1. The artist will create:

i. 20% non refundable deposit (minus sketch fee) upon signed agreement _______

3. The artist is obligated to:
a) Purchase necessary materials with the exception of ____________________________________________________________
b) Create the artwork and /or oversee the work of a hired sub-contractor or assistants
c) Make necessary improvements to the artwork as she sees fit (with clients approval) at no additional cost to the client
d) Complete work on time or request reasonable extension time from client (in the case of an emergency or illness)
e) Make reasonable restoration changes within the first 6 months of mural completion free of charge as a guarantee of workmanship (granted artists directions for care of the work is followed) If work is damaged or destroyed through no fault of the Artist, the client will be charged $75.00 per hour for restoration charges.
f) Warrants that the completed work will be of a style and level of expertise consistent with previous work as presented in portfolio
g) Provide proof of liability insurance to the client (for work done in the home)

4. The client is obligated to:
a) Pay for transportation expenses in excess of 20 minutes from artist’s place of business, shipping costs for moveable murals, Installation of moveable mural. If artist must travel to complete mural, the client must also pay for reasonable living costs and travel expenses while the mural is being completed.
b) Prepare the room (for onsite mural) as directed by artist: ________________________________________________________________________________________________________________________
c) Hire and pay for any additional labor services necessary for wall or room preparation.
d) Supply any necessary permits for creation of mural.
e) Provide OSHA compliant scaffolds if necessary.
f) Pay artist for requested mural changes (that does not comply with approved sketch or other previous agreements) at the rate of $75.00 per hour.
g) Notify the artist should the need for maintenance or restoration arises granting him/her the first opportunity to repair/ preserve the work for reasonable compensation.
h) Preserve the artwork according to the artist’s instructions and refrain from changing the artist’s designs. In absence of any need for restoration or maintenance, the work shall remain free of alteration by the client, who shall take reasonable precautions to protect it against damage or destruction by external forces. (In the event of possible alteration or destruction of the work due to proposed renovation or demolition of a structure to which the artwork is affixed, the artist shall be entitled to notification, by the client, affording the artist a reasonable opportunity to reclaim the artwork be removing it whole, at her own expense).
5. This agreement is for the above-mentioned artwork only. Any additional artwork is negotiated separately.
6. Copy write/ ownership: (select)
a) The artist has created a mural design for the client. The design is the creation and property of the artist. Ownership of the Mural (only) shall pass to the client upon completion and final payment. Client will not exploit the image through reproduction, or advertising without written permission of the artist. ________ initial

Ownership of the Mural and full licensed right to reproduce use for advertising, etc shall pass to the client upon completion and final payment for the consideration of ____________ approx 50% of commission fee. ________ initial
d) The artist has re-created a mural design based on artwork owned by the client. The mural design is the creation and property of the artist. Ownership of the Mural shall pass to the client upon completion and final payment. Artist reserves NO copy writes to the mural design and may only use it for portfolio purposes. 7. Extenuating Circumstances:
a) In the event of serious accident or illness where work cannot be completed, the artist will notify the client and provide references to artists who can complete the work. In the event of artist death, his/ her estate shall retain any payments previously made.
b) Should work be delayed due to inaction or neglect on the part of the client, the artist shall be entitled to extend completion date without inconveniencing other clients already scheduled.
8. Arbitration: Any between the parties (for amounts under $2000.00) shall be resolved by arbitration.
The laws of the state of __________________________ shall govern all stipulations of this agreement. Failure or inaction to demand contract stipulations does not invalidate this agreement or the laws surrounding this kind of work.
