GHOST DA VINCI’S TERMS OF SERVICE

Please read thoroughly before commissioning to avoid any confusion or issues.

By commissioning me (Ghost Da Vinci), you are agreeing to the terms and conditions outlined below. These are put in place to protect both the artist and the client.

OVERVIEW

  • These Terms of Service exist to ensure transparency and protect both parties.
  • By default all art commissions done by Ghost Da Vinci are for personal use unless stated otherwise. Commercial use has additional charges, see the Commercial and Licensing Rights section for more details.
  • Breaking or violating any part of this agreement may result in the client being blocked, blacklisted, and permanently refused service in the future.
  • All artworks are digital or in jpeg/png only — no physical products will be shipped.
  • Please keep in mind my current skill level and what I can/cannot draw (see “What I Will and Will Not Draw”).


WHAT I WILL AND WILL NOT DRAW

I Can Draw:

  • Original Characters (Anthros / animal ears / light monster traits included)
  • Semi-Nsfw (18+ characters)
  • Mild Gore or Blood
  • Real People / Portraits of People
  • Pairings, Poly-ships

I Will Not Draw:

  • Heavy mecha or tech
  • Armor
  • Complex Reptiles and Monsters
  • Heavy gore
  • Non-con
  • Pro-ships
  • Full Nsfw (Genitalia)
  • Hate art, political content
  • AI/NFT-related work
  • Overly detailed background Illustrations


PAYMENT & PRICING

Payment Methods:

  • GCash
  • Paypal

If anyone contacts you pretending to be me with a different GCash number, it is a scam. I am not responsible for those transactions.

Down-Payment: A 50% down payment is required to secure your commission slot. This deposit confirms your commitment and protects both the artist and the client from potential scams.

A sales invoice will be issued for both the down payment and the final payment as proof of transaction.

The remaining 50% is due once the base colors are completed and approved, and must be settled before the final artwork is submitted.

Clients may also choose to complete the full payment earlier at their convenience. Work beyond the base color stage will only continue once full payment has been received.

Rush Orders: Need it within 4 days? There is a +30% of total regular cost of commission rush fee.

Pricing Adjustments: Complexity charges may apply for very detailed outfits, props, or character designs. I will always notify you first before applying any additional costs.


REVISIONS & CHANGES

Sketch Stage: You may request unlimited free revisions during the sketch phase. This is the stage for major changes such as pose, expression, outfit, or overall composition. Please finalize all major details before rendering begins. Once the sketch is approved, I will proceed to the next stage, and further large-scale edits will no longer be free.

Rendering Stage: After the sketch is approved and rendering has started, you are entitled to 3 free minor revisions (such as lighting adjustments, color tweaks, or small detail fixes). Anything beyond the 3 free revisions will incur an additional 15% fee per change, depending on complexity.

Major Changes or Redos: Requests to completely redo or “start over” after rendering has begun are treated as new commissions, unless otherwise agreed upon.

Post-Completion: Once the final artwork is approved and delivered, only small corrections (e.g., typos, color balance) will be accepted. No major edits will be made after completion.

Artist Responsibility: If a mistake was made on my part (missing details, incorrect design, etc.), I will fix it free of charge, regardless of the revision count.

Client Responsibility:  Please provide clear and specific feedback to prevent confusion and unnecessary revisions. Excessive or unclear revision requests may delay your commission or result in additional fees.


CANCELLATIONS & REFUNDS

Cancellation Policy:

You may cancel within 36 hours of ordering. After that, 40% of the total price must still be paid if I have already started working.No cancellations will be accepted if the artwork is halfway done or fully rendered.

Refund Policy:

  • Exception:
  • a.) The Artist cannot complete the Commission within the specified time frame and the Client has disagreed for an extended allowance of time, upon which the client shall be refunded in the following percentage of their payment based on degree of completion of the work:
  • a.1.) Seventy-Five (75) Percent Complete - Twenty-Five (25) Percent Refund;
    a.2.) Fifty (50) Percent Complete - Fifty (50) Percent Refund;
    a.3.) Twenty-Five (25) Percent Complete - Seventy-Five (75) Percent Refund;
    a.4.) Zero (0) Percent Complete - Full Refund;
  • Provided, that by the time the Artist reaches out to the Client, the Commission has been accepted AND the Duration Time has begun to run. The absence of one shall render a demand for refund void and the No Refund Policy shall apply.
  • b.) The Artist has offered to refund the Client under the following reasons:
  • b.1.) Delay due to personal circumstances;
    b.2.) Deterioration of amicable communication between the
    Client and the Artist;
  •  b.3.) Deterioration of business relations between the Client and the Artist;
  • Provided, that both or either parties have tried to salvage the communication or business relations and that no resolution acceptable to both parties was reached. Provided further, that when no acceptable resolution has been reached, the Artist shall keep the payment as the Client’s Nuisance Fee or for nominal damages.
  • If I personally cannot complete your commission for any reason, you will receive a full refund regardless of progress. Personal reasons may include, but are not limited to, health concerns (physical or mental), family emergencies, unforeseen personal obligations, or circumstances that may affect my ability to deliver the work at the expected quality or within the agreed timeframe. In such cases, I reserve the right to issue a refund without further disclosure of specific details, as these reasons are already covered under this clause.


DEADLINES & TURNAROUND

  • I currently complete approximately one (1) commission per 10 days. Depending on your position in the queue, your commission may take a minimum of four (4) weeks and a maximum of seven (7) weeks to complete, excluding Saturdays and Sundays.
  • Please keep this timeline in mind before placing your order.
  • Commissions are handled on a first-come, first-served basis. Once all active slots are filled, you can still join my waitlist — you won’t need to pay until your slot is coming up. I will contact you when it’s your turn.
  • Payment for waitlisted slots is only requested once I’m ready to start your piece. This ensures you’re not paying months in advance.
  • You may request updates (WIPs) at any time.
  • I will inform you of any delays.


COMMUNICATION

  • If I do not receive a response within 7 days, your slot may be cancelled or moved to the bottom of the queue.
  • If the Client is rude, disrespectful, or aggressive, I reserve the right to cancel the commission without refund and permanently block the Client.
  • The following behaviors shall be considered rude, disrespectful, or aggressive conduct, including but not limited to:
  • The use of insults, profanity, or demeaning language directed toward me or my work;
  • Unsolicited harassment, such as repeated messages after being asked to wait or refrain from contacting;
  • Disrespecting artistic boundaries, including forcing changes beyond what was agreed upon or demanding work not included in the commission terms;
  • Aggressive negotiation or coercion, such as threatening chargebacks, defamation, or negative exposure to pressure a response or revision;
  • Any form of discrimination or hate speech based on race, gender, sexuality, religion, or other personal attributes.
  • These rules are in place to maintain a safe, respectful, and professional environment for both the Artist and the Client.
  • Mode of Communication:

COMMERCIAL AND LICENSING RIGHTS

By default, all commissioned artworks by Ghost Da Vinci are for personal use only. If the CLIENT wishes to use the artwork for profit, promotion, or business purposes, a commercial license or rights agreement must be purchased separately. The ARTIST retains all moral and intellectual property rights unless explicitly stated otherwise in writing.

Ownership & Copyright
  • The ARTIST retains full copyright of all artworks.
  • Purchasing commercial or exclusive rights does not transfer ownership.
  • The CLIENT may not claim, resell, or alter the artwork without permission.
  • Full Rights / Copyright Transfer (complete ownership) is available upon request.
  • Fee: +700–1000% of base price.
Commercial Use License
  • Allows use for profit, promotion, or monetized content (e.g., branding, ads, YouTube, events).
  • Small business / indie creator — +200% (Triple the Base Price)
  • For independent creators or small teams using the art for monetized or branding purposes. (e.g., VTuber assets, YouTube banners, self-published book covers, small online shops.)
  • Not for agencies or large-scale brands.
  • Mid-size project — +500% (Six Times the Base Price)
  • For indie studios, small companies, or collaborative events using the art in monetized or promotional materials. (e.g., indie games, small publishers, conventions, crowdfunding, group campaigns.)
  • Major / international campaign — +1000% (Eleven Times the Base Price)
  • For large-scale brands, agencies, or international campaigns that use the artwork in widespread promotional, advertising, or monetized materials. Examples include:
  • Official company branding or global marketing
  • International events, ad campaigns, or merchandise lines
  • Mass-produced or franchised products

Merchandising Rights
  • For products or merchandise featuring the artwork.
  • Small batch (<100 units) — +200%
  • Medium (100–500 units) — +300%
  • Large-scale (500+) — +400–500% or 5–10% royalties
Distribution & Licensing Rights
  • For sublicensing or third-party use (e.g., publishers, partners, collaborators, affiliated brands, or distributors). Fees:
  • +100% — For limited distribution to one (1) third party or a single platform.
  • +150% — For distribution or sublicensing across multiple third parties or platforms under the same project.
  • +200% — For broader commercial distribution, such as retail sales, external publishing, or use by multiple affiliated partners.
  • The Client must clearly disclose where and how the license will be used, including all third parties, publishers, or platforms involved. Any unauthorized redistribution, sublicensing, or use beyond the agreed scope will be considered a breach of contract and may result in revocation of rights and additional charges.

Lifetime License
  • For clients who wish to obtain permanent, transferable, and exclusive rights to distribute or sublicense the artwork across any platform, project, or collaboration, without limitation of time or scope.
  • Fee: — +1000% (Exclusive, Permanent Rights)
  • This includes, but is not limited to:
  • Long-term partnerships or publishing contracts
  • Ongoing brand collaborations or franchises
  • Mass production, merchandising, or international distribution
  • Once a lifetime license is purchased, no renewal or additional licensing fees will apply for that artwork.

Terms:

  • All commercial fees are non-refundable.
  • Unauthorized commercial use = copyright infringement.
  • All rights not explicitly purchased remain with the ARTIST.
  • You may NOT:
  • Claim the artwork as your own
  • Resell or reproduce it for profit without paying the commercial price
  • Feed it to AI or mint it as an NFT

CREDIT

  • Please credit me (Ghost Da Vinci) when posting or sharing the artwork.
  • Do not remove my signature or watermark.
  • Cropping for profile icons or layout edits is okay, as long as proper credit is given.
