may only be returned during open hours. Late fines ($1/tool/day of operation) will be levied for each item kept past the loan period.
Loans may be renewed before the return deadline. The tool library may need to refuse or limit renewals based on demand for those tools. Renewals may be requested in person, online, by email, or by phone during tool library operating hours.
All items are first come, first served. There are no reservations, with exception for a few oversized items that must be reserved.
Borrower understands and accepts that in an effort to maximize availability of tools to all Members, tool librarians may send emails as a reminder when borrowed tools’ return dates are approaching.
Items are to be returned clean and in the same condition as they were issued, barring normal wear and tear. The borrower agrees to pay for the loss of or damage to any item and further agrees to accept the tool library’s assessment of condition of items and to further agree to the tool library’s assessment of fair restitution for damage, dirtiness, delinquency and/or loss of items in part or in total. This restitution amount could equal replacement cost of the item plus handling and processing fees.
When tools are not returned by the designated due date, the tool library will issue an overdue notice by phone call or email. If the tools are not returned after the notice has been sent, appropriate steps will be taken to retrieve them. Rockwood Common Tool Library may replace severely delinquent tools after 6 months, and the borrower may be held responsible for full replacement cost plus applicable handling and processing fees.
Rockwood Common Tool Library retains the right to refuse to loan any item to any person for any reason whatsoever.

Rockwood Comon Tool Library Waiver and Indemnification

I state that I am capable and experienced in using the tools I am borrowing, and that I will use the tools I am borrowing in a proper manner.

I do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, waive any and all claims against Rockwood Common, Rockwood Common Tool Library, and our partner organizations, for any injury or injuries of any nature that I may suffer or incur in the use of the tools that I am borrowing from the Rockwood Common Tool Library.

I do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, agree to release and indemnify and hold harmless Rockwood Common, Rockwood Common Tool Library, and our partner organizations, and their officers, agents, employees, and volunteers from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use of tools I am borrowing from the Rockwood Common Tool Library. I affirm that the information provided is current, true and correct and may be subject to verification. I further state that I have read and fully understand the Borrowing Rules of the Rockwood Common Tool Library and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges. I have read and agree to this Waiver and Indemnification form, relinquishing any and all claims against Rockwood Common, Rockwood Common Tool Library, and our partner organizations.

I acknowledge that I have received and read a copy of the current Rockwood Common Tool Library Borrowing Rules and Disclaimer and agree to the terms and conditions therein. I understand that these rules may be updated at the discretion of Rockwood Common. The most current rules will be posted at the Rockwood Common Tool Library.

By agreeing to the Terms & Conditions upon signing up for the Rockwood Common Tool Library, I acknowledge and understand that agreement is the legal equivalent of my manual/ handwritten signature and I consent to be legally bound to this agreement.

Centro de Herramientas Compartidas de Rockwood Común

El Centro de Herramientas Comparidas de Rockwood Común, también puede denominarse Rockwood Común o “centro de herramientas compartido”.

Sólo los residentes o dueños de negocios dentro del área de servicio y que son mayores de 18 años son elegible para pedir herramientas prestadas en el Centro de Herramientas Compartidas.
Los prestatarios deben ser miembros del Centro de Herramientas Compartidas de Rockwood antes de pedir préstamos de herramientas. La inscripción incluye la verificación de la identidad del prestatario (identificación válida e emitida por el gobierno con fotografía) y la dirección de su casa (factura de servicios públicos o cualquier otra prueba de residencia). Además, el prestatario debe firmar los Términos y condiciones (Acuerdo y Renuncia del Prestatario).
Al tomar posesión de cualquier artículo o herramienta, el prestatario está certificando que él o ella es capaz de utilizar ese elemento de una manera segura y apropiada.
Sólo el prestatario está autorizado utilizar las herramientas del Centro de Herramientas Compartidas. El prestatario no permitirá el uso de los elementos prestados a ellos por cualquier otra persona.
Herramientas del Centro de Herramientas Compartidas son para uso personal por los propietarios o inquilinos para reparar o mejorar sus propias residencias o negocios, y no deben ser utilizados para propósitos comerciales.
Nosotros en el Centro de Herramientas Compartidas de Rockwood Común somos sus vecinos, no somos expertos en el uso de herramientas. Con la firma de Acuerdo y Renuncia del Prestatario, que usted acepta que ni nosotros, ni nuestros cesionarios o sucesores, seremos responsables de ninguna lesión, muerte, daños materiales, o cualquier otra consecuencia por la utilización o el transporte, de nuestras herramientas.

El prestatario está de acuerdo que si cualquier herramienta prestada que se devuelva que sea insegura o en mal estado, el prestatario deberá suspender inmediatamente el uso de la herramienta y notificar a el Centro de Herramientas Compartidas con el problema.
Todas las herramientas prestadas deben ser devueltas al Centro de Herramientas Compartidas una semana desde el día en que se fue sacado. Herramientas sólo podrán ser devueltas durante las horas abiertas. Multas serán recaudadas por cada artículo que mantiene más allá del período del préstamo ($1 por cada herramienta por cada día tarde que estamos abiertos).
Para solicitar una extensión del préstamo usted debe hablar con un Bibliotecario antes de la fecha de límite. El permiso se puede conceder, pero el Centro de Herramientas Compartidas puede tener que denegar o limitar las extensiones en base a la demanda de esas herramientas. Las extensiones se pueden solicitar en persona, por correo electrónico o por teléfono durante las horas de operación del Centro de Herramientas Compartidas.
Todos los artículos se entregan por orden de llegada. No se hacen reservas, salvo algunos artículos de gran tamaño que deben reservarse.
El prestatario entiende y acepta que, en un esfuerzo para maximizar la disponibilidad de herramientas para todos los Miembros, los Bibliotecarios pueden enviar mensajes de correo electrónico como recordatorio cuando la fecha de retorno se está acercando.
Los artículos o herramientas deben ser devueltas limpias y en las mismas condiciones en que fueron emitidos, salvo el desgaste normal. El prestatario se compromete a pagar por la pérdida o daño de cualquier elemento y acuerda aceptar la evaluación de Bibliotecario del estado de los equipos y de acuerdo además con la evaluación de Bibliotecario de las restituciones justas por los daños, suciedad, delincuencia y/o pérdida de artículos en parte o en su totalidad. Estas restituciones podrían igualar el costo de reemplazo del artículo más gastos de envío y gastos de tramitación.
Cuando las herramientas no son devueltas en la fecha designada, el Centro de Herramientas Compartidas emitirá un aviso de retraso por llamada telefónica, correo electrónico. Si las herramientas no son devueltas después de que el anuncio se haya enviado, se tomarán las medidas adecuadas para recuperarlos. Rockwood Común puede reemplazar herramientas gravemente atrasadas, responsabilizando el prestatario por el costo total de reemplazo más los gastos de manejo y procesamiento aplicables.
Rockwood Común se reserva el derecho de negarse a prestar cualquier artículo a cualquier persona por cualquier motivo.

Renuncia e Indemnización

Yo declaro que soy capaz y con experiencia en el uso de las herramientas cuales estoy tomando prestado, y que voy a utilizar las solamente de una manera apropiada.

Yo y en nombre de mis sucesores y cesionarios por este medido, en consideración de que se me permita prestar herramientas, renuncio a cualquier y todas las reclamaciones contra Rockwood Common, el Centro de Herramientas Compartidas de Rockwood Común, y nuestras organizaciones asociadas, por cualquier lesión o daños de cualquier clase que pueda sufrir o incurrir en el uso de las herramientas que estoy tomando prestado de el Centro de Herramientas Compartidas de Rockwood Común.

Yo y en nombre de mis sucesores y cesionarios por este medido, en consideración de que se me permita prestar herramientas, doy acuerdo a liberar e indemnizar y mantener Rockwood Common, el Centro de Herramientas Compartidas de Rockwood Común,y nuestras organizaciones asociadas, y sus funcionarios , agentes, empleados y voluntarios de cualquier y toda responsabilidad, pérdida, reclamos y demandas, acciones o causas de acción por la muerte o lesiones a las personas y de los perjuicios materiales sufridos o incurridos por cualquier persona que se presenta o puede surgir o ser ocasionado en modo alguno por el uso de las herramientas que estoy tomando prestado de el Centro de Herramientas Compartidas de Rockwood Común . Yo afirmo que la información está actualizada, fidedigna y correcta y puede ser objeto de verificación. Además declaro que he leído y entendido las reglas de endeudamiento de el Centro de Herramientas Compartidas de Rockwood Común y entiendo que el incumplimiento de cualquiera de estas reglas puede resultar en la revocación de mis privilegios de préstamo y / o acciones legales en mi contra. He leído y estoy de acuerdo con esta renuncia y la forma indemnización, renunciando a cualquier reclamación contra Rockwood Común, el Centro de Herramientas Compartidas de Rockwood Común, y nuestras organizaciones asociadas.

Reconozco que he recibido y leído una copia de las reglas de préstamo del Centro de Herramientas Compartidas de Rockwood Común y acepto los términos y condiciones de los mismos. Entiendo que estas normas se podrán modificar a discreción de Rockwood Común. Las reglas más actuales serán publicadas en el Centro de Herramientas Compartidas de Rockwood Común.

Al aceptar las Bases y Condiciones al registrarme en Centro de Herramientas de Compartidas de Rockwood Común, reconozco y entiendo que el acuerdo es el equivalente legal de mi firma manuscrita y doy mi consentimiento para estar legalmente obligado por este acuerdo.

Điều Lệ Mượn và Lời Từ Chối Trách Nhiệm đối với Thư Viện Về Dụng Cụ Cộng Đồng Rockwood Common (“thư viện về dụng cụ”)

Chỉ những cư dân hoặc chủ doanh nghiệp trong khu vực phục vụ và trên 18 tuổi mới đủ điều kiện mượn dụng cụ từ thư viện dụng cụ
Những người mượn dụng cụ phải là hội viên của Thư viện Dụng cụ Rockwood Common trước khi mượn dụng cụ. Ghi danh bao gồm kiểm chứng căn cước của người mượn dụng cụ (chứng minh nhân dân có ảnh do chính phủ cấp còn hiệu lực)) và địa chỉ tư gia (hóa đơn tiện ích hoặc thứ khác có chứng minh địa chỉ). Ngoài ra, người mượn phải ký vào Điều khoản & Điều kiện (Thỏa thuận và Từ bỏ trách nhiệm của Người mượn).
Khi sở hữu bất cứ dụng cụ nào, người mượn dụng cụ người mượn xác nhận rằng anh/chị/quý vị có đủ khả năng sử dụng món đồ đó một cách an toàn và đúng cách.
Chỉ có người mượn được phép sử dụng dụng cụ của thư viện về dụng cụ. Người mượn dụng cụ không được cho phép bất cứ người nào khác sử dụng những vật dụng được đem ra khỏi thư viện.
Những dụng cụ của thư viện về dụng cụ dành những sở hữu chủ, người thuê mướn sử dụng cho cá nhân để sửa chữa hoặc cải tiến nơi cư trú hoặc cơ sở thương mại của họ và không được sử dụng trong mục đích thương mại.
Chúng tôi hiện diện tại Rockwood Common và với tư cách là quản thủ thư viện là hàng xóm cuả quý vị, , và chúng tôi không phải là chuyên gia về dụng cụ. Người mượn dụng cụ đồng ý rằng nếu có bất cứ dụng cụ nào được mượn bị hoặc trở nên không an toàn hoặc trong tình trạng không được sửa chữa, người mượn dụng cụ sẽ ngưng ngay tức khắc việc sử dụng dụng cụ và thông báo cho thư viện về dụng cụ biết vấn đề.
Tất cả những dụng cụ được mượn phải được hoàn trả thư viện về dụng cụ một tuần lễ kể từ ngày lấy vật liệu ra. Những dụng cụ chỉ có thể được hoàn trả trong giờ làm vệc. Tiền phạt trễ hạn ($1/dụng cụ /ngày hoạt động) sẽ được áp dụng cho mỗi dụng cụ quá hạn thời kỳ cho mượn.
Để xin gia hạn mượn quý vị phải nói chuyện với quản thủ thư viện về dụng cụ trước hạn chót phải hoàn trả. Việc mượn dụng cụ có thể được gia hạn trước hạn trả. Thư viện dụng cụ có thể từ chối hoặc giới hạn số lần gia hạn tùy theo nhu cầu sử dụng dụng cụ. Quý vị có thể yêu cầu gia hạn trực tiếp tại thư viện, trực tuyến, qua email hoặc qua điện thoại trong giờ hoạt động của thư viện.
Tất cả các mặt hàng đều được phục vụ theo thứ tự đến trước. Không có đặt chỗ trước, ngoại trừ một số mặt hàng quá khổ phải được đặt chỗ trước.
Người mượn dụng cụ hiểu và chấp nhận rằng trong sự nỗ lực để tăng lên tính sẵn có của các công cụ cho tất cả Hội Viên, quản thủ thư viện về dụng cụ có thể gửi emails để nhắc nhở khi những dụng cụ được mượn đã gần đến hạn phải hoàn trả.
Những dụng cụ mang trả lại phải sạch sẽ và giống như điều kiện vào lúc cấp phát, ngoại trừ cũ và hư rách tự nhiên. Người mượn dụng cụ thoả thuận thanh toánbất kỳ thiệt hại hoặc mất mát nào đối với các món đồ và chấp nhận đánh giá của thư viện dụng cụ về tình trạng của chúng, cũng như đồng ý với việc thư viện đánh giá mức bồi thường hợp lý cho thiệt hại, dơ bẩn, trả muộn, và/hoặc mất mát toàn bộ hoặc một phần các món đồ. Số tiền phục hồi này có thể tương đương với chi phí thay thế dụng cụ cộng thêm lệ phí bảo quản và gia công.
Khi dụng cụ không được trả đúng thời hạn chỉ định, dụng cụ sẽ ban hành một thông báo quá hạn qua điện thoại, email. Nếu sau khi thông báo được gửi mà dụng cụ vẫn không được trả, các biện pháp thích hợp sẽ được thực hiện để thu hồi chúng. Thư viện Dụng cụ Rockwood Common có thể thay thế các dụng cụ bị quá hạ nghiêm trọng sau 6 tháng, và người mượn có thể phải chịu trách nhiệm thanh toán toàn bộ chi phí thay thế, cùng với các khoản phí xử lý và quản lý áp dụng.
Rockwood Common dành quyền từ chối cho mượn bất cứ dụng cụ nào cho bất cứ người nào vì bất cứ lý do gì.

BÃI BỎ VÀ BỒI THƯỜNG cuả Thư Viện Về Dụng Cụ Cộng Đồng Rockwood Common

Tôi tuyên bố rằng tôi có khả năng và kinh nghiệm sử dụng những dụng cụ tôi mượn, và tôi sẽ sử dụng đúng cách những dụng cụ tôi mượn.

Tôi nhân danh bản thân, thay mặt cho người kế nhiệm tôi và người tôi chỉ định, trong việc được phép mượn dụng cụ, xin bãi bỏ bất cứ hoặc mọi khiếu nại với Rockwood Common, Thư Viện Về Dụng Cụ Cộng Đồng, và thàn phố Gresham về thương tích hoặc những thương tích dưới mọi trạng thái mà tôi gây ra trong khi sử dụng phương tiện tôi mượn của Thư Viện Về Dụng Cụ Cộng Đồng Rockwood Common.

Tôi nhân danh bản thân, thay mặt cho người kế nhiệm tôi và người tôi chỉ định, trong việc được phép mượn dụng cụ, đồng ý giải toả và bồi thường và không gây thiệt hại cho Rockwood Common, Thư Viện Về Dụng Cụ Cộng Đồng, và thành phố Gresham và những viên chức của thành phố, các cơ quan, các công nhân, và những thiện nguyện viên phải gánh chịu bất cứ hoặc tất cả trách nhiệm, mất mát, khiếu nại, và những đòi hỏi, những hành động và nguyên nhân của hành động đưa đến tử vong hoặc thương tích cho bất cứ người nào và đối với mọi thiệt hại về tài sản do bất cứ người nào phá hoại hoặc gánh chịu và có thể xảy ra hoặc trong trường hợp nào đó do bất cứ cách nào từ việc sử dụng những dụng cụ mà tôi mượn của Thư Viện Về Dụng Cụ Cộng Đồng Rockwood Common. Tôi xác nhận những tin tức trên đây là có, đúng sự thật và chính xác và có thể phải được kiểm chứng. Ngoài ra tôi báo cáo thêm rằng tôi đã đọc và hiểu đầy đủ về Điều Lệ Mượn dụng cụ của Thư Viện Về Dụng Cụ Cộng Đồng Rockwood Common và tôi hiểu rằng nếu không theo đúng những điều lệ này có thể đưa đến kết quả thu hồi đặc quyền mượn dụng cụ. Tôi đã đọc và thoả thuận Bãi bỏ và Bồi Thường, từ bỏ bất cứ hoặc tất cả các đơn khiếu nại với Rockwood Common, Thư Viện Về Dụng Cụ Cộng Đồng.

Tôi xác nhận tôi đã nhận và đọc bản sao Điều Lệ Mượn và Lời Từ Chối Trách Nhiệm cuả Thư Viện Về Dụng Cụ Cộng Đồng Rockwood Common và thoả thuận những điều khoản và điều kiện trong bản này. Tôi hiểu rằng những điều lệ này có thể được cập nhật theo ý định cuả Rockwood Common. Hầu hết các điều lệ hiện hành sẽ được niêm yết tại Thư Viện về Dụng Cụ Cộng Đồng Rockwood Common.
