tmThere's good news and bad news for RIM, it all depends on which headline you read. The bad news is RIM announced subscriptions for the last quarter declined by 1 million, the first decline ever for RIM. Also revenue fell 48 percent and RIM reported an adjusted net loss of $114 million or 22 cents a share. The good news? slNokia has announced that it has agreed to a deal with RIM that will end all patent infringement litigation between the companies, with RIM making a one-time payment to Nokia to settle the cases. Going forward, RIM will give Nokia "ongoing payments" for the right to use its patents. iaInstagram is hitting control+Z on its terms of service change and will revert to its previous terms of service. Kevin Systrom on the Instagram blog says that Instagram will complete its advertising plans first then come back to users to explain how its advertising business would work. dkBloomberg reports HTC will make 12-inch and 7-inch Windows RT tablets next year. The tablets wouldn't come out until the fall and would run on Qualcomm chips. tmCNET reports Facebook will experiment with charging users one dollar in order to be able to send messages to people with whom they are not friends. Facebook recently changed messaging so that anyone can send a message to anyone else, but if you are not friends, it ends up in an 'other' folder. Paying a dollar would make the message skip the 'other' folder.

slAn Italian court has overturned the conviction of three Google executives found guilty of allowing a video of a bullied teenager to be posted online, which breaks Italian law.
The clip was uploaded in 2006, and the employees were given six-month suspended jail sentences in 2010. Google had appealed against the ruling, saying it had removed the video within two hours of being notified by the authorities.

iaAfter looking at a 12 week period ending on November 25th, Kantar Worldpanel ComTech says that Apple landed its biggest marketshare ever in the United States owning 53.3% of the smartphone market. This is the first time Apple has hit over 50% and Kantar expects more gains in December. dkSenator Ron Wyden isn't a fan of artificial data caps. He says they "run the risk of undermining innovation" if they are "not designed to truly manage network congestion." So, Senator Wyden introduced legislation on Thursday that would require any data cap to functon to "reasonably limit network congestion without unnecessarily restricting Internet use." The bill would also grant the FCC power to regulate ISPs' methods of measuring bandwidth usage and also introduce a network neutrality-like rule. http://arstechnica.com/tech-policy/2012/12/senator-introduces-bill-to-regulate-data-caps/

tmHave you ever wondered why someone didn't just set up a bunch of slingbox-like devices and start renting them out? Meet Nimble TV. The plan here is that Nimble will set up a cable box for you from any proivider you want and stream it to you and only you over the Web wherever you are. The service's trial run will start in New York City for 250 users charging only the cost of the cable subscription. Sometime in 2013 Nimble TV hopes to launch for real and expects to charge about $20 a month on top of the cable package. slWhy is Edison Junior, the tech lab behind the POP portable power station, returning $139,170 in funding it raised from Kickstarter backers to develop the device? Because Apple refused to give the project permission to license the Lightning charger in a device that includes multiple charging options. POP was billed as “the intersection between charging and design” and featured connectors to charge iPads, iPhones, and Android devices. - The section in the terms and conditions applying to advertising would revert to how it originally read when the site was launched in October 2010

RIM's earnings were yesterday and it beat expectations

Financials
- RIM's revenue was $2.7B, down 47% compared to the same period last year
- Earnings per share were -$0.22, expected to lose $0.35 per share
- RIM earned a $9 million profit last quarter, compared to a $235 million loss a year earlier. Most of that gain, though, came from a tax benefit.

Non-financials
- 6.9 million shipped smartphones shipped in the quarter. Last year RIM shipped 7.4M handsets
- 1M fewer subscribers: The BlackBerry subscriber count fell to 79 million from 80 million at the end of the second quarter.
- RIM’s chief information officer, Robin Bienfai, announced he would retire.
The Future:
- RIM said it is likely to report a loss next quarter as it ramps up its marketing campaign for its new BlackBerry 10 operating system and smartphones

Rep. George Miller owns a house by the Senate that he shares with another Congressman and two Senators.
