MIHARU’S ART COMMISSIONS

                   TERMS OF SERVICE:

NOTE: ***By commissioning me, you are automatically agreeing to my TOS. If you have not read this article before commissioning me, that is no fault of my own! This document is subject to change at any time. ***

09/06/2014: Commissioners must be 18 years of age or older to commission me. I do NOT accept commissions from minors as they are legally unable to be bound by contracts. I no longer accept commissions from minors even with parent/guardian approval.

  General Info

  • My preferred method of communication is e-mail (Miharu_Commissions@yahoo.com), and Skype (Miharu_Commissions). Skype is acceptable for quick exchanges and small inquiries. Full information and details need to be sent by email.

  • I am comfortable drawing a wide variety of subject matters, but I have my strengths and weaknesses. I am open to all different types of animal species (including humans). I am willing to try almost any different types of settings, and scenarios. I am not very comfortable with heavy machinery, intricate armor, vehicles, detailed weaponry, or complex architecture. Even though I’m willing to try anything, I may still refuse your commission. Please look at my gallery and familiarize yourself with my work before commissioning me. When in doubt just ask!!!!

  • It is the responsibility of the commissioner (that’s you) to provide me with all necessary information to complete the commission. I refuse to look in your gallery for examples of your character. (This slows me down)

  • Please do not hound me for a commission. As an artist there are certain conditions I can not work under and pressure is a major one. Remember I may have other commissions and there may be some people ahead of you. If you have yet to hear or see any updates on a commission after 1-2 weeks time, please send a kind inquiry asking about your commission. I will not begin any commission(s) until I am paid in full. Once your commission(s) is fully paid off you are guaranteed a spot on my commission list and you are guaranteed art. ALL SALES ARE FINAL.

  • Be sure to check my art queue located on my front page and journals as thats where I post updates. You can use the art queue to get an idea of how far your commission has progressed and to see your spot in line. Journals are used to update multiple commissioners when I do not have the time to message anyone individually. You may still email me however.
  • Smaller commissions e.g. like icons, badges, etc aren't usually added to my queue due to how fast they're completed and because they are worked on in between large commissions. If you are concerned about your commission I am an email or Skype message away!

   

Detailed "Will Do/Won’t Do" List

If unsure whether or not I will draw something, just ask! I assure you I do not judge others for their interests or ideas, and such inquires will be kept private. Generally I am very open minded so if you have an idea feel free to approach me. If I refuse to draw something do not feel bad. It doesn't in any way reflect my thoughts or feelings of the person. Certain subject matters are just harder for me to draw than others

I'm Willing to Draw:

  • People
  • Compositions with Tasteful nudity
  • Adult Compositions (please see the "Will not do at all" section for what adult art I will not draw)
  • Feral art
  • Some Rule 34
  • Macro and Micro
  • Watersports (I may still refuse to do these kind of commissions but I am more open to the idea)
  • Cub art

 

Will not do at all:

  • Cubs in adult situations or messy diapers
  • I will not draw anything I deem hateful in nature towards any person/race/orientation/religion, etc.
  • Scat
  • Gore that I deem excessive
  • Zoo/Zoophilia art e.g. Feral x Human art (Anthro animals x humans I would be more willing to draw)
  • Hyper

Payment/Payment Method

  • Payment is due up-front before any work is to begin. In the case of icons however, payment is due upon completion of your icon. Do not send me payments. I will invoice you. Please not final quoted price of your commission doesn't include tax unless stated otherwise. Tax is calculated as the invoice is being made. If you'd like to know how much your commission is after tax please let me know.
  • I do offer a half and half payment plan if it's needed! Bare in mind work will not begin until all funds are received.
  • PAYPAL ONLY. No e-cheques. No exceptions.
  • Please have payment ready within 48 hours of your commission being accepted. If payment is not provided promptly, your slot may be given up to another at my discretion.

 

Refunds

  • 24 hours after paying for a commission from me you may back out of a commission for any reason. I understand life happens or finances may have been miscalculated. If not done within this grace period consider the deal as sealed.
  • If I am unable to start your commission for some reason I -will- refund you in full.
  • I the Artist (that’s me) reserves the right to issue a refund and cancel a commission, at any time, due to poor communication, rude or inappropriate behavior or the inability to communicate in effective English.
  • In the case of a cancellation on my part due to personal matters, you -will- be refunded in full if no work has begun or partially if work has begun.
  • In the case of a cancellation on your part due to poor commissioner conduct, you -may- receive a partial refund.
  • Artwork is non-refundable once complete.

Edits and Alterations

  • I will provide the commissioner 1 Work in progress sketch for approval (For Painting, Line Art commissions only). Once approved I will not edit the pose or expressions any further. If further alterations are requested a fee will be charged.
  • Icons, Sketches and badges commissions are treated differently. These do not have any approval stages.
  • Generally I do not allow any more than two alterations (unless they are my mistakes) before asking for compensation, but this is subject to vary depending on the project, size of the alterations and amount initially paid.
  • After 2 alterations to your Approval sketch, if you are still unsatisfied I will have to ask for compensation. If you'd like a re-draw of the same pose/idea but done a bit differently, this is half the price of a regular sketch of that style. If you'd like a Completely redrawn pose/idea, then it is the full price of a regular sketch.
  • I reserve the right to reuse any discard/disapproved poses/wips for my personal use which includes but not limited to Ychs, adoptables etc
  • Any discarded poses or ideas belong to me ans you may not upload them or take them for your own. Once you disapprove the pose/WIP you relenquish any rights of posting it.

Turn-around and Deadlines

  • Commissions are generally worked on one at a time, in the order in which they were received. If you are at the bottom of the queue do not rush me. I will drop commissioners who are too pushy.
  • I do NOT work by deadlines, I will try my best to get your art finished within 1-3 weeks time with three months being the maximum wait time, but very rarely does it take that long. I do my best to get art done as quickly as possible, but time taken can vary greatly depending on a multitude of factors --complexity, communication, how many people are ahead of you in my queue, sickness, family issues, fursuit work on the side etc.
  • If you need something done by a certain date, I require at least two weeks notice. Furthermore, if you do want to set a deadline, please be clear about this and make sure I have AGREED to said deadline. Otherwise, deadlines are not usually accepted.

RUSH FEES:

*** I accept a rush fee for those who want to be moved to the first slot of my queue. I will accept them at my discretion and I will charge however much I deem the piece is worth for rushing it. Please keep in mind that your place in my queue also affects the pricing of your rush fee. The further down the line you are, the more it will cost to cut in line.

How I work

  • Majority of the time, I'm very strict when it comes to first come, first serve. It's only fair to those who pay first.
  • Rarely though, I do need to jump around just a bit. Only when all those commissions have a similar time frame on who paid first (i.e, a couple hours difference to a day or two). It does happen that I sometimes need a break from a commission I'm working on, feel I would have an easier time sketching today rather than inking or I simply have a lot of inspiration for a different piece. I do this to make sure you each get the best possible piece. So if you do see a bit of jumping around, please do not fret! You will not be pushed aside for new commission, except for small items, see below.
  • Once in a while, I will take on small commissions, icons or sketches, which will be done in-between commissions. I consider these warm-ups and would need to do a warm-up before your commission, paid or not, so it honestly does not get in the way.

*****Mistakes in commission queue sometimes happen. Emails are accidentally deleted while cleaning out my inbox or sometimes there are technical errors with the queue itself. If you are missed please inform me right away so that I may add you and correct my queue immediately.

Rights

  • I reserve the right to refuse any commission for any reason, and I am in no way obligated to provide a reason in the case of refusal.
  • Unless I have explicitly stated otherwise, I will retain all copyright to my artwork, even when characters contained within the work belong to the commissioner. It is in my right as the artist to post, distribute, copy, or reproduce images for promotion, prints etc..
  • You are free to post any commission done for you to a personal/public gallery, so long as credit is provided and my signature showing. I do, however, require that you do not re-post full resolution commissions to public galleries, and do not remove my signature on the image.
  • I am not obligated to post your commission to my gallery, or anywhere else nor link to your page.
  • You have permission to alter/crop/edit your commission for websites, banners, signatures, icons ,and so on provided there is credit.
  • You have permission to make prints/copies of the image so long as it is for personal use and no profit is made.
  • Please discuss with me if you want to purchase an image's full copyright/publishing rights.
  • I reserve the right to use rejected sketches (i.e. if you rejected a sketch for a whole new pose) for my own use, but I will  alter it so the character doesn't look like yours.

  • If you are waiting on a commission, I require that the commissioner give at least a weeks time after each update before asking for another. I do not want to leave anyone in the dark, but I also do not like being hounded as it can kill my motivation. Unless there is a deadline.
