Palestinian prisoner Khalil Awawdah (40 years old) is from the town of Idna in Hebron Governorate. He is currently imprisoned in Ofer Prison, an Israeli military occupation prison in the West Bank. Awawdah, started his open hunger strike on March 3, 2022, demanding the cancellation of his administrative detention, imprisonment without charges or trial.

Palestinian Prisoner Khalil Awawdah has been on a hunger strike since March 3, 2022, in protest of his unjust arrest under the pretext of "administrative detention" and his subsequent inhumane treatment in prison, including solitary confinement.

Awawdah, started an open hunger strike, demanding the cancellation of his administrative detention and his release. Military courts do not offer the impartiality afforded all prisoners by internationally recognized legal standards, and his detention therefore amount of arbitrary detention, which goes against international covenant that the State of Israel has signed and ratified.

Khalil Awawdah has been held in a cell unfit for human life, with dimensions not exceeding 2 meters. Solitary confinement of hunger strikers is considered a from of torture according to the UN Special Raporteur on Torture, which goes against international conventions for humane treatment of prisoners.

I demand you to immediately take action to avoid loss of life and uphold the rights of prisoners under International Law to a fair judicial process & humane treatment.

To continue to hold Khalil Awandah and all 'administrative detainees' is unacceptable and needs to end immediately. I urge all Israeli authorities involved to immediately take action to end Khalil Awawdah's arbitrary imprisonment.

I ask the Israeli authorities to either:

Immediately cancel Khalil's administrative detention orders, release him immediately and transfer him to a West Bank hospital where he can recover.

Khalil's release is also one of the terms agreed upon by Israel in the most recent ceasefire agreement with Islamic Jihad in Gaza; his continued detainment is a breach of said ceasefire agreement.

What is happening to  Khalil Awawdah is just another example of how the Israeli occupation authorities continue to trample on the human rights of Palestinians, and in particular, Palestinian prisoners.

Canada must act in our foreign policies to uphold human rights, and hold accountable those nations who are our supposed ‘friends’ and trading partners who commit human rights abuses and violations of international law.

The prisoner, Awawdah, had started his open hunger strike on the 3rd of this March, demanding the cancellation of his administrative detention and his release.

He, like many Palestinian prisoners under administrative detention for extended periods of time, go on hunger strike to protest this policy whereby the Israeli occupation can incarcerate palestinians without charge or trial for an indefinite period of time.  

Palestinians detained under this policy are given zero opportunity for due process, nor do they have any real legal recourse to gain their freedom.  The military commander of the West bank has the right to arrest and detain any Palestinian under the policy of administrative detention based on a secret file of evidence that neither the detainee, nor their lawyers are ever permitted to view or refute. It is a policy that the UN, and both Israel and International NGOs, have observed that the Israeli occupation uses arbitrarily and is abused to incarcerate anyone who shows any form of descent for the occupation or the racist laws that the Israeli government imposes on Palestinians throughout the region. Palestinians can be held under AD for something as benign as Tweets that express opposition to their oppression. It is also routinely used as a substitute  for due process where there is insufficient evidence to move forward with proper legal proceedings (for example, if an an Israeli citizen living illegally in a West Bank settlement makes a “claim” about a Palestinian, but there is no evidence to back it up).

I demand that you speak up about this particular issue in Parliament as well as the recent Amnesty International report that concluded Israel is an apartheid state. I demand that you engage with the factual information that glaringly points to Israel’s abuse of power and violations of International Law, and hold accountable those nations who commit human rights abuses and violations of international law
