iaRemember that whole e-book price fixing thing where the DOJ said Apple and publishers rigged prices of ebooks? Well, the five publishers who settled with the DOJ are now opposing the U.S. government's proposed injunction whereby Apple and other ebook retailers like Amazon would be able to discount the publishers' ebooks for five years. The publishers say that the injunction is punishing them and it "directly conflicts" with the settlements the publishers made with the government. http://gigaom.com/2013/08/08/publishers-protest-dojs-proposed-punishment-for-apple/

tmRemember the Xerox copier compression error which swapped measurement numbers on floor plans? It's been patched! Hooray! Xerox says the issue only arose if users altered the default settings in its Workcentre copiers to lower resolution. The machine even warns users that "character substitution errors" may occur if they change the setting. The patch, which should come in the next couple weeks, will not so much fix the problem as disable the setting that causes it. You know what they say, if you can't fix it, break it.http://www.bbc.co.uk/news/technology-23610405

tmHuawei will offer a new line of switches with streamlined upgrading compared to the ease of upgrading apps on a smartphone. The software-programmable S12700 series will be released in October. The US Congress has accused Huawei of cooperating with Chinese intelligence services and barred government agencies from purchasing Huawei networking equipment. Chinese media have been calling for more Chinese-made networking equipment, accusing Cisco of cooperating with the US NSA on its surveillance.http://www.bloomberg.com/news/2013-08-08/huawei-to-sell-smartphone-like-network-switch-in-cisco-challenge.html

iaThe New York Times reports that the National Security Agency is searching through the contents of Americans' data who merely "mention information about foreigners under surveillance." These Americans don't need to be in direct contact with anyone under surveillance - they just need to "cite information linked to those foreigners, like a little used e-mail address..." and that will lead to the NSA copying e-mails and other text-based communications. According to the NYT's source, the keywords that lead to the collection are "'very precise' to minimize the number of innocent American communications that were flagged by the program." http://arstechnica.com/tech-policy/2013/08/nsa-captures-americans-internet-content-if-it-mentions-overseas-suspects/

On the Edge of failure: Ubuntu smartphone looks unlikely to reach crowdfunding goal http://www.theverge.com/2013/8/7/4594714/canonical-ubuntu-edge-crowdfunding-campaign-may-not-reach-its-goal

.

Canonical Updatehttp://www.indiegogo.com/projects/ubuntu-edge?c=activity

.

29- Canonical just cut the price of the Ubuntu Edge to $695 for the rest of its Indiegogo campaign
- Canonical has the lofty goal of raising $32M. So far, the company has raised over $8.6M with 2 weeks to go in the campaign.
- The Indiegogo campaign is a fixed funding campaign, which means it will only receive funds if the total goal is met within the timeline
- Canonical has altered the price of the device once before, but this new $695 price will remain the fixed for the next two weeks.
- There will be no limit to the amount of people who can order at that price, nor will there be any limit on quantities
- Canonical says this is thanks to major industry announcing Bloomberg LP snapped up the first of the $80k Enterprise bundles
- At the end of the campaign, anyone who has pledged over $695 will receive a refund on the difference

Q: 2 weeks to go and more than $20M to raise. Is this device just not broad enough?

slPayPal co-founder Max Levchin’s Glow launches to improve healthcare, starting with infertilityhttp://thenextweb.com/apps/2013/08/08/paypal-co-founder-max-levchins-glow-launches-to-improve-healthcare-starting-with-infertility/

.

- PayPal co-founder Max Levchin says he wants to reduce the cost of healthcare in the US (teased at D conf in May). next startup called Glow jsut launched iOS app, targeting the fertility industry.
- Glow uses data science to predict when a woman is most fertile, without any artificial or medical treatments. In much of US, fertility treatments are not covered by insurance carriers, so patients often pay between thousands to tens of thousands of dollars.
- women can receive personalized data about their fertility by providing it answers to a few questions. levchin says Glow should never replace medical advice — it’s a guide
- Data from the app can be exported into a PDF and shared with a user’s OBGYN or physician
- company has established Glow First, in which participants can put in $50 per month for 10 months into a community pool. After 10 months have passed, the pot is divided equally among those women who didn’t have a natural pregnancy — these funds will go towards making sure that they can afford the necessary treatments. To help jumpstart this non-profit fund, Levchin has put in $1 million to the Glow First program.

Acer's Android Ambitionshttp://blogs.wsj.com/digits/2013/08/08/acers-android-ambitions/

.

47- Acer's Q2,2013: Net loss of $11.4M, compared to a net profit of $1.7M dollars last year at the same time
- 90% of Acer's revenue came from Windows products
- On a conference call, Acer President Jim Wang told investors "We are trying to grow our non-Windows business as soon as possible,"
- He says, "Android is very popular in smartphones and dominant in tablets...I also see a new market there for Chromebooks."
- Wang said Android devices--including smartphones, tablets and Chromebooks--will likely contribute 10%-12% of Acer's revenue by the end of this year, and may grow up to 30% in 2014.
- The rest will come from Windows devices
- Acer Chairman JT Wang said Microsoft has to "do something to re-establish or reinforce confidence among PC users" because people are not buying the machines

Q: Lenovo, HP, and now the world's 4th largest PC maker Acer seems to imply Windows isn't the way to go. Should Microsoft be worried about Acer?

Regarding the Smart Watch segment in Episode #812 -

My biggest problem with any wearable tech (bluetooth headset, watches, etc.) is yet another item that I need to remember to charge. Believe it or not, I still wear a normal, everyday watch, even with my Android phone always in reach. And the battery in my watch will last a decade or more. Can you do the same with the Pebble? What about your headset or fitbit?

I'm a huge tech fan and look forward to all these great wearable tech inventions, but until the battery situation improves, I'm not likely to participate.

Love the show and Hail Chief Illiniwek.

We received a couple of emails from smart watch owners:

Tony from Minnesota says he uses a Sony smart watch and he loves using it to read and reply texts while customers are around.

Chris from Washington DC says "As someone who walks pretty much everywhere, I find [my smart] watch really helpful. I tend to use blue tooth headsets to listen to podcasts and music and keep the phone in my pocket or backpack. So being able to see texts, the subjects of emails, caller ID info and the like is particularly helpful. Especially since my hands are usually busy with dog leashes and coffee cups"
