Coastal Creature Works’ Terms of Service
By commissioning me you are agreeing by contract, to have read, understood and agree to my terms and conditions.
General Information
-The artist reserves the right to refuse a commission based on the limit of subject matter, depiction of themes, illegal activity or personal reasons. Artist retains the right not to justify said reason.
-Customer must be 18 years of age or older. If underage business will be done with parent/legal guardian.
-The artist retains the right to refuse or cancel and refund a commission due, but not limited to: harassment, bullying, threats, stalking, or other unsavory behavior.
-At any time the commissioner may request an update of the commission or status in the queue
-The artist will maintain their style which is consistent with all pieces in their gallery – the artist will not change or ‘copy’ another style by request of the commissioner or to accommodate any particular character or design
-The artist retains the rights to artistic expression and the limits of their personal style will depict character(s) and design(s) how they best feel they will be expressed via pose, light source, lighting effects, etc - the commissioner may request any pose, expression, light source, or lighting effects for their piece, which will be executed to the best of the artist's abilities
-The artist will not accept any commissions of copyrighted characters – the artist will accept commissions of fan characters, designs created by the commissioner and stylized interpretations
-Complex character designs will affect the price, and up-charges will be applied accordingly – the commissioner will be notified of any up-charges prior to payment arrangements
Communication
-The artist lives in Eastern Standard Time in the USA – their responses to notes/comments/etc will be done in accordance to this
-The artist suffers from chronic medical issues that can sometimes limit ability to respond to notes/comments/etc. Artist will make an effort to respond as soon as they are able. The artist will try to send a tweet on status if they are unable to give any other response.
-Communication concerning individual commission prices and content will be done via the private messaging system on the respective website the artist was contacted on – the artist or commissioner may request the venue to be changed to a different website or to e-mail should the current venue prove cumbersome
-The artist will not chat or otherwise use IM for commission correspondence
-The artist will do their best to respond to any and all messages, questions, and commission inquiries in a timely manner, their personal schedule and health status permitting
-If the artist loses contact with a potential commissioner and cannot reach them prior to payment for a period of 30 days, the artist will assume that the commission is void and it will be cancelled
-If the artist loses contact with a commissioner and cannot reach them after payment has been received, the artist will complete the artwork and continue to attempt to contact the commissioner on the website where the initial correspondence took place, after which point the artist will attempt to reach the commissioner on other websites or contact a friend of the commissioner to alert them of the completed piece
-The artist reserves the right to ask any questions concerning the nature of the commission or the character(s) and scene(s) being depicted and may request further information or reference material of the commissioner
-In the case of a prior or sudden responsibility, the artist will alert the commissioner of their plans, as well as the estimated date of their being able to start/complete the piece if it differs from the previously given estimated wait time
-If a rush fee project is requested, schedule permitting, the artist will give the commissioner the options for them to pay what they can and/or for how soon they would like the piece completed
-If an event occurs that will prevent the artist from completing the piece at all, the commissioner will be alerted and immediately refunded up to the point of which the artwork was completed
-If the artist is threatened or otherwise harassed during correspondence, the individual will be reported to the applicable site’s staff immediately and authorities depending on the threat level
-The artist retains the right to not answer personal questions
Edits
-A work-in-progress sketch will be sent out for anything beyond a sketch unless requested otherwise. It is the responsibility of the commissioner to notify the artist of all desired edits at once.
-The commissioner is allotted a total of three work in progress sketches until additional fees will be added to the price.
-After sketch is approved the artist will provide commissioner a work-in-progress update at various stages of work — line art, flat color, shaded, final approval.
-It is the responsibility of the commissioner to provide any and all image reference material that they feel best represents their character or design – this material includes but is not limited to: their personal artwork, artwork done by others, artwork done by many others, an image compilation showing various elements of the design, clear written material, pre-made colour palettes, fursuit/costume images, photos, etc.
-Written referenced material must be clear and detailed. In bullet point format and include all information including color information.
-The artist retains the right to refuse a request for an edit should it compromise their artistic integrity – any instance of this will be brought to the commissioner’s attention right away should it occur to come to a solution
-The artist retains the right to refuse a commission or detail of the commission based on content – the commissioner will be alerted of this right away to reach a solution
-Please allow for artistic license and stylistic differences - these will be obvious via examples of the artist's previous works and will not be held against the artist
-Major edits will only be available on the work-in-progress sketch
-Major edits requested by the commissioner to the final piece may incur up-charges depending on the nature of the edit – i.e; an entire redraw of an area will incur an up-charge of $40+
-Failure by the commissioner to not make any edits during the sketch phase or to give any necessary information concerning references or details of the piece to the artist will be counted as a miscommunication and failure on the commissioners’ part and will not be held against the artist, and the artist reserves the right to refuse any edits - the artist will not go 'hunting' for reference material
-Small edits may be done to the completed piece, including color and size adjustments
-The commissioner has a time period of seven days to request any small changes to the completed piece – the artist retains the right to refuse further edits beyond these seven days
Copyright
-The artist retains the right to the artwork.
-The artist retains the right to display the image on any number of websites of which they are active.
-The artist original signature and/or watermark must remain on the completed image. Including sketches, line-art or otherwise that may be colored or finished by commissioner
-The artist owns the rights to the original piece of work and may reuse the work in advertising and/or promotional reasons - the commissioner retains all rights to the character(s) or design(s) depicted
-The artist owns the rights to resize/reuse the image to create icons, wallpapers, signatures, banners, and other graphics for any purpose, such as promotion, advertising, examples of work, etc
-The artist retains the right to create prints for sale of the completed work – the commissioner may, at any time, request that their piece not be made available for print
-The commissioner may repost the image to their personal gallery/galleries for display or reference material as long as a link to the artist's page or original submission is provided in the information
-The commissioner may request the full-resolution file at any time – this file may be sent via e-mail, or dropbox link. The commissioner must provide their preferred e-mail address for emailed file.
-The commissioner is not permitted to publicly upload the full-resolution file size – the commissioner must only publicly post a smaller-sized ‘display’ version
-commissioner is not permitted to make a artwork into a NFT without prior discussion with the artist
-The artist will not send artwork sans signature/watermark – this does exclude icons, (50x50px, 100x100px)
-The commissioner may request the piece to be created or resized to a certain dimension for printing or use as an icon, signature, etc.
-The commissioner is required to provide credit to the piece no matter where it is used, including but not limited to icons, wallpapers, signatures, and other graphics whether these graphics are created by the commissioner or by another party
-The artist’s signature and watermark must remain visible on the piece at all times – attempted removal of the signature and/or watermark will be counted as theft
-The commissioner may request the image to not be posted publically – this will incur an additional cost of 1.5% times the Commission price
-Reuploading images by others other than the commissioner and without the explicit permission from both the artist and the commissioner and lacking proper credit will be counted as theft and just legal action will be taken against the individual(s)
-No edits by either the commissioner or a third party are authorized to be made to the completed piece – any edits done without permission from the artist will be counted as theft and just legal action will be taken against the individual(s)
-The commissioner has the option to print for personal use only.
-The commissioner may request the piece to be ‘upgraded’ to a more detailed shading style, background, or fuller reference sheet as applicable in the future, for the difference of the paid amount for the completed portion – please inquire for details on specific pieces offered
Payment Information
-All prices are in USD (United States Dollar)
-Quotes are valid for 30 days – the artist and commissioner will review any previously discussed information prior to the 30 day deadline to determine if the previously given quote will remain the same or change
-Payments preferably done via Stripe or PayPal – the artist requests that Commissioners send a Note when the payment was sent, as well as include their username from the respective website on the payment, to confirm receipt
-PayPal fees and sales tax are included on all pieces – no additional fees will be added during PayPal processes
-The artist will not accept cash payment that is not USD – any foreign currencies that are erroneously sent will be returned to sender immediately and the commission canceled
-Full up-front payments are preferred – tips are accepted
-Payment plans are available for pieces starting at prices of $80+
-Deadlines must be specified by the commissioner and agreed upon with the artist prior to the payment
-If a deadline is not specified by the commissioner and agreed upon with the artist prior to payment, the artist cannot guarantee that the commission will be completed by the deadline and will not be held responsible
-Rush fees for deadlines may be applied or refused at the artist's discretion and will be outlined prior to making payment arrangements
Refund Information
-All Sales are final
-The commissioner may request a refund at any time prior to completion
-The artist reserves the right to issue a refund or cancel a commission at any time due to personal decision based on the artist's ability to complete the commission in a timely manner, due to events in the artist’s personal life, or due to unsavory behavior by the commissioner
-The amount refunded will be based on the amount of work already put into the commission
-The commissioner will be given the option of the artist sending them the artwork up to the stage of which it was completed – the artwork will be sent in .png or .jpg format as the artist does not make .psd files available for commissioners
