CONSTITUTION


ARTICLE I - NAME


SECTION 1. The name of this organization shall be “Association for Computing Machinery,” abbreviated “ACM”, and referred to as the “organization,” “ACM,” or “Association for Computing Machinery.” The name of suborganizations within ACM will be called "committees" or "divisions."

ARTICLE II – PURPOSE


SECTION 1. The purpose of the “ACM” shall be to encourage and foster a greater interest in computing and its applications, bring members together that share common interests, strengthen community involvement, and encourage the educational and entertaining aspects of computing culture and other interests within the group.


ARTICLE III – MEMBERSHIP

SECTION 1. All registered undergraduate day college students shall be eligible for membership in the “ACM”. Membership shall be open to any student regardless of race, color, religion, sex, national origin, age,

sexual orientation, marital status, veteran status or disability.

SECTION 2. Voting members shall be designated as those persons who have attended three (3) meetings.

SECTION 3. Honorary (non-voting) memberships may be given to anyone by any member of the e-board.

ARTICLE IV – OFFICERS

SECTION 1. PRIMARY OFFICERS

SECTION 3. The term of office for the officers shall be from September of the regular academic year to the May of the following year. Under a general election by majority vote, named “Summer Office,” term of office may be extended from May of the following year to September of the following year instead for select officers or all officers of the organization, by choice of the officers running Summer Office.

SECTION 4. The officers shall be elected by a majority at the annual elections held on the first week of April closest to the next general organization meeting.

SECTION 5. Vacancies of offices shall be elected by a general vote of all members, regardless of the aforementioned number of meetings members have attended to become voting members. If such an election cannot take place, the President will appoint members to fill the vacancies of offices.


SECTION 6. Under provisional vote of 5/6 the voting body, a regularly scheduled election may be defaulted to not take place for that voting term. The result of elections will contain the same officers and e-board members as the previous term reassigned to the new term of office. All officers must qualify for eligibility of their positions, or the position becomes vacant immediately and will require appointment of an individual into the position in question.


ARTICLE V – MEETINGS

SECTION 1. The regular meetings of the voting membership shall be held at least every month.

SECTION 2. Special meetings of the organization may be called by the President, or upon the requests of voting members of the organization.

SECTION 3. A quorum for the conduct of official business shall be defined as two (2) officers of any type.


ARTICLE VI – RULES OF PROCEDURE

SECTION 1. Robert’s Rules of Order (revised) shall be the parliamentary authority of this organization. Should Robert’s Rules of Order

conflict with this Constitution, this Constitution takes priority.

SECTION 2. In order to maintain active status, the organization agrees to abide by those rules and procedures, including financial regulations of Salem State College and the Student Government Association, which pertain to all student groups and organizations.


ARTICLE VII – AMENDMENTS

SECTION 1. Amendments to this Constitution may be proposed by either the officers or voting members of this organization.

SECTION 2. Consent by two-thirds (2/3) of the voting members shall be

necessary to approve amendments to this Constitution.


SECTION 3. Pirates/Ninjas Clause

  1. The ACM is where “Pirates”, “Ninjas”, “Shinigami”, and “Mudkips”, among other parties who don't claim an affiliation to the above groups, can come and gather peacefully under common interests.

  2. Under no circumstances should there ever be a battle between any of the parties in the previous list.

  3. During meetings of any ACM activities, none of the aforementioned parties will be “better” than any of the other aforementioned parties, and will not declare any precedence over another, with the exception of “Pirates” vs. Global Warming, where discussion is encouraged that the number of pirates be directly correlated to the conditions in global warming.



BYLAWS


ARTICLE I – DUTIES OF OFFICERS


SECTION 1. The duties of the President shall be to:

  1. Preside over all regular membership meetings.

  2. Call for special meetings when necessary

  3. Sign all financial documents of the organization

  4. Serve as the organizational representative.

SECTION 2. The duties of the Vice-President shall be to:

  1. Succeed the President should he or she for any reason be unable to carry out the Presidential duties.

  2. Assist the President in administering the business of the organization.

SECTION 3. The duties of the Secretary shall be to:

  1. Take brief minutes of each meeting and take care of any major

correspondence concerning the organization as a whole.

SECTION 4. The duties of the Treasurer shall be to:

Keep a record of all financial and historical documents and submit all financial records to the Student Government Association and/or the

Financial Affairs Office as required.

  1. Sign all financial documents.

  2. Turn in all financial records for re-issue to the new Treasurer when required or appropriate.

SECTION 5. The duties of a committee or division officer shall be to:

  1. Conduct all business of the division of ACM.

  2. Act as a representative of the division to ACM and its primary officers.

  3. Execute operations related to the division, including, but not limited to: maintaining safe operations during meetings, taking responsibilities for all activities during meetings, ensuring meetings may be held properly by verifying room availability for the chosen days for meetings, and ensuring the safety of all properties the division may utilize during meetings.

  4. The Officer inherits the responsibilities of the President in respect to the division only, and must report all activities to the President.

  5. A temporary Officer may be assigned at any time by the President. The temporary  Officer may not serve as Officer for more than two (2) meeting sessions of the Officer's assigned committee. The temporary Officer may become Officer with a majority vote of the Officer's assigned committee or division.

  6. When a new Officer is given leadership of a specific committee or division, any existing Officer is removed from that title and position.



ARTICLE II – DUTIES OF ADVISOR


SECTION 1. A faculty advisor shall be appointed by a majority vote of the voting

members. A faculty advisor may be appointed at any time. More than one advisor may exist during a term of office, provided that all advisors are aware of all other officer's involvement with the organization.

SECTION 2. The duties of the advisor shall be to:

  1. Attend the regular meetings of the organization

  2. Sign documents on behalf of the organization as appropriate, including room clearance forms, recognition forms, contracts, etc.

  3. Act as a consultant for the organization and any projects and special committees in the organization.

  4. Act as a liaison between the College and the organization, representing the interests of each.

SECTION 3. The advisor shall have voting privileges in the organization.


ARTICLE III – COMMITTEES


SECTION 1. Ad-hoc committees.

  1. Shall be formed by the President, as deemed necessary,

to investigate matters of immediate concern.

  1. The Chairperson and members of the ad-hoc committee will be appointed by the President, to be approved by a majority of the voting members of the organization.

  2. Ad-hoc committees that have formed may be used to create new permanent divisions of the ACM organization by authority of the President only.

SECTION 2. Computing and Gaming Division

  1. Provides appropriate computing-related seminars, lectures, and events for the ACM organization.

  2. May only be controlled by the President, Vice President, or Computing Officer.

  3. Meeting times and rooms will be regulated by the controller of this division, but may be overridden by the President and Vice President.

  4. Is a subsection of the ACM organization as a whole, and not an independent organization.

  5. Computing and Gaming Division inherits all eligibility of membership of ACM.

  6. This division may not be removed from the ACM organization.

SECTION 3. Anime Division

  1. Provides appropriate anime-related seminars, lectures, and events for the ACM organization.

  2. May only be controlled by the President, Vice President, or Anime Officer.

  3. Meeting times and rooms will be regulated by the controller of this division, but may be overridden by the President and Vice President.

  4. Is a subsection of the ACM organization as a whole, and not an independent organization.

  5. Anime Division inherits all eligibility of membership of ACM.

  6. This division may be removed from the ACM organization by a 4/5 vote, and approval from all advisors and primary officers.


ARTICLE IV – IMPEACHMENT


SECTION 1. Officers and/or members may be impeached on the basis of not fulfilling the purposes and policies of the organization as outlined in the Constitution and Bylaws or for violation of college and/or financial procedures.

SECTION 2. Any member of the organization may initiate impeachment proceedings

by giving written notice to the President. If it is the President who is being impeached, notice should be given to the Vice-President.

SECTION 3. Upon formal notification, it is the responsibility of the President (or Vice- President) to convene an ad-hoc committee of inquiry to consider the filed allegations.

SECTION 4. Any individual who is impeached shall be given full notice of the allegations against him/her and shall have an opportunity to respond to them.

SECTION 5. The ad-hoc committee of inquiry will investigate the allegations, determine

the validity of the charges, and make recommendations regarding sanctioning to the full body for its consideration.

SECTION 6. Recommendations for sanctioning made by the ad-hoc committee of inquiry must be approved by two-thirds (2/3) of the members present and

voting, in order to be implemented.

SECTION 7. Possible sanctions include, but are not limited to, reprimand, censure, and/or removal.

SECTION 8. An individual may appeal his/her sanction by submitting an appeal request to the advisor of the organization within ten (10) calendar days of his/her

notification of the sanction. If it is the advisor who has been sanctioned, appeals should be directed to the President.

SECTION 9. An appeal may be requested only on the basis of one of the following two claims:

  1. That there was procedural error in the conduct of the

impeachment proceedings.

b. That there is significant new evidence which was previously not available.

SECTION 10. The advisor shall determine whether there are grounds for appeal and may choose to affirm the sanction or remand the

case for a rehearing by a new ad-hoc committee of inquiry.

SECTION 11. If an appeal hearing is granted based upon one of the conditions in Section 9, it will be conducted in accordance

with the provisions of Sections 5-7, and with new evidence

submitted or procedural error removed.


ARTICLE V – ELECTIONS


SECTION 1. Elections shall be held during the last three weeks of

the spring semester of each academic year.

SECTION 2. Candidates for offices shall be eligible provided they have met the requirements for that office as stated in Article III of the Constitution.

SECTION 3. Violations of election procedures shall be heard by the President. If this would create a conflict, the Vice President will hear the violations.


ARTICLE VI – FINANCES


SECTION 1. All finances shall be handled in accordance with the established fiscal procedures in effect for the Student Government Association and the College as outlined in the

Groups and Clubs Manual.

SECTION 2. In the event of loss of recognition, any funds remaining in the organization’s account will revert back to the Student Government Association.


ARTICLE VII – INITIATION


SECTION 1. The Association for Computing Machinery does not engage in any initiation procedures which would be considered illegal under applicable state and federal law.

SECTION 2. Each year, every member, will be provided with a copy of Massachusetts

General Laws Chapter 269, Sections 17, 18 and 19, as amended, and will

be required to sign an acknowledgment of such receipt.











ARTICLE VIII – AMENDMENTS



SECTION 1. Amendments to these Bylaws may be proposed by either the officers or voting members of this organization.

SECTION 2. Consent by two-thirds (2/3) of the voting members shall be necessary to approve amendments to these Bylaws.
