Ireland says not to blame for Apple's low tax rate

Biting criticism
http://www.economist.com/blogs/schumpeter/2013/05/apples-tax-arrangements

.

- U.S. Congressional investigators say Apple has avoided billions in tax by setting up a bunch of companies "so complex it spanned continents and went beyond anything most experts had ever seen"
- Some of the subsidiaries had no employees
- The main subsidiary, a holding company that includes Apple's retail stores throughout Europe, has not paid any corporate income tax in the last five years, the report said.
- Apple's arrangement has allowed it to pay just 1.9 percent tax on its $37 billion in overseas profits in 2012,
- Last year, international operations accounted for 61 percent of Apple’s total revenue
- According to the Congressional report, Ireland had also agreed a special 2 percent rate for Apple's Irish taxable profits instead of the normal 12.5 percent.
- Ireland's European Affairs minister Lucinda Creighton said there is no such deal
- The investigators did not find Apple had broken any laws, but they questioned its use of multiple subsidiaries in Ireland to report profits when those subsidiaries had no offices or other physical presence in the country.
- Acc'g to study by the National Bureau of Economic Research found that 92 percent of the repatriated cash was used to pay for dividends, share buybacks or executive bonuses.
- “Repatriations did not lead to an increase in domestic investment, employment or R.&D.,

- Apple's prepared statement for the Senate committee: Apple “welcomes an objective examination of the U.S. corporate tax system, which has not kept pace with the advent of the digital age and the rapidly changing global economy.”

Q: Will a tax investigation like this hurt Apple's image? Do you think any company has a duty to do more with the money they save by not paying taxes?

slNY official: Airbnb stay illegal; host fined $2,400http://news.cnet.com/8301-1023_3-57585377-93/ny-official-airbnb-stay-illegal-host-fined-$2400/

.

- city of NY's housing board fined Airbnb host Nigel Warren to pay $2400 in fees for violating a law that makes it illegal for property owners to rent out homes temporarily -- essentially mimicking hotel stays
- 2011 law that makes it illegal for New York residents to rent out a property for less than 29 days. It was originally aimed at landlords who bought up residential properties and turned them into hotels. Airbnb has been lobbying legislators to change the law so it clearly protects hosts, like Warren, who are not trying to turn their homes into hotels.
- Warren is only a tenant himself: Warren's landlord has 30 days from May 14, the date the decision was mailed, to appeal the decision, according to the Environmental Control Board, which oversaw the case.
- Airbnb sent a lawyer to the hearing to argue on Warren’s behalf, the first time the startup has intervened in such a case. New York City, where Airbnb is projected to do $1 billion in sales in 2013, is an important battleground for the startup, which has run into trouble with regulators in some cities. David Hantman, Airbnb’s head of public policy, has said the company would like to make New York a "model city."
- problems elsewhere: San Francisco housing officials concerned about property owners potentially using its service to get around local tenant protections and land use codes.
- if airbnb can't get law changed, what happens? just riskier business?

- WhatsApp (200 million monthly active users), WeChat (195 million monthly active users), Viber (200 million registered users), Line (150 million registered users), Kakao Talk (90 million active users), Kik (50 million registered users)

Hi TNT crew:

When you guys were discussing the technology that looks at your face when going into a store, and how creepy that might be, I took it a different way. I was thinking that maybe in the future this program would not only look at your face, but maybe it would see what size your body is and what you are currently wearing. In a clothing store, this sort of thing could pull out selections of clothing you might be interested in right when it sees you walk in the door.

Just an idea-- would like your thoughts.
