- This morning Bloomberg reported US filed an antitrust suit In New York district court against Apple, Hachette, HarperCollins, Macmillan, and Penguin. ---- Connecticut Attorney General George Jepsen announced that his state and 15 others have filed an antitrust lawsuit against Apple and five publishers in Texas.
- come after a year-long investigation into Apple and publishers, after Apple switched to an "agency" model that is said to have resulted in an industry-wide price increase
- The Department of Justice has confirmed a settlement with Hachette, HarperCollins, and Simon & Schuster. Must give retailers like Amazon and Barnes & Noble the ability to reduce prices on ebook titles and end their "anticompetitive most-favored-nation agreements with Apple and other ebook retailers. ---- The States are seeking money Jepsen says that two of the publishers — Hachette and Harper Collins — have already capitulated and agreed to pay $52 million in “consumer restitution.”
- Apple and Macmillan deny that they have colluded to raise prices on digital books. Penguin has not settled.
- They will argue that pricing agreements between Apple and publishers enhanced competition in the e-book industry, which was dominated by Amazon.com
- Random House Inc., based in New York, has agreements with Apple and Amazon that lets the book publisher set prices for e- books, the essence of the agency model.
agency model lets publishers -- not vendors -- set e-book prices ----- Macmillan CEO John Sargent: "The government's charge is that Macmillan's CEO colluded with other CEO's in changing to the agency model. I am Macmillan's CEO and I made the decision to move Macmillan to the agency model. After days of thought and worry, I made the decision on January 22, 2010 a little after 4 a.m., on an exercise bike in my basement. It remains the loneliest decision I have ever made, and I see no reason to go back on it now."---------

slThe ever popular MPAA says that there should be no distinction between hosting and embedding copyrighted materials in a brief filed with the Seventh Circuit. Both Google and Facebook have publicly taken a contrary opinion trying to keep the two actions separate, which makes sense since their sites could be held liable for infringement if someone embedded infringing material on their sites. The Seventh Circuit hasn't made up its mind on whether it will side with the MPAA or not.

Greetings Twit Group,

In episode #475, you had a discussion about smart phones being stolen and your wish for remote wipe. As it turns out, the Windows Phone has the ability to remotely find, ring, lock, and erase the Windows Phone. All you need to do is go to the www.windowsphone.com web site, click the "My Phone" link, and select one of the options on the left hand side.

Have a great day!

Rick

You said you wished there was a way to remotely wipe the data on your android phones, you can. You have to download an app called lookout mobile security. It backs up contacts, and is an anti virus and if you pay monthly you can back up pics and remote wipe your device.

A 13 inch tablet may not be for everyone, but I have been using an 11.3 inch Windows 7 tablet (currently running Windows 8) daily for over a year and would like a larger one. I am a 65 year old man but do not have particularly poor eye sight and would still like a larger tablet, especially if ran windows (millions of applications) and was not limited like the iPad. I paid $699 for my current tablet last year and would pay the same or more for a larger tablet with newer tech.

Hey Twit team,

Loved the show today, but I have a second perspective on your Central IMEI Database story from today:

Have you considered the possible repercussions that a centralized IMEI database may have on the second-hand phone market? Such a database may have a chilling effect on second-hand buyers of mobile devices. Perhaps there is a secondary motive behind this effort to establish such a database.

Worth a discussion.

Cheers,

Nolan
