The Rules
I. General framework
1. The “Portugal Open” competition is promoted by Turismo de Portugal, I.P. in partnership with Stat Track Technologies – Serviços Tecnológicos para o Desporto, Lda., hereinafter referred to as Hole19, and has as aim the boosting of the golf product and of the Portuguese trademarks Portuguese Greens and Visit Portugal, on the Hole19 platform.
2. Participation in the competition determines the acceptance of the terms and conditions and the participation rules of this regulation, which are published in the Hole19 app and in the Hole19 platform.
3. The competition consists of making a video and/or taking a photo in Portugal together with a small text referring what they enjoy most in Portugal, which, for validation purposes, must be submitted in the platform Hole19, in accordance to the terms described in paragraph 9 below.
4. The competition is open to United Kingdom and Ireland residents.
5. The competition begins on the 5th April and ends on the 28th April 2017 at 11:59 p.m (GMT).
II. Participation rules
6. Employees and collaborators of Turismo de Portugal, I.P. and of the Tourism Teams Abroad, as well as the Hole19’ collaborators are prevented from participating in the competition.
7. Except for the aforementioned, the competition is open to all users resident in the United Kingdom and Ireland, provided they are more than 18 years old.
8. By participating in the competition, the competitor expressly consents the @Visitportugal domain to republish, in the future, the videos and/or photos submitted in the present competition, according to paragraph 20 of this Regulation.
9. To participate in the competition, competitors must upload the video and/or a photo in Portugal, together with a small text referring what they enjoy most in Portugal, on the Hole19’s platform app’s feed, with the hashtags #PortugueseGreens, #TeamFinch and tagging @visitportugal.
10. The competitor is free to participate with the number of videos and/or photos he/she understands.
11. Turismo de Portugal, I.P. reserves the right to exclude any participation, which in its sole discretion, reveals to be out of the competition’s scope.
12. Videos and/or photos that are considered unworthy, offensive or contrary to morality or public order or that indicate fraudulent behaviour or activities shall be likewise excluded.
13. Videos and/or photos whose intellectual property rights do not belong entirely to the participant in the competition may not be presented, being in such case the participant in the competition the sole liable before third parties deemed offended.
III. Winner and Prize
14. The selection of the winning video and/or photo shall be made by a jury appointed by Turismo de Portugal, I.P. and by Hole19. The jury’s decision is free, final and unappealable.
15. The winners of the competition shall be awarded with two Pro-Am positions, in which a professional shall take part of, with a (2) two-night stay in a superior class hotel (single occupation), meals included in the Pro-Am program and a tourist class airplane trip from the 9th to the 11th of May, with luggage included (15kg) and transportation for golf bags. Transfers from airport to the hotel are included.
16. The winners shall be announced on the Hole 19’s platform app, within 48 hours after the competition’s term.
17. To confirm and accept the prize, the winner must claim it within 72 hours after being contacted by Hole19.
18. In case the winner does not claim the prize to which he/she is entitled to, within the deadline mentioned in the previous paragraph, Turismo de Portugal, I.P. shall award the prize to the competitor classified immediately thereafter.
IV. Final provisions
19. The competitors hereby grant, free of charge and unconditionally, to Turismo de Portugal, I.P., the right to freely use, within the scope of its activity either carried out by itself or by third parties, the submitted videos and/or photos, including the right to edit and post them for promotional purposes on digital platforms.
20. The personal data provided by the competitors shall be subject to automated processing for the exclusive purpose of managing the competition and for the purpose stated in the previous paragraph.
21. Turismo de Portugal, I.P., is authorized to announce the name of the winner to third parties exclusively for the purpose of delivery of the competitor's prize.
22. Turismo de Portugal, I.P. undertakes to ensure the confidentiality of the personal data conveyed and to ensure that they are not used for different purposes other than those for which they have been assigned.
23. Turismo de Portugal, I.P. shall not be liable for any damage, loss or impairment suffered by any participant in the competition.
24. Turismo de Portugal, I.P. reserves the right to amend this regulation at any time without prior notice, by publishing the modified regulation in the Hole 19’s platform app.
25. The present competition is of the initiative of Turismo de Portugal, I.P.
26. This regulation shall be governed by Portuguese law, and Portuguese courts shall be deemed competent to resolve any conflicts arising from its interpretation or execution.
27. Proof of age and handicap certificate may be required.
28. The prize does not include travel within the UK and Ireland, insurance, taxes, service charges, or any other service or item.
29. There is no cash alternative to the prize and the prize is non-refundable and non-transferable. The Promoter reserves the right to amend these terms and conditions at any time.
30. The promoter does not accept responsibility for network, computer or software failures of any kind.
31. No responsibility can be accepted for entries which are invalid, incomplete, illegible, lost or delayed in transit, or which fail to be properly submitted. Proof of sending does not constitute proof of receipt.
