Photography Services Agreement

This Photography Services Agreement ("Agreement") is entered into by:

1. Scope of Services

The Photographer agrees to provide the following photography services:

  • Date of Event or Session: ________________________________
  • Location of Event or Session: _____________________________
  • Type of Photography: ____________________________________
  • Duration of Session: _________________________

(For type of photos and session duration specifics aren’t of the greatest concern, just rough ideas on paper is sufficient)

2. Payment Terms

  • Total Fee: This is subject to travel cost and what the client is looking for, prices can be discussed in person or via message
  • Deposit: A non-refundable deposit of 50% is due upon booking.
  • Remaining Balance: The remaining balance of [Insert Amount] is due after photos have been taken at location.
  • Travel Fee:  If location is 20 miles or more I will charge $0.50 for every mile after 20 miles traveled (for example if the distance is 30 miles the travel fee is applied to 10 miles costing an extra $5.00). The Travel fee is included with the deposit, if you are within the minimum then no fee is added
  • Payment Methods: PayPal, Venmo, Cash, Check, Bank Transfer.

3. Cancellation/Rescheduling Policy

  • Cancellation by Client: The Client must provide written notice of cancellation at least 48 hours before the session to avoid a cancellation fee.
  • Cancellation Fee: A fee of 50% of the total fee will apply if the Client cancels the session within 48 hours of the scheduled date.
  • Rescheduling: Rescheduling is permitted if requested at least 48 hours before the session without penalty, subject to Photographer’s availability.
  • Photographer Cancellation: If the Photographer cancels for any reason, the prepaid deposit will be refunded as well as any other costs incurred for that agreed upon session.

4. Deliverables

  • Images: The Photographer will deliver [Insert Number of Images, e.g., 20 edited images] to the Client within a few days of the session date (life and work depend on how quickly photos will get done).
  • Delivery Format: Images will be delivered in digital format via SMS messages for smaller amounts of photos and google drive for larger quantities (rough estimates for quantity of images).
  • Additional Edits: Additional edits or photos beyond the agreed-upon package may incur an additional fee (There is a lot of flexibility within this but if any questions arise, clarity will be given to make sure no details are missed).

5. Copyright and Usage

  • The Photographer retains all copyright to the images produced.
  • The Client is granted personal, non-commercial usage rights for the images.
  • Any commercial use (e.g., advertising, selling) of the images requires written consent from the Photographer and may incur an additional fee.

6. Model Release

The Client grants the Photographer the right to use images taken during the session for promotional purposes, including but not limited to: the Photographer's website, social media accounts, portfolio, and marketing materials. If the Client prefers to keep their images private, this must be stated explicitly in writing prior to the session.

7. Liability

  • The Photographer is not liable for any injuries, damages, or loss of property that occurs during the session.
  • The Client agrees to take full responsibility for any individuals accompanying them to the session.

8. Miscellaneous

  • Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings, whether written or verbal.
  • Amendments: Any amendments to this Agreement must be made in writing and signed by both parties.

9. Signature

By signing below, you acknowledge all information presented to you within the document and in signing agree to all terms set by this Service Agreement.

10. Completion of Article

After completing this document with electronic or written signature please contact me and share this document to “devittographics@gmail.com”. Once I can process said document and everything has been discussed then I will perform the contract and provide my services.
