Brett Kavanaugh faces new Democratic Coalition judicial misconduct complaint over sexual assault allegations
Judge Kavanaugh compromised his integrity by participating in a smear campaign on partisan cable TV news.
The Democratic Coalition, along with its chairman Jon Cooper and co-founder Scott Dworkin, just filed a second judicial ethics complaint[1] against Judge Brett Kavanaugh with the DC Circuit Court of Appeals.
Merrick Garland is the Chief Judge of the DC Circuit Court of Appeals. His mandatory duty compels him to review all complaints against Judge Kavanaugh and decide if a full blown investigation panel should be appointed. If empaneled, the Chief Judge also sits on any special judicial committee to impartially investigate allegations of the appearance of impropriety against Kavanaugh. That committee can ask for Kavanaugh’s resignation and, if he remains in office, they can conduct an impartial vote to certify his impeachment from the bench to Congress to protect the independence and integrity of the federal bench.
The Democratic Coalition is a national Super PAC based in Washington, D.C. It is chaired by Jon Cooper. Senior Advisor Scott Dworkin is the co-founder of the Democratic Coalition and host of the Dworkin Report podcast. Two weeks ago, the Democratic Coalition’s attorney J. Whitfield Larrabee delivered a criminal complaint[2] for Kavanaugh’s apparent perjury to the Senate with the Department of Justice’s Public Integrity Section.
Judge Kavanaugh, his patrons in the White House and Republican lawyers, conspired to libel an innocent former-classmate to manufacture false evidence for his confirmation hearing. He then appeared on the partisan cable TV network Fox News to falsely disclaim his days of hard-drinking while attending elite academic institutions, challenging the integrity of women accusing him of sex assault in violation of federal judicial canons requiring the appearance of propriety, independence and integrity in all activities.
“Judge Gorsuch attended the same prep school as Judge Kavanaugh, yet we didn’t hear any allegations of sexual assault. Gorsuch never went on Fox News to ‘appeal to the base’ like a politician,” says Scott Dworkin. “We need non-partisan judges, but now, Judge Kavanaugh’s rulings will forever be tainted.”
“Judge Kavanaugh compromised his independence by making an unprecedented appearance on Fox News,” says attorney J. Whitfield Larrabee. “Cameras aren’t allowed inside federal courthouses to reduce sensationalism in legal affairs. Why did Kavanaugh appear on Fox just to inflame the public debate?”
