TERMS OF SERVICE

Current as of: 12/16/2023

You are solely responsible for reading through my terms of service before paying for your commission. By paying for your commission, you are agreeing to these terms as they are written at the time of payment being sent!

I reserve the right to decline any commission for any reason, stated or not.

✨Contact Information✨

You may contact me in a few different ways (pink text is clickable):

X (@vcrshark) via DM

Instagram (@vcrshark) via DM

Email (kristinpinkham@gmail.com)

I do my very best to get back to people within the same business day the message is sent to me, but please allow 24 hours for a response.

If I am away for personal reasons, I will try to respond within 24 hours to let you know an alternate time frame for when you can expect a response.

✨What I Draw✨

I am a furry artist and prefer to draw animals, including anthros/furries and pets. I don’t generally accept humanoid commissions unless specifically offered.

I am LGBT and will always be happy to draw your LGBTQ+ characters!

I am happy to draw ANY canids, felines, mustelids, and otherwise “uncommon” species. I have experience drawing: monkeys, horses, cows, deer, dragons, birds, sharks, and much more. If it’s an animal or animal-adjacent, I will draw it (at my discretion).

I am a SFW (safe for work) artist and ask that all provided reference materials also be SFW or otherwise censored.

By commissioning me, you trust me to render your character in my own personal style. I am always trying to adjust my process and certain features and techniques may not be consistent in every piece. If there is a particular detail you enjoy in my work and wish to see replicated in your commission, please let me know and I can accommodate!

✨Payment✨

Payment is in USD only. Client is responsible for conversions if applicable.

Payment must be made upfront by invoice through Paypal. Occasionally Paypal.me may be utilized for convenience. Please make sure you are paying via ‘Goods and Services’ when sending payment.

I can also process payments through Stripe, Square, Venmo, or CashApp upon request.

Payment should be made promptly and in full, preferably within 24 hours unless otherwise discussed ahead of time. I do not hold slots except under special circumstances for clients I have established rapport with.

Tips are never required but are always appreciated!!

Posting and Use Policy

I retain all rights to all art I produce and reserve the right to post any and all commissions and work in progress images.

If you wish for your commission to be kept private or anonymous, I must be notified upfront. A 15% privacy fee may be applicable if I’m not allowed to post. (Does not apply to gifts that need to be kept secret but will eventually be posted.)

On digital commissions, I will provide you with a watermarked and non-watermarked version of your commission. I ask that clients use the watermarked copy if posting it anywhere publicly. Written credit is appreciated and/or you are welcome to tag me.

You MAY NOT:

do anything with my art that generates a profit. We can discuss upfront an additional merchandising fee to allow this

use my work for NFTs or other blockchain-related activities

get my art tattooed by another artist, unless it is discussed and allowed beforehand (I am planning to become a tattoo artist and this is stepping on my toes)

YOU MAY:

print commissioned art for personal use (ex. wall art, badges, stickers NOT for profit)

use your commission as a social media icon, banner, or general website decoration (with credit or watermark)

make personal edits to your commission at a later time

have an artist re-interpret your commission for a tattoo design

You are solely responsible for figuring out optimal settings for personal printing; I cannot be on call for assistance or advice. It is helpful to note that I work in an RGB color format and colors may not always convert accurately when printing.

If you know ahead of time that you will likely print your commission, let me know upfront and I will try to work with CMYK considered.

✨Commission Process✨

In your initial message, please provide me with a clear and accurate reference of your character(s).

The best references are: un-shaded, have color swatches, provide clear visuals of all important markings and details, and clearly state the character’s species. I can and will work from any reference or images you have on hand, but these things make my life easier if they can be provided on a single reference.

If you have a specific pose, expression, or details in mind, please be sure to mention them! I am happy to take artistic liberty if you aren’t particular! Any details not specified are up to my interpretation.

I try to give all clients a personalized and reasonable estimate for turnaround at the time of discussing your commission before payment is made. I am allowed to push back the estimated time frame as needed and will communicate these changes with you.

Expected time frames at the time of writing this are between 1 week to 1 month. Digital art commissions tend to be worked faster. Traditional art generally takes me longer and any provided time estimate does not account for shipping time.

You are welcome to contact me at any time for updates; please see my Contact Information above.

✨Edit Policies✨

Edits are allowed at my discretion and at any point during the commission process when reasonable. I tend to be very liberal about allowed edits but I will set boundaries or negotiate additional edit fees if necessary or excessive.

Things such as but not limited to: basic color changes, a couple markings needing to be redrawn, minor lineart edits, or errors that are a result of me missing something on the reference sheet are no problem and should be brought to my attention!

Clients that make repeated and/or excessive requests for edits that are disruptive to completion of their commission will be given a polite warning. When possible, please keep edit requests to a single, comprehensive message and provide demonstrative images if applicable.

If you are not satisfied with the initial sketch, 1 full re-sketch is allowable if edits cannot make it better. Any unused sketches are eligible to be made into YCHs to recuperate time and effort and are not part of your commission outside of the finished piece.

Once you have given sketch approval, I will not redraw large parts of any commission.

If your character undergoes a design change while you are waiting on your commission, please contact me as soon as you know the changes are happening. I am happy to work with changes as long as I am made aware and I’m not too far along with your commission!

Regarding old commissions: commissioners may contact me at a later time if pronouns, orientation (flags or other pride-related details), or gender-affirming edits are needed. Edits of this nature may be done for a negotiated fee, or free at my discretion, and depending on the extent of the edits.

Traditional art commissions cannot be edited as easily. Please make sure your reference sheet is completely accurate before sending it to me. If changes need to be made, they must be caught during the sketch phase or otherwise be errors that are a result of my own oversight.

✨Refunds✨

Due to the nature of custom art, I do not allow refunds after a commission is completed. Outside of this, refunds may be granted under extremely limited circumstances if work is incomplete.

Refunds are disruptive, as I rely on commissions to pay for my living expenses like rent and groceries. This is my job. Buy art at your own financial discretion.

If I have not started work on your piece, a full refund may be an option.
If a
sketch has been provided to you, no more than a 50% refund may be an option.

I reserve the right to cancel a commission for any reason, stated or not. If I choose to cancel your commission, you will be refunded in full.

✨Chargeback Information✨

Chargebacks are NOT an acceptable way to initiate a refund or skirt around rejection of a full refund.

Please talk to me so we can find a way to make things right or allow me to initiate the refund. Please understand that refunds are not always an option BEFORE commissioning me. When a forced chargeback is made, I am penalized with a nonrefundable $20 fee.

In the event of a chargeback, you will be blacklisted from any future transactions with me in all creative endeavors (commissions, future tattooing, etc.), regardless of provided reason, and other artists may be notified.

Your rights to any work generated by me are forfeited and is subject to be resold, reused, or otherwise modified to be made appropriate for reuse.

I take this issue very seriously. Please communicate with me. It is unfair to me and will not be tolerated.
