tmBig news is spinning out of GamesCon. Microsoft announced 23 titles to launch along with the Xbox One in November, including Battlefield 4, Assasin's Creed IV Black Flag, Dead Rising 3 and Peggle 2 among others. Fifa 14 is one that will come free with pre-orders of the Xbox One in Europe. slBecause of concerns of privacy and government surveillance, Pamela Jones is shutting down her site Groklaw, which focused on unjust legal action in the tech domain. Jones started her site a decade ago taking on the SCO Group's legal attack on IBM and others involving Linux and Unix intellectual property. iaTiVo made its latest DVRs available starting today. Say hello to the Roamio, Roamio Plus, and Roamio Pro -- Roamio is spelled "r-o-a-m-i-o" as in wandering around because those devices will eventually bring built in Slingbox-like functionality. Recordings on these DVRs will be accessible via your iOS device using the TiVo Stream app even if you're outside your local network. However that funciton will not roll out until October or November. The Roamio line gives you four to six tuners depending on the model and ranges in price from $200 to $600. tmBarnes and Noble did an about-face announcing they will continue to make color Nook tablets like the Nook HD along with e-ink readers. Barnes and Noble announced in June they would cease manufacturing the tablets by the end of the year. Instead, BN now promises a new tablet in time for the holidays. Barnes and Noble had a disappointing quarterly earnings report, including a 20% drop in Nook division's sales. slGoogle has introduced its first integrations between Google Maps for mobile and its newly owned Waze. The traffic tab on Google Maps for iOS and Android will now include accidents, construction, road closures and other incidents reported by Waze users. iaGuardian editor Alan Rusbridger says that after pressure from the British government, he agreed to allow government officials to destroy hard drives containing data provided by Edward Snowden located in the Guardian's London offices so the publication could continue covering the ongoing NSA story. Rusbridger told BBC Radio 4 that he tried to explain to officials that the data is located in more than one place and destroying the London hard drives would be pointless. Nevertheless, the UK Government Communications Headquarters supervised the destruction of those drives in the basement of the Guardian. slPhyllis Schneck, a senior executive with Intel's McAfee anti-virus software division has been named the top cyber official at the U.S. Department of Homeland Security. DHS Secretary Janet Napolitano on Monday named Schneck the new deputy undersecretary for cybersecurity in the department's National Protection and Programs Directorate. tmPrenda Law, a company used by many media companies to track down copyright violators online seems to have been using a honeypot to catch offenders. As part of discovery in the case of AF Holdings vs. Patel, records were subpoenaed from Comcast for a user called Sharkmp4. The IP address returned by Comcast was associated with the account of Steele Hansmeier PLLC another company name associated with Prenda's John Steele. iaGarmin announced a new line of action cameras called the VIRB and the VIRB Elite. Unlike the GoPro, the VIRB cameras come with an always-on 1.4-inch display. Garmin claims you can get 3 hours of 1080p recording out of these ruggedized cameras. - GigaOm's Om Malik says he's got details about the upcoming Samsung Galaxy Gear smartwatch

Hardware
- Om's sources say that Samsung has seeded many different variations of the watch design to developers. However, all of them had square OLED screens. The watch face is about 3-inches including the case.
- Inside: dual core processor that should allow for decent battery life
- The strap would contain an integrated camera. The clasp of the watch would house tiny speakers.
- NFC and BT 4.0
- An accelerometer allows the watch to turn on when moved up towards your eye

Software
- The Galaxy Gear watches out there are based on Android 4.1 and 4.2. Tight syncing between watch, phones and tablets. If you're looking at a particular email on your watch, your phone will be at the same place if you pick up that device.
- The connection will use Samsung’s proprietary accessory protocol and will use Bluetooth LE as the network transport.
- Om's sources tell him that the apps for the watch will come not from the Google Play store, but instead from the Samsung App store.
- Om says that Samsung will launch the product and possibly a pop-up store in Times Square along with its IFA event in Berlin and an additional event in NY on Sept 4, 2013.

- The Verge also has a report up today saying its sources say the watch itself will not be able to make phone calls, but will work with your phone to do so.

- Judge Charles Breyer of US District Court in Northern California ruled agains 3taps motion of dismissal. States 3taps had intent because of the C&D and 'circumvented a technological barrier' meaning the IP block.
- "Judge Breyer: "the average person does not use “anonymous proxies” to bypass an IP block set up to enforce a banning communicated via personally-addressed cease-and-desist letter."
- Orin Kerr wrote on Volokh Conspiracy Blog "IP addresses are very easily changed, and most people use the Internet from different IP addresses every day."

- Garmin announced the VIRB, a rugged action camera that will compete with the likes of GoPro
- The VIRB captures 1080p wide-angle video, has digital image stabilization and can take 16MP stills while recording
- It has a 1.4-inch color display and Garmin says it will last up to 3 hours when recording 1080p video
- The camera has an IPX-7 waterproof rating, which means it can be submerged in water about three feet deep for up to 30 minutes
- There will be two models. The VIRB Elite includes Wi-Fi and GPS tracking. The VIRB Elite will come with activity profiles so you can track location, speed and heart rate (if you get a separate heart rate monitor) while recording. That data can be viewed on the device or embedded into the video when editing.
- The Elite also has the ability to automatically turn on (the example given by Garmin, camera won't auto turn on going up a ski lift, but will when skiing down the mountain)
- The lower end model will be able to connect to other GPS-enabled Garmin products for GPS and Wi-FI.
- The lower end model is $299, the Elite will cost $399. Both launch in Sept.
- Garmin is also launching a mobile app for preview, playback and remote functionality, along with a free desktop software application to edit and upload VIRB and VIRB Elite videos

in cars as premium sound like Bose and Sony. They already do. The
first car was the 2012 Chrysler 300S and they have since put it in the
dodge charger and the North American version of the fiat 500. It can
also be found in fiats elsewhere. Also I think it's more trendy than

First, I want to say. I love the show.

I found the Sony-Viacom deal somewhat interesting, but I think you may be overestimating its impact. My fear is that cable TV providers who for many people are also their ISP may place bandwidth caps in response. I am sure their justification will be lost revenue from people discontinuing television service will require them to implement bandwidth caps to remain profitable. In my case, I have Comcast who also owns NBC.

Do you think they would be agreeable to providing their content to such services? On one hand, they could prevent companies like Sony, Apple, Microsoft, and Google from making any serious inroads to Cable programming. On the other hand, they get paid from these other services for their content. What do you think?
