tmEA's Medal of Honor: Warfighter better be good. It just cost at least 7 Navy Seals their military careers. 7 Members of Team Six, one of which is reported to be Matt Bissonnette who took part in the bin Laden raid, have been disciplined for misuse of command gear and disclosure of classified material, in connection with two days of paid consultation with EA. The sailors lose 1/2 pay for two months and receive punitive letter of reprimand, which most agree will prevent any possibility of future promotion.http://www.usatoday.com/story/news/nation/2012/11/08/navy-seals-punished/1693453/

slIt took years of testing and preparing, but the Australian government formally abandoned a plan to filter its domestic Internet. Officials now say that it will use Interpol’s "worst of" child abuse site list as a way to shield Ozzies from the Internet's worst content. The push for a filtering program had largely been promoted by Family First, a conservative party Down Under, but had critics. In 2010, Google told Australia its program had gone too far.http://arstechnica.com/tech-policy/2012/11/australia-comes-to-its-senses-abandons-national-internet-filtering-regime/

iaNvidia announced a record high revenue of $1.2 billion in the third-quarter. Nvidia also said that its non-PC business - that's pretty much its Tegra line of processors - now accounts for a third of its total business. Three years ago, Nvidia's non-PC business accounted for just 7% of its revenue. http://www.theverge.com/2012/11/9/3621708/nvidia-q3-2012-earnings-tegra-growth

dkAT&T announced yesterday that it will allow any customer with an LTE device on a tired data plan to use FaceTime over Cellular.
Previously only customers with a Mobile Share plan could use FaceTime when not on Wifi.
Several consumer rights groups still consider AT&T's restrictions on FaceTime a violation of Net Neutrality.

tmAnd now the bad news. NPD Group reports total retail video game sales fell 25% from $1 billion in October 2011 to $755.5 million October 2012. Hardware sales fell 37% but accessories sales offset that a bit, rising 5% largely driven by Skylanders Giants. The good news is, these numbers don't include digital sales like Steam or mobile sales like the app store.http://www.pcmag.com/article2/0,2817,2411929,00.asp

tmJudge Lucy Koh will give Samsung one last shot. After the Apple-Samung patent case this summer Samsung alleged that jury foreman Velvin Hogan hid the fact he had been sued by Seagate in 1993. Samsung and Seagate have a close business relationship. Hogan says he was only asked to disclose the past 15 years of his business history. US Federal District Judge Lucy Koh has now said she will "consider the questions." http://news.cnet.com/8301-13579_3-57547490-37/judge-to-review-whether-foreman-in-apple-v-samsung-hid-info/

slIn universal translator news, Microsoft posted a demonstration of a translation tool that turns English into spoken Mandarin. The crazy thing is, the translated voice is the same as the original. The system uses a library of tones generated by the speaker combined with recorded speech from a native Chinese speaker. Microsoft says that one word in about 7 or 8 is incorrect, but this is a 30% reduction in error than previous methods. http://thenextweb.com/microsoft/2012/11/08/microsoft-demos-amazing-english-to-mandarin-translation-allowing-for-real-time-audible-translations/?fromcat=all

- kayak started in 2004. IPO'd on July 20. Priceline world's largest travel co. Priceline's shares down following news, Kayak's up.
- – Priceline is offering $40 per share of Kayak, a premium on current value of around $30/share. Kayak valued at about $1.8 billion, with about $500m in cash and $1.3b in equity and assumed stock options.
- Both boards have approved the deal, but shareholder approval required, expected to close by Q1, 2013. Kayak to remain separate brand, same management. Kayak’s directors & officers represents 77.9% voting power, so shareholder pushback unlikely.
- separate SEC filing, Kayak extended its Google marketing services deal till Oct 2014. (not for Google’s ITA airline search software)

.

Another Project Homerun Yahoo homepage design being tested looks like Windows Tile interface or maybe Pinterest
- More simplified icons for various Yahoo properties, fewer text links, additional social and personalization aspects and — perhaps most importantly — no advertising module at the very top.
- plan is to move from several 300×250 sized ad units to a single 300×600, which other sites like AOL have shifted toward
- Previous tests showed infinite scrolling, a simplified logo and giving search more prominence,
Q: What do we think?

iaThe Mess That Is Google Shopping
http://searchengineland.com/the-mess-that-is-google-shopping-139112

.

- Danny Sullivan over at Search Engine Land tore apart Google Shopping
- The newest iteration of Google Shopping launched on Oct 17th. Search results would appear only if merchants paid to be included.
- Sullivan did some test searches for the Kindle Fire HD, the iPad mini, and Halo 4
- Kindle Fire HD: Sullivan noted how Amazon is not one of those paying merchants, so you get all kinds of other places and a number of duplicate entries. One result featured the Kindle Fire (not HD)
- Sullivan was annoyed that when Google made the switch to paid listings that Google said "this is about delivering the best answers for people searching for products…"

Q: Is Google ever going to get the shopping element right for consumers or are they just happy making money from the vendors? They've been trying (Froogle/Google Products/Google Product Search days) without real success since 2002.

slAT&T Expands FaceTime Over Cellular Access to More Customershttp://www.macrumors.com/2012/11/08/att-expands-facetime-over-cellular-access-to-more-customers/

.

AT&T's flip-flop on FaceTime over cellular should scare youhttp://www.theverge.com/2012/11/8/3619058/att-facetime-flip-flop-fcc

.

- AT&T announced yesterday any customer "with an LTE device" on a "tiered data plan" can use iOS 6's FaceTime over Cellular feature, no extra charge. Previously, only customers with Mobile Share plan could use FT. says feature will roll out over 8-10 weeks.
- AT&T is also making FaceTime over Cellular available to deaf and hard of hearing customers who qualify for special text and data-only packages.
- only affects iPhone 5 and iPad with LTE customers with tiered, though not unlimited, data plans.
- Jim Cicconi, AT&T's head of External and Legislative Affairs, wrote a blog post about the change. says there was no way for ATT engineers to model usage and network impact so decided to hold off on feature until they knew they could handle it
VERGE SAYS NOT SO FAST- organizations like Public Knowledge and Free Press pushed legal action to get block removed, that's why ATT caved.
- a co. like ATT is only licensing spectrum. if you don't use spectrum you license fully for the good of the citizens, that's a violation of spectrum agreement. but FCC doesn't police this enough, so companies "convince" consumers they're doing the right thing
- why doesn't FCC intervene more? doesn't have access to internal ATT data. access would take months (if not years) of filings, proceedings, and legal stuff.
- john bergmayer of Public Knowledge tells verge: "If it turns out they don't make it available to truly everyone, we still plan to file a complaint. The violation is ongoing until the feature is made available to every plan, including unlimited plans,"

Hey gang, just finished listening to yesterday's show (episode 625) and wanted to share my experience with Waze advertising. I love Dunkin Donuts and am fortunate to have one near my house, but not exactly on my morning route. To keep Waze from freaking out about me going the wrong way for the first mile of my commute, I added a "favorite" location for my nearest DD so I could use Waze's waypoint feature for a combo route. Now, anywhere I go, anytime I get close to a DD (brick and mortar or C-store kiosk) there magically appears a DD logo pin. It may not matter for my daily commute, but when I go out of town to visit family, it will be hugely helpful to have those pins on the map so I can start my morning off on the right foot.

Not sure if DD is a partner with Waze or if it simply knows from my favorites that I prefer DD, but I have yet to be "bothered" by pins for other coffee shops like Starbucks. So, for now, my map is not overrun by unwanted ads and unrequested info. In my book, that's a win...for now.

Love the show! Have a great weekend!

Thanks,

A Thomas Price
