tmReuters reports the European Commission plans to fine Microsoft before the end of March in relation to the antitrust case regarding browser choice in Windows. This would be the second time Microsoft would be found in violation of the 2009 settlement. Microsoft's board cut Steve Ballmer's bonus last year as a result of the failure to provide a browser choice screen as required. Microsoft says it was a technical error. Either way sources tell Reuters the Commission plans to fine Microsoft by Easter. iaBlackBerry owners, get excited. There's an update to BlackBerry 10 that BlackBerry says will improve third party apps as well as provide better Gmail calendar support. tmUnlocking your phone lost its legal exemption in the US at the end of January but never fear FCC chairman Julius Genachowski is here. The Chairman told TechCrunch the ban raises competition and innovation concerns and the FCC will investigate whether it "can and should enable consumers to use unlocked phones." slFacebook has confirmed it's buying the Atlas Advertiser Suite from Microsoft. Though rumors have suggested this is Facebook launching its own ad network, the company says no, it just wants to help advertisers “close the loop” and understand how their investments on facebook earn them money. Atlas allows advertisers to plan campaigns, buy ads on sites across the web, and measure their impact. iaGerman lawmakers say Google and other news aggregators can continue to show "single words or very small text excerpts" on their sites without being required to pay. However, anything longer than that is still the exclusive property of the content owner. Today we have Google CFO Patrick Pichette telling the Morgan Stanley Technology Conference that Motorola's current roster of phones doesn't 'wow' by Google standards. slBritish Sky Broadcasting Group (BSkyB) will buy Telefónica’s UK fixed-line broadband and telephony business for up to £200 million ($303 million). The deal should close in April if it passes regulatory clearance, at which point customers will be moved off the O2 and BE Broadband brands and become Sky customers. tmElectronics chain Best Buy did not receive an anticipated takeover offer from founder Richard Schulze by the deadline yesterday. Schulze had been attempting to buy back the company since last August, but Bloomberg reports he could not line up debt and equity financing. iaCody Wilson's non-profit organization Defense Distributed demonstrated a semi-automatic weapon capable of firing over 600 rounds with a 3D printed AR lower. The lower contains the gun's operating parts including the trigger. Last year, Defense Distributed demoed a lower that failed after six rounds. FCC Chairman Julius Genachowski told Gregory Ferenstein last night at a CrunchGov event “ban raises competition concerns; it raises innovation concerns,”
- “It’s something that we will look at at the FCC to see if we can and should enable consumers to use unlocked phones.”
- From 2006-2010 Library of Congress issued an exemption to the DMCA for unlocking phones
- This past October no exemption was issued: a) Vernor v. Autodesk 9th Circuit ruled EULA can prevent 'ownership' of software b.) more unlocked phones on the market and carriers have plans for unlocking
- No court has tested whether unlocking phone actually violates the DMCA.

- macworld found even emails with the phrase contained in an attached PDF—even a zipped PDF—were blocked.
- instances where that phrase is used out of context, email still gone
- In macworld's tests, we did find that the filtering only occurs on inbound emails, not outbound emails. So you can at least send emails from your iCloud account with the phrase “barely legal teens”
apple's response: “Occasionally, automated spam filters may incorrectly block legitimate email. If the customer feels that a legitimate message is blocked, we encourage customers to report it to AppleCare.”
- how can you know if someone didn't arrive because you never saw it? what else is being filtered? where's the grand list?

Hey TNT crew. A couple comments on the conversation in episode 700 about users not wanting gigabit internet.

First, from a consumer point of view. Why would I pay for that when I would never actually get to use it? The best speed I have available at my house is through Comcast at a maximum of 105 MB/s for $199.95/month. First, the word "Maximum" they don't actually guarantee I will get that speed and odds are I will not, especially at peak use times. Second, how fast would I go over the data cap streaming HD video and such over a connection like that? I would be throttled halfway through each month.

Now from the point of view of a person who works for a Telecom I actually asked our executives if they had considered offering something like residential with a guaranteed minimum, symmetrical connections, no caps etc. I was told that Marketing determined the plans offered based on what they felt they could get people to pay. So as you all postulated, until it makes money now they aren't doing it. Oh and my company is putting a lot of money into infrastructure... to cell towers.
