By accessing this website and registering with The Language Lounge (Colorado Pro Spanish LLC), you indicate your agreement with and understanding of the following terms of use and legal restrictions pertaining to both this site and the material on it. If you do not agree to be bound by the conditions and terms in this Agreement, do not subscribe to, access or otherwise use this site or any other of The Language Lounge (Colorado Pro Spanish LLC) services.

This Agreement is between you and The Language Lounge (Colorado Pro Spanish LLC), a company organized and existing under the laws of any and all of The Language Lounge (Colorado Pro Spanish LLC) locations, and with a principal place of business located in Fort Collins, CO, in the United States of America.

To register in one of our programs, an advance payment is required. This payment amount must be paid in full and is subject to our Refund Policy (see below). Your balance must be paid at the time of your in person or online registration to reserve your space. Tuition and fees are non-refundable within 30 days of the class start date. Class and lesson attendance is the responsibility of the student and there will be no partial refund of tuition for failure to attend classes for any reason, including illness, early withdrawal, dismissal from the program, or other emergencies.

1. Levels and Courses

The courses at The Language Lounge (Colorado Pro Spanish LLC) are separated into different levels for adults and children: beginner, intermediate, and advanced. Each level is broken in sublevels and are in accordance with their schedule listed on the The Language Lounge (Colorado Pro Spanish LLC) website. Upon completion of the each level, students will receive a certificate stating their proficiency. Classes will not be held on holidays specified on the class schedule. 2. Behavior

The Language Lounge (Colorado Pro Spanish LLC) reserves the right to remove and student from class or private lessons whose behavior is inappropriate and/or distracting to the rest of the class.

3. Teachers

The Language Lounge (Colorado Pro Spanish LLC) will do everything within our power to make sure that the same teacher continues through the length of the term of student’s contract period. However, we reserve the right to replace or substitute a teacher if it becomes necessary.

Additionally, we do everything within our power to accommodate students’ requests for teachers for private lessons. However, we cannot make any guarantees.

Teachers are subject to change from term to term. The Language Lounge (Colorado Pro Spanish LLC) cannot guarantee that you will have the same teacher for each level you take, even if you purchase course packages.

Students may not solicit lessons from a Language Lounge (Colorado Pro Spanish LLC) teacher outside of The Language Lounge (Colorado Pro Spanish LLC). The teachers are informed that they may not provide The Language Lounge (Colorado Pro Spanish LLC) students with lessons – private or group – outside of the scope of The Language Lounge (Colorado Pro Spanish LLC).

4. Responsibility

The Language Lounge (Colorado Pro Spanish LLC), and its agents, directors and teachers shall not be held liable for any loss, injury, death of persons, damage, accident, delays or expenses arising from the use of any travel facilities, accommodations or services provided herein. The Language Lounge (Colorado Pro Spanish LLC) highly recommends to its students to buy travel/medical insurance before traveling abroad. The Language Lounge (Colorado Pro Spanish LLC) offers its services in several countries under the specific conditions established by their respective governments laws and the The Language Lounge (Colorado Pro Spanish LLC) policies, and it will be the responsibility of each individual coming to this institution to obtain the necessary documents and permits to leave his/her country, as well as the visa to enter the country being visited. Please review the respective government websites before visiting those countries or agreeing to these terms and conditions. The Language Lounge (Colorado Pro Spanish LLC) reserves the right to change rates and policy without prior notice and to revise the advertised policies and schedule whenever other factors make this necessary or advisable.

5. Copyrights and Trademarks

All materials on the The Language Lounge (Colorado Pro Spanish LLC) website, as well as its subdomains, including without limitation text, images, software, audio and video clips, and Fee-Based Services (collectively, the “Materials”) are owned or controlled by The Language Lounge (Colorado Pro Spanish LLC), which retains all right, title, and interest in and to the Materials. The site and materials are protected by the copyright and trademark laws of the US and other countries, international conventions, and other applicable laws. You may not download, display, reproduce, create derivative works from, transmit, sell, distribute, or in any way exploit the Site or any portion thereof for any public or commercial use without the express written permission of The Language Lounge (Colorado Pro Spanish LLC).

6. Disclaimer and Warranty

The site (including all content, software, functions, fee-based services, materials and information made available thereon or accessed by means thereof) are provided AS IS, without warranties of any kind, either expressed or implied, including, but not limited to, warranties of title or implied warranties of merchantability, fitness for a particular purpose, title, compatibility, security, accuracy, or non-infringement. To the fullest extent permissible by law, The Language Lounge (Colorado Pro Spanish LLC) and its affiliates make no warranties and shall not be liable for the use of this site under any circumstances, including but not limited to negligence by The Language Lounge (Colorado Pro Spanish LLC). The Language Lounge (Colorado Pro Spanish LLC) does not warrant that the functions contained in the site or the services, fee-based or otherwise, will be uninterrupted or error-free, that defects will be corrected, that the site or fee-based services will meet any particular criteria of performance or quality, or that the site, including forums or the server(s) on which the site is operated, are free of viruses or other harmful components.

7. Limitation of Liability

Use of the site is at your own risk. You assume full responsibility and risk of loss resulting from your downloading, accessing or use of files, information, communications, content, or other material (including without limitation software) accessed through or obtained by means of the Site. Under no circumstances shall The Language Lounge (Colorado Pro Spanish LLC) or its affiliates, or any provider of telecommunications or network services for The Language Lounge (Colorado Pro Spanish LLC) or the affiliates, be liable for any indirect, punitive, special, or consequential damages that are directly or indirectly related to the use of, or the inability to use, the site or fee-based services, even if The Language Lounge (Colorado Pro Spanish LLC), its affiliates, or their providers of telecommunications or network services has been advised of the possibility of such damages. The total liability of The Language Lounge (Colorado Pro Spanish LLC) and the affiliates hereunder is limited to the amount, if any, actually paid by you for access and use of the fee-based services. You hereby release The Language Lounge (Colorado Pro Spanish LLC) and its affiliates from any and all obligations, liabilities and claims in excess of this limitation. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

8. Single User

Each assigned user name for a The Language Lounge (Colorado Pro Spanish LLC) online service is to be used solely by the individual to which it was issued.

9. Termination

The Language Lounge (Colorado Pro Spanish LLC) reserves the right to restrict, suspend or terminate your access to The Language Lounge (Colorado Pro Spanish LLC) services, fee-based or otherwise, in whole or in part, with respect to any breach or suspended breach of any portion of this Agreement. In the event of such a termination, there will be no refunds for unused time under the terms of your license or subscription. The Language Lounge (Colorado Pro Spanish LLC) reserves the right to refuse to provide services to you in the future.

10. Privacy Policy

We will not sell, rent or give your personal information to any third party for marketing or other purposes without your explicit consent. Please see the “Privacy Policy” link on the registration page for more information.

11. Modification to This Agreement

The Language Lounge (Colorado Pro Spanish LLC) may modify this Agreement at any time and changes are effective as soon as new agreement is posted to site or notice is made via electronic mail. If you are not satisfied with any such changes your only recourse and right is to cancel your subscription.

12. Modification of the The Language Lounge (Colorado Pro Spanish LLC) Site

The Language Lounge (Colorado Pro Spanish LLC) may modify the website in any way at any time, including fee-based services. The Language Lounge (Colorado Pro Spanish LLC) may impose limits on any site features and/or services or restrict your access to parts or the entire The Language Lounge (Colorado Pro Spanish LLC) site without notice or liability. If you are not satisfied with any such changes your only recourse and right is to cancel your subscription.

13. Change in Fees or Fee Structure

The Language Lounge (Colorado Pro Spanish LLC) may change fees or fee structure for any product or service, including recurring subscriptions, at any time. Notice of any such changes will be posted in advance on the The Language Lounge (Colorado Pro Spanish LLC) site and sent via electronic mail to any subscribers with recurring subscriptions that may be affected.

14. Refund Policy

14a. Private Lesson Package Refund Policy

The Language Lounge offers (sells) private lesson credits sold in packages of varying quantities to our clients. Recurring private lesson packages and memberships have expiration dates stated on the receipt which is either printed or emailed (automatically) to the student. Once the expiration date has been reached, no refund will be given for the original purchase price of the lesson credit. For individual lesson packs of (4) or (8) lessons, the expiration of such packages are (30) days and (60) days respectively.

14b. Group Course / Children’s Language Discovery Refund Policy

The Language Lounge (Colorado Pro Spanish LLC) offers a service that requires prior registration from our clients to reserve space in one our classes. Due to the nature of this agreement we do not allow students to cancel their registration for a full refund within 30 days of the class start date. We do understand that one’s schedule may change and certain things may arise forcing a necessary change on the clients end. Because of this we offer a 50% refund upon request 15-30 days prior to the class start date or 100% credit towards a future course.

Unfortunately, within 14 days of the class start date we cannot offer a refund of any value due to the nature of our registration. Please review the policy below and contact us with any questions. Thank you for understanding.

* Please give 24 hours for our Support Team to get back to you on the claim. Requests for a refund are accepted only as per the policy stated above. You should accompany a request with detailed and grounded reasons why you are applying for a refund. Please make sure your request does not contradict our Terms and Conditions.

The refund is issued to you after we receive your request and our Support Team verifies the validity of the request. Please acknowledge that a mutual consent exchange can be done to avoid a Refund.

15. Attendance, Missed Classes, & Class Cancellation

• Students are permitted to miss as many classes as needed. Missed classes will not be made up and no credit or reimbursement will be given. Students are encouraged to discuss missed materials with their fellow students and their teacher.

• Adult classes canceled by The Language Lounge (Colorado Pro Spanish LLC) will be made up at the end of the term, as per their normal schedule, permitting there is time.

STUDENTS TAKING PRIVATE LESSONS OR COURSES AT THE LANGUAGE LOUNGE ARE REQUIRED TO CALL AT LEAST 24 HOURS PRIOR TO RESCHEDULING OR CANCELING A SCHEDULED LESSON CLASS. ALL CALLS THAT ARE RECEIVED LESS THAN 24 HOURS PRIOR TO THE SCHEDULED LESSON WILL COUNT AND WILL BE CONSIDERED A 'LATE CANCEL' WHICH WILL DEDUCT (1) OF THE STUDENT’S PRE-PAID CREDITS FROM THEIR ACCOUNT. THIS CREDIT MAY NOT BE MADE-UP.
CLASS AND LESSON ATTENDANCE IS THE RESPONSIBILITY OF THE STUDENT(S) AND THERE WILL BE NO PARTIAL REFUND OF TUITION FOR FAILURE TO ATTEND CLASSES FOR ANY REASON INCLUDING ILLNESS, EARLY WITHDRAWAL, DISMISSAL FROM THE PROGRAM OR OTHER EMERGENCIES.
PRIVATE GROUP LESSONS REQUIRE THE ATTENDANCE OF ALL STUDENTS FOR EACH SCHEDULED LESSON. IF ANY OF THE MEMBERS OF THE GROUP ARE NO SHOWS FOR THE SCHEDULED CLASS, (1) CREDIT WILL BE DEDUCTED FROM THE ACCOUNT OF THE ABSENT STUDENT, AS IF THEY WERE IN ATTENDANCE.

• Students of Kid’s Language Discovery Programs are expected to be picked up on time, per the class’ regular schedule. Parents will be notified of any change to the schedule or pick-up time. Late pick-up will result in a warning, followed by a $10 fee per late pick-up thereafter. Repeated late pick-ups may also result in removal of the student from the program.

• The Language Lounge (Colorado Pro Spanish LLC) and Kid’s Language Discovery Programs reserves the right to cancel any classes due to bad weather or unfit work conditions, even with fewer than 24 hour notice. Teacher and student safety is our biggest priority, so we may err on the side of safety. Please keep in mind that our teachers often drive long distances to get to your class, so although you may live nearby or your child is already at school, your teacher may be be driving upwards of 30 miles to get to your class.

* Cancelled classes will be made up at the end of the term permitted there is time. If the class was canceled due to weather and there is not time to make up the class, The Language Lounge (Colorado Pro Spanish LLC) is not required to make up or give credit for that class.

Membership Policy:
For all recurring payments or memberships, the Student receives a set number of private lesson credits to be used during the subsequent 30 days following the date of purchase. Lesson credits do NOT roll over to the next month. This encourages the essential consistency and commitment required to effectively learn a foreign language. If the student misses a week, or cannot attend for a period of time, it is the Student’s responsibility to book his or her remaining credits before the 30 day expiration period for the current credits on their account. Student is welcome to book multiple lessons during the week to make use of their remaining credits before the expiration date.
Suspension and termination:
If Student decides to cancel his/her membership prior to the contract end date, there is a one time $75 cancellation fee. Student will also be back-charged the discounted monthly amount according to the shorter membership term. For example, if a student signs up for a 6 month membership and only fulfills 3 months of the contract, the student will be charged the balance of any discounts received for having signed up for a longer (less per month) membership. Calculation will be prorated based on the student's cancellation date and number of payments made according to the original contract. This is in addition to the $75 membership cancellation fee.
Freezing your Membership:
To freeze your auto pay, a completed request must be submitted in writing at least 30 days in advance of your next billing date in order for your request to be effective from the following month. Billing date is based on your activation date of Student’s membership
Student may freeze Auto Pay schedule once per year at any time for a fee of $25 per month. The freeze is activated at the start of the next billing cycle and can be requested in monthly increments for up to 6 months. To request the freeze, contact the Language Lounge in writing explaining the need for the freeze and the timeframe for which you need the auto-pay frozen. Following the end of your requested freeze period, your monthly auto-renew will automatically be reactivated.
