To the FBI- athttp:// tips.fbi.gov Riverside County District Attorney Office commited fraud in not providing services with the use of Federal funds to prevent constitutional rights of victim Lee Frank 72 years of age. I am requesting that the use of federal funds be investigated for illegal use and fraud to the public. That the proper funding agencies be notified about federal funds misuse and fraud to the public. I requesting that the County of Riverside DA office have the victim federal funds removed as a funding source. 68 year old Nye Frank was attacked and strangled on 8/5/07 by a 27 year old Ty Allen Reddish. Ty has had professional judo training and has awards by his father Norco High Wrestling Coach, gov teacher Phil Reddish. Nye Frank has zero fighting history and led a very public life. In police interview of Phil Reddish, Jason Reddish both tell sheriff officers that Ty Reddish has a combative personality. Ty Reddish shares with the Sheriff officers on the video of their interview the judo moves he used on the Old Guy per Ty. Ty Reddish bends down to avoid the video recorder and told the sheriff how he used judo to choke the old guy, the audio is clear and able to hear him. The Sheriff officers share a laugh with Ty Reddish on how he strangled the old guy. DA Prosecutor shows up at death scene and after the Father Phil Reddish explains on audio to sheriff Martinez he has a friend high up close to DA Rod Pacheco that will help him that person being Brian Floyd who was the chief deputy under Rod Pacheco when he was a assemblyman. The prosecutor then spends a good amount of time with Phil Reddish as he is heard on the sheriff audio being introduced at about 1300 hour and then does not go to victims home to site where the body is till the 1500 hour. When there she refuses to give her card and is rude to victims wife. Makes 72 year old Lee Frank take pictures like she is going to be arrested. The prosecutor ask her lady is your brain working? She was so rude we made a call to the DA office about it. The prosecutor was Daima Calhoun Riverside County who has moved to San Bernardino after threatening Lee Frank. The evening of the death of Nye Frank his family was followed by the parents of Ty Reddish. They had parked along the Frank home and followed them when they were guest of a person who had come to console them. The Reddish family jumped out of their car when the Franks arrived as guest. They inisted that the family not let the Frank family in their house. They then went on to call every few minutes during dinner. This family had to stay out of town for two months as the harassment would not stop and they were in fear. The Frank family notified the Sheriff Department of the event. They said they could not prevent this. The Reddish family watched the home of 72 year old Lee Frank. They then went to anyones home that visited her from the area and told them lies and intimidated them for visiting Lee Frank. They made several repeated visits. The third day after the death of Nye Frank Ty Reddish the killer was out and he along with three family members stood at the corner 2 houses from Lee Frank and waived at anyone passing by and stared at them . The Sheriff was called and the Frank family was told there was nothing that they could do about it. The killer was let out of jail without bail even while on probation within three days. The sheriff said they are not investigating because the DA said coroner said it was a heart attack. The family contacts the coroner and he states he never said it was a heart attack. The family doctor confirms it is not a heart attack. The family was denied any information on the case and was told that Nye Frank had died of a heart attack and had zero injuries. By much persistence and after the family had checked with county records the staff confirmed the case was closed but told not to release documents. DA Chief Deputy Mike Rushton said the family had to wait one year. But with the help of Nova the DA office finally allowed the daughter to see the autopsy in their office without anyone else or medical person to look on. They did allow the DA victim advocate Kim Emmerling in the meeting with DA prosecutor Mike Rushton and Dawana the daughter. During the beginning of this meeting Mike Rushton said that this was a heart attack. After reading the report the daughter realized that this was actually strangulation proved out in the report. Finally Mike Rushton admitted yes it was strangulation but that is not the reason we did not file a charges on Ty Reddish. He said because there is no witnesses they concider this mutual combat. But Lee Frank was there. She never saw her husband hit anyone. Before the autopsy was and sheriff report was released the autopsy was given to the Press Enterprise. The man from the Press Enterprise called us and said he felt we had a story to tell. We had alread had many people interview us but not write the article. During conversation the man said he had the autopsy. We told him we did not have it. We asked him to fax it to us. Which he did. When he wrote the article he put in it mutual combat, fist fight, and heart attack. The autopsy showed a beat elder and states no heart attack. When the family got the pictures and audio of the day the sheriff were at the house from the sheriff department it showed-1. Nye Frank beat, skin off his back, bleeding from his back, broken ribs, beat up face. Ty with one scratch. The audio had his dad tell how and who was helping them, Ty says how he choked Nye Frank. When the family made a call to internal affairs they said they do not investigate unless the family makes a complaint. When family made a complaint they said they cannot talk to them any more because they filed a complaint. Mike Rushton's office sealed the case. The one time that the family went to the DA office to find out who the prosecutor was after speaking to the coroners office and they confirmed reported as cause of death homicide. The woman who refused to give her card at the house came out and and was confirmed the prosecutor Daima Calhoun. She said she did not care what the coroner said she made up her mind at the house and that if Lee Frank and her daughter continued to pursue this she would arrest 72 year old Lee Frank. She again refused to give her card and when it was requested she asked "why". She left Riverside County soon after our complaint. Mike Rushton took over and we never saw her again, but later found she was the lead person in the meeting at the DA office. So even though she was let go she was allowed to continue with the case. During the entire time the family was going through this they made several request to the DA, and DA victims advocate office for a elder victim advocate as both Nye and Lee Frank were over 65. They were told that Riverside county does not have one . There was several times the family made this request and were denied many of the victim rights that should of been provided. The case was closed as exceptional. Later the family saw a award in the paper for Mike Rushton for A National Elder Victim Advocate Award program. I emailed Kim Emmerling that I could not think of one good reason she could possible have to say why she lied to our family. She quit the next day. Lee Frank just got a letter from the board for victims funds. Denying the victim benifits to her. The letter states that Nye Frank participated in the fight and instigated it. The family from day one has requested the right to see what was in the file. They realized there may be fraud. Mike Rushton was promoted to a judge after closing this case. Use of Federal Funds to the District Attorney office to commit a fraud and deny the public constitutional rights, and prevention for the intentional use of the funds that were given for has to be a federal offense and crime. This should be cause of investigation. I have read before that when County and state agencies misuse funds they lose them. Rod Pacheco has full knowledge of this event and has denied any assistance to the family. Ty Reddish was on probation at the time of the killing and until march of 2008. The court records did not show any other cases open. The head judge Fields was notified by the family but told Frank family they could be in trouble for telling him, that it was the DA office duty to report this. The DA office refused to report this. The family of Nye Frank were denied the right to go to court, denied right to testify. They were denied protection from Ty Reddish and his family. In fact now Ty Reddish has a new home that we believe the County funded for him two doors from Lee Frank. The property that the Reddish family claim was left to them in a will from the prior owner is not what the prior owner stated to the Frank family within two weeks of his death. The chain of title shows what looks to be clearly a fraudulent signature of the owner john Husbeth. He was a 95 year old blind man. The person who deeded the property over to the Reddish family is attorney Diana Dimaggio, who stated she was the trustee. She is married to a Lawence Taylor a DUI attorney. Both Diana and her husband are known as personal friends of the Reddish family. Diana use to be a Prosecutor in Banning Ca, and current office across the street from DA Rod Pacheco. Diana Dimaggio is referred from the County DA office victims for attorney services. The story that has been told is that the daughter of John Husbeth was told that if she fights the transfer she would get nothing. If she went along with it she would get ten thousand dollars. She did not have the resources to fight this. The Riverside County area has a history of elder's being taken advantage of by the legal system. I am as a citizen requesting that this be investigated. The County of Riverside District Attorney Office and the Attorney General are both being investigated for changing police reports and the attorney general's rubber stamping refusal to investigate by the Grand Jury per channel 3 news. I do not know of any more gross misconduct than to continue to let the goverment misuse funds, to protect a killer and allow him to harass and torment a senior. There is several reports of opportunities that the officials should of protected Nye and Lee Frank and arrest Ty Reddish. But because of mutual friends with his parents the goverment misused its position and did not do what it is mandated to do. The Riverside County Goverment agencies continue to let a dangerous man who murdered a man in front of his senior wife out in public to endanger the public. Riverside County failed to protect Lee Frank, and even have allowed Ty Reddish to live and put a house two doors from Lee Frank. It is a form of torture for this senior person to have this threat, staring, and intimidation. She has lost her husband, safety, her neighbors are intimidated if the neighbors talk to her, now forced isolation, fear and loss of support. The Frank family had been given letters that the event that happened to Nye Frank being attacked was not so unusual for Ty Reddish behavior. The DA Chief Mike Rushton removed them from the file as evidence and lied to the family that they were presented. Kim Emmerling was requested to report this but failed to do so. Nye Frank worked all his life to have a good reputation. The Reddish family and Riverside Corruption should not be allowed to steal this away from him. Lee Frank is a hard working woman with zero history with the police. Ty Reddish has a public history with his father helping to get the records changed per the general public. There has been a petition of 1600+ people that have signed requesting that this case be investigated. The elder laws to protect the victims of our community have all been violated.
