IRRESISTIBLE REVOLUTION – RELEASE OF
LIABILITY
By signing this document, I _________ acknowledge that I have read the statement
below, I understand its meaning and legal implications, and I agree to the terms and stipulations here set forth. In consideration of being permitted to volunteer, participate in, and/or attend the Irresistible Revolution and SUNSET
& CHILLsetup, performance, breakdown, and circus skill share that includes pole, lyra, and other dance classes for
all events in (hereinafter “Irresistible Revolution and SUNSET & CHILL”), I understand, acknowledge, and agree to
the following:
I certify that I am physically able to participate in the Irresistible Revolution and SUNSET & CHILLevent and in
any activity, performance, or circus skill share associated with it, and have not been advised otherwise by a qualified
medical professional.
I am responsible for any allergies and/or medical conditions that I may or may not be diagnosed with and I am
responsible for the administration and storage of any/all medications directed under my doctor’s guidance.
I have read, I understand, and I agree to comply with any and all rules, regulations, terms, and conditions of the
Irresistible Revolution and SUNSET & CHILLevent, including but not limited to those set forth in this document, in
the National Park Service Permit Requirements for Irresistible Revolution and SUNSET & CHILL, and on the
Irresistible Revolution and SUNSET & CHILLwebsite.
4. I acknowledge and fully understand that as a participant, I may be engaging in activities that involve risk of
serious injury, including permanent disability and death, property loss and severe social and economic losses.
These risks include, but are not limited to, those caused by: (a) the actions, inactions or negligence of
Irresistible Revolution and/or SUNSET & CHILL, LLC or its agents, participants, volunteers, spectators, event
officials and organizers; (b) conditions of the premises or equipment used; (c) rules and regulations regarding
the activities; (d) temperature; (e) weather; (f) condition of participants; and (g) vehicular traffic. I further
acknowledge and fully understand that there may also be other risks that are not known or foreseeable at this
time. I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISK OF PROPERTY LOSS, PERSONAL
INJURY, SERIOUS INJURY OR DEATH, WHICH MAY OCCUR BY VOLUNTEERING IN,
PARTICIPATING IN, AND/OR ATTENDING Irresistible Revolution and/or SUNSET & CHILL2018 AND
HEREBY FOREVER RELEASE, DISCHARGE AND HOLD Irresistible Revolution and/or SUNSET &
CHILL, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES , CONTRACTORS, AGENTS ,
VOLUNTEERS OR REPRESENTATIVES, HARMLESS FROM ANY CLAIM ARISING FROM SUCH
RISK. EVEN IF ARISING FROM THE NEGLIGENCE OF Irresistible Revolution and/or SUNSET &
CHILL, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, VOLUNTEERS
OR REPRESENTATIVES, OR BY THIRD PARTIES, AND I ASSUME FULL RESPONSIBILITIES AND
LIABILITY FOR MY PARTICIPATION.
5. I, on behalf of myself, my heirs, executors, administrators and assigns hereby waive, release, discharge, and
agree not to sue Irresistible Revolution and/or SUNSET & CHILL, LLC, its officers, directors, members,
employees, volunteers, representatives, agents, contractors and subcontractors, and other participants,
sponsoring agencies, sponsors, advertisers and, if applicable, owners and lessors of equipment and premises
used to conduct Irresistible Revolution and/or SUNSET & CHILLevents or activities (collectively the
“Releasees”), from any and all claims for damages, injuries, losses, liabilities and expenses which I may have
or which may subsequently accrue to me, relating to, resulting from or arising out of my use and/or
participation in any programs, events or activities of Irresistible Revolution and/or SUNSET & CHILL, LLC,
including any injury or damage to my person or property, or to that of any other person or property.
6. I agree to indemnify, defend and hold the Releasees harmless from and against any and all claims for
damages, injuries, losses, liabilities and expenses relating to, resulting from or arising out of my participation
in any Irresistible Revolution and/or SUNSET & CHILLprogram, event or activity.
7. I understand that I have an option to have medical assistance that may be deemed advisable in the event of
injury, accident and/or illness during any program, event or activity. I give consent to medical assistance under
any of the conditions of implied consent. I release Irresistible Revolution and/or SUNSET & CHILL, LLC
and all persons participating in any such medical assistance from all responsibility for any such actions.
8. I intend that this Waiver and Release of Liability shall be construed broadly to provide a release and waiver
to the maximum extent permissible under applicable law.
9. I agree that I am not employed by any city, state, or federal law enforcement agency or acting as an
independent contractor on their behalf.
10. I am aware that my image may be captured on film, video or photographs without my consent and without
compensation.
11. I acknowledge that the Irresistible Revolution and SUNSET & CHILLorganizers control all rights
regarding the licensing and reproduction of any imagery recorded at Irresistible Revolution and/or SUNSET &
CHILL. Commercial use of images taken at Irresistible Revolution and/ioe SUNSET & CHILL2024 is strictly
prohibited without the prior written consent of Irresistible Revolution and/or SUNSET & CHILL, LLC. I
understand that, if I desire to make any use, other than for personal use of the footage, film or video, I can do
so only if I obtain written permission from Irresistible Revolution and/or SUNSET & CHILL, LLC.
12. I appoint Irresistible Revolution and/or SUNSET & CHILL, LLC as my representative to take actions
necessary to protect my intellectual property or privacy rights, recognizing that Irresistible Revolution and/or
SUNSET & CHILL, LLC has no obligation to take any action whatsoever.
13. I agree that Irresistible Revolution and/or SUNSET & CHILL, LLC is not liable for acts of God, or actions
taken by government agencies.
15. I agree and understand the rights of Irresistible Revolution and/or SUNSET & CHILL, LLC to order my
ejection from the event in the incidences of TRESPASSING, negligent and disrespectful and unsafe behavior
to myself and to my fellow participants, consuming or possessing alcohol and illegal drug use.
17. I understand that art cars, art installations, theme camps, and performances are not owned or operated by
Irresistible Revolution and/or SUNSET & CHILL, LLC and, therefore, I also assume any and all risk of injury
associated with or arising from their operation or occurrence.
19. I understand that smoking, candles, incense, or any other open flame on the premises of any buildings and
pavilions, is strictly PROHIBITED. I understand that if I am responsible for setting off: tampering with the
electrical supply or removing the battery from a smoke detector, I will be held accountable for all damages that
are incurred. (MINIMUM FINE: $1,000.00)
20. I understand that Irresistible Revolution and/or SUNSET & CHILL, LLC AND ITS ORGANIZERS do
not condone the consumption or possession of illegal substances, and I agree that I will not bring such
substances onto the grounds of the event. Furthermore, I understand that I will not use or consume illegal
substances while at the event and that I have been made aware that doing so is a direct contradiction off the
stated policy of Irresistible Revolution and/or SUNSET & CHILL.
21. I understand that NO ONE is allowed to possess and/or consume alcoholic beverages on the grounds of
SUNSET & CHILL. I also agree to notify Irresistible Revolution and SUNSET & CHILLstaff if I see someone
who appears to be intoxicated to the point that he or she constitutes a danger to him/herself or others.
22. I agree and understand that Irresistible Revolution and/or SUNSET & CHILL, LLC, ITS INSURERS
AND AFFILIATES ARE NOT AND WILL NOT BE HELD LIABLE AND RESPONSIBLE FOR ANY
AND ALL INCIDENCES THAT MAY OCCUR BEFORE, DURING AND AFTER PARTICIPATING IN
ANY ACTIVITIES PROVIDED BY THIRD PARTY COLLECTIVES AND GROUPS ATTENDING THIS
EVENT. THIS INCLUDES ALL ACTIVITIES INCLUDING AERIAL RIGS, ANY PHYSICAL
ACTIVITIES, CLIMBABLE STRUCTURES AND ART INSTALLATIONS.
23. Any dispute that arises under or relates to my participation in Irresistible Revolution and/or SUNSET &
CHILL, whether civil or criminal, shall be resolved in the District of Columbia Superior Court and shall be
governed by DC law, and excluding any laws that direct the application of another jurisdictions laws.
24. In any litigation, or other proceeding by which one party either seeks to enforce any perceived rights,
although explicitly waived in this document, the prevailing party shall be awarded reasonable attorney fees,
together with any costs and expenses, to resolve the dispute and enforce the final judgement.
26. I understand that Irresistible Revolution and SUNSET & CHILLis an all-ages event and will not be held
liable or responsible for the safety or wellbeing of my child. If I am deemed an unfit or irresponsible guardian
to my child by Irresistible Revolution and/or SUNSET & CHILL, LLC, event coordinators may see it or to
take legal action or eject me from the event grounds.
My signing of this waiver confirms my agreement to the terms reflected above.
