None of Apple's design patents are involved and HTC is forbidden from cloning an Apple device. Pricing and royalty rates were redacted. http://allthingsd.com/20121205/heres-apples-settlement-pact-with-htc-well-the-parts-were-allowed-to-see/

iaLack of Distribution Is “Killing” Surface
http://allthingsd.com/20121205/lack-of-distribution-is-killing-surface/

.

- Detwiler Fenton, a Boston-based brokerage firm, said in a research note today that Microsoft is likely to sell just 500,000 to 600,000 Surface RTs in the December quarter,
- Reports say MS manufactured 3-5M surface tablets to sell in Q4
- “Lack of distribution is killing the product,” Detwiler Fenton explained. “Mixed reviews and a [$499] starting price tag certainly don’t help, but lack of retail exposure at Best Buy and others is severely depressing sales.”
- Microsoft sells its Surface tablet in MS Stores (31 stores, 34 holiday kiosks in the U.S.) and online

Q: Should Microsoft start distributing the Surface outside of its stores or is this the proper strategy?

iaAmazon Adds A/B Testing For Android Developers; Says App Downloads Grew 500 Percent In 2012http://techcrunch.com/2012/12/06/amazon-adds-ab-testing-for-android-developers-says-app-download-grew-500-percent-in-2012/

Amazon’s Appstore is on fire: 500% more downloads this yearhttp://gigaom.com/mobile/amazons-appstore-is-on-fire-500-more-downloads-this-year/

.

- Amazon's Appstore has a new feature: A/B testing for developers for the Kindle Fire HD
- Developers will be able to upload multiple versions of their apps to experiment
- This is unlike Apple's review process or Google's publish immediately policy
- Developers had to use third party services for A/B testing before. Now they can use Amazon's built-in testing
- It's not clear if Amazon's tools will allow any Android developer to A/B test, but the website description suggests that.
- Amazon's introduced a bunch of AppStore features recently. GameCircle, a Maps API, Test Drive (try before you buy), and a Kindle Fire emulator
- Amazon also said that Appstore downloads grew "more than 500% over the previous year."

Q: Will this feature (and growing feature set) spark development particularly for Amazon's AppStore?

I'm a rural prepaid cell customer and while I enjoy the freedom of having cheap cell phone bills, I also suffer since I'm not on one of the Big 3 (truly, only 1 of the 3 works remotely well in my town) as the coverage is spotty and mobile data is very limited. Because of this, using an SMS replacement product is not a feasible option for me. Sure, I use WiFi wherever I can, but even though I have line of sight to a cell tower I get no data reception at my residence and it does me no good when I'm out running errands etc. and don't have access to wifi. SMS works great however. There seems to be large swathes of areas where a SMS replacement would not work until rural [wireless] broadband becomes more pervasive (and cheaper!)
