ORDER

Before the Court is Defendant’s counsel’s Motion to Withdraw. The Motion states

that the Defendant Donald L. Gillispie and Relief Defendant Energy Executive Consulting,

LLC no longer have the financial ability to retain counsel and continued representation in

this matter would result in an unreasonable financial burden to counsel. Mr. Gillispie has

submitted a written consent to this Motion for himself and on behalf of Energy Executive

Consulting, LLC. (Dkt. 285-1, Ex. A.) In addition, counsel has filed a supporting Declaration

to the Motion. (Dkt. 285-2.) The Court has reviewed the Motion, Declaration, supporting

materials and entire record herein and finds as follows.

Motions to withdraw as counsel are governed by Local Civil Rule 83.6, which

requires counsel to request leave of the Court in order to withdraw from representation. This

Court having considered the Motion to Withdraw and the supporting documentation, finds

good cause exists to grant the Motion.

ORDER

NOW THEREFORE IT IS HEREBY ORDERED that the Motion to Withdraw

(Dkt. 285) is GRANTED. Counsel is directed to comply with Local Civil Rule 83.6 in all

respects and, specifically, to serve this order on the clients forthwith.

IT IS FURTHER ORDERED that counsel of record will continue to represent the

clients until proof of service of this Order upon the client has been filed with the Court.

Thereafter, Donald L. Gillispie and/or Energy Executive Consulting, LLC shall have twenty-

one (21) days from the filing of the proof of service of this order by the attorney to file

written notice with the Court stating how he/it shall be represented in this matter.

IT IS FURTHER ORDERED that Donald L. Gillispie shall appoint another attorney

to appear and represent him or appear in person by filing a written notice with the Court

stating how she will be represented. As to Energy Executive Consulting, LLC, the Court

notifies it that as a corporation it cannot appear without being represented by an attorney and

must file a notice of appearance by an attorney. See Dist. Idaho Loc. Civ. R. 83.4(d),

83.6(c)(3).

IT IS FURTHER ORDERED that upon entry of this Order and filing of the proof of

service on the clients, no further proceedings can be had in this action which will affect the

rights of Donald L. Gillispie and/or Energy Executive Consulting, LLC for twenty-one (21)

days.

If Donald L. Gillispie and/or Energy Executive Consulting, LLC fails to appear in

this action within such twenty-one (21) day period, such failure shall be sufficient grounds

for the entry of a default against such party or dismissal of the action of such party with

prejudice and without further notice.
