General TOS

Do not claim ownership or that you are the creator of any of my designs/art pieces.

You cannot use my designs or art anywhere unless you have purchased, traded or were gifted them from me or are the current owner or the character depicted or design created. Any artwork created that does not depict a specific character commissioned by the client may not be reposted or used anywhere without my explicit written permission.

Anyone who does not follow these guidelines will be blocked and blacklisted by me, and are directly going against copyright laws, since I as the artist hold automatic copyright to my works and hold authority over where that work is shown and depicted unless an agreement has been made with me personally.

ALL of my artwork is for personal use only, this means unless previously discussed with me you do not have permission to in any way profit off of my artwork, or use it for any kind of advertisement, anything mass produced that may be used as “merchandise” or anything else that may be seen as branding.

Work for commercial use must be specifically commissioned as such as prices will be different. Unless given written consent by me while discussing your commission, all work is personal use only.

Art commissioned from me can be used in any way within these guidelines:

• My watermark/signature cannot be removed or altered in any way.
• You may not use my art for any kind of propaganda, political statements or hate speech.
• The Art/design creation is credited to me.
• Any alterations to my artwork must be run by me first.

Designs that have been commissioned or bought from me or a previous owner can be used or changed however you wish within these guidelines.

• Original design creation credit must always be credited to me.
• Rules of any closedspecies I’m designing for override my own, but you are allowed to change the species of my designs.
• You may not sell the design for more than what you paid for it, unless extra art is added.

Commissions, Queue, and payments

Payments

All commission prices are in USD and all payments are over paypal unless you’re paying in deviantart points

• Payment plans for auctions that go over 200$ are fine but must be discussed prior.
• Any missed payments in a payment plan without prior discussion will result in a full refund of prior payments and revoking of the character to be sold to the next highest bidder.
• Payments must be made quickly or you can lose your slot. For normal commissions with limited slots, you must pay within 24hrs of payment being requested or you can lose your slot to the next person requesting one if there is one. For auctions, you have 48 hrs for payment or it will go to the second highest bidder.
• I do charge small complexity fee’s, what is considered complex is at my own discretion.
• If a chargeback is issued after receiving the adopt, product or artwork from me you will be Permanently blacklisted from any of my future purchases. If it’s an adopt or custom the adopt/custom will be put back up for sale and will no longer belong to you.
• If it is commissioned work and a chargeback is issued I also hold the right to re-use the line art/sketch from your commission excluding character details for any other use.

Designs are under my ownership until fully paid off.

Refunds

Average turnaround time for art is 1-2 weeks. 

I do have a life outside of commissions and other projects I am working on, and  will usually inform my commissioners if something is to deter me for a significant amount of time.

In the event of a commission taking longer than 1 month without being started, a full refund can be requested! Refunds will not be given out before this time! When commissioning me make sure you can afford it as I will not prioritize your financial situation above my own.

I hold the right to issue a refund at any point in time for any reason.

Sometimes I find myself unable to complete commissions for varying reasons. In these cases, I will either request a character change or just inform you of my inability to complete your commission and issue a full refund. If no response is given the refund will be sent back to the account originally sent from.

Any kind of harassment may result in an immediate refund and potential blacklisting.

Refunds for completed commissions cannot be requested!

All art will be completed based on information stated in forms provided when ordering anything from me! If there is a problem with your commission, I will ask you for clarification. If none is received, I will continue the commission as I feel best represents the original request. In the event that a completed commission is not to your liking, small changes such as markings and color corrections can be requested but no large changes can be requested without a fee, even then it may be denied if the change is too great.

I'm happy to provide WIP's as I go if you wish to make sure things go smoothly, but if you don't disclose wanting something changed at this stage I may not change it or charge a fee to change it depending on the severity.

Commissions

• All payments must be made in full before a commission is started
• Once I have started sketching your commission, you are locked into the character you have chosen, regardless of trading, selling or otherwise relinquishing ownership of said character. If the new owner is not told to me, I will send the finished product to the original commissioner.
• If you give me an unclear reference or the wrong reference and something is wrong with the artwork, a fee may be issued for any significant changes to the artwork depending on how far along it is. Changes made in the sketching phase are fine but after that a fee may be issued. Minor changes are fine on my discretion but please ask.
• I hold the right to refuse service for any reason.
• I hold the right to issue a full refund at any point if I cannot complete your commission.

Queue

All commissions will generally be finished in order of payment, I might jump around a bit if I need a break from certain commissions, but I try to stay in order.

Please do not ask me when your commission will be finished! I keep my queue updated as I work on commissions, if you would like to keep track of the progress of your commission you can do so through my queue here

Blacklist

By breaking any of the rules on here one or multiple times depending on severity, may result in being blacklisted.

People on my blacklist will not be allowed to purchase commissions or designs from me, or have others do it for them. Anyone caught buying things from me for people on my blacklist will also be blacklisted.

I will not state publicly if or why someone is added to my blacklist, if you would like to ask about someone being added to my blacklist you may ask through DM’s.

I will NOT draw

-Anything illegal nsfw wise

-vomit

-robot/mech characters (some cyborg aspects are alright but it’s case by case and need a detailed reference)

-any kind of propaganda

If reposting my artwork I must be credited. Preferably with a direct link but if that isn't possible a username and where to find me is fine "ex: Art by Contaminated_Cryptid on Instagram"


Unless discussed with me, I hold the right to post any Art I make wherever I please including social media, my website, etc.

Commissioned or payment art will not be used by me for anything other than showing off my work on social media, chatrooms, or private messages or used as commission examples anywhere needed.

By commissioning me or purchasing anything from me, you are agreeing to all of the terms stated above.
