PREAMBLE


1. The Indian Ex Servicemen Movement, hereafter referred to as IESM is an All India Federation of Ex Servicemen’s organisations. The term ‘Military Veterans’ means the retired personnel of the Indian Army, Indian Navy and Indian Air Force. We, the Ex Servicemen of India, resolve to come under one umbrella in a unified federal structure at National, State and District levels in order to:-

Ex Servicemen (ESM) settled abroad.


2. Aims & Objectives. In general the IESM will aim to bind the ESM fraternity together and use the talent and experience of the ESM towards nation building. In specific the aims and objectives will be, but not limited to, as follows:-

(a) To promote, support and organize suitable occupational opportunities for ESM.

(b) To provide assistance to ESM and their widows in their resettlement.

(c) To provide assistance to ESM in setting up own small scale ventures for livelihood.

(d) To provide assistance to all ESM in matters concerning medical, pension, grants etc.

(e) To organize social, cultural, educational and recreational events for the benefit of ESM and their wards.

(f) To periodically hold conferences, meetings, seminars, lectures and visual shows on topics of interest to the ESM.

(g) To pursue with the Centre and State governments for removal of any discriminatory rules and provisions adversely affecting the interests of ESM.

(h) To pursue establishment of Just & Fair place of Defence services in the country i.e. functioning of Defence services in a democracy.

(j) To undertake any other task considered appropriate by the Governing Body.


3. Areas of Immediate Concern. To strongly take up important issues/ problems affecting the ESM like:

  1. Constitution of Ex Servicemen Commission at the National level to look after welfare measures of the ESM. The ESM commission should be headed by an ESM and to have members from the ESM including ESM Widows.

  2. One Rank One Pension.

  3. Guaranteed Re-settlement/ Reemployment of servicemen on retirement until the age of 60 years or in the alternative, suitable enhanced compensation till attainment of 60 years of age.

  4. To remove all anomalies of the previous Pay Commissions and get due justice for the Defence Services.

  5. To restore status, respect and self esteem which has been eroded in the past 60 years.

  6. Revamping of ECHS Scheme so as to make it user friendly for all types of medical care, including super specialized care thereby improving the health care of ESM.

  7. Representation of the ESM on all committees and other such bodies constituted for the purpose of looking into matters affecting the interests of the ESM.

  8. Single window service to be established in all Civil/Govt. offices to avoid difficulty and delay of ESM problems.

(j) One ESM must be appointed as PET/NCC Instructor in all School &

Colleges.

  1. Once a year a free railway warrant of the class authorized to be given to

every ESM and his/her spouse of the life time.

  1. Taking up case for Defence Constituency like graduate constituency for the serving & retired defence personnel to safeguard their interests in the Parliament & state legislatures. Till this is accepted asking for nominated members?

  2. Taking up with state governments for allotment of residential plots & industrial sheds for the ESM’s.

  3. Taking up cases collectively for removal of injustice through legal means

  4. Building up funds by voluntary contributions as prescribed to have resources for building, office & legal aid.

  5. To liaise with the services to help the PBOR’s in resettlement..


4. Conditions

(a) The resources of the IESM shall be utilised solely towards solving the problems and the objectives of the IESM as set forth in the Memorandum of Association and no portions thereof shall be paid or transferred directly or indirectly to members of the IESM.

(b) No member of the IESM shall be appointed to any salaried office of the IESM, or any office of the IESM paid by the IESM to any members except repayment of out of pocket expenses and interest on money lent or rent for premises to the IESM.

(c) The IESM by its constitution is required to apply its profit if any, or other income in promoting its objectives.

(d) If upon winding up or dissolution of the IESM, the remains after settlement of all debts and liabilities, any property whatever is remaining, the same shall not be paid to or distributed amongst the members of the IESM but shall be given or transferred to some other institution having objectives similar to the objectives of the IESM.

Notes:-

1. The Governing Body will nominate State Conveners for the remaining states who will be in constant consultation with the Governing Body on all important matters affecting the IESM. These are the initial appointments and depending upon the performance of each state, changes shall be made by the Governing Body

2. State Convener will nominate State Governing Body, District Core Groups and City Committees.

3. President and Gen Secretary of the Defence Veteran organisations joining the Federation (IESM) will be part of the General Body of the IESM


7. Rules & Regulations

(a) Membership. Membership of IESM is open to all Ex-servicemen Organisations of Army, Navy & Air Force, Widows of Ex Servicemen and also to individual Ex servicemen who fulfill the terms and conditions of the IESM and subject to the approval of the Governing Body of the IESM.

Note:- If the membership is not approved by the Governing Body of the IESM, the reasons of refusal shall be communicated to the veteran organisations/ applicant concerned.

(b) Admission Fee and Subscription. The Admission Fee and the Subscription shall be as decided by the Governing Body of the IESM from time to time

(c) Sources of Income:-

(i) Subscription from Members.

(ii) Donations/ Contributions from volunteer individuals/organisations duly approved by the Governing Body.

(iii) Lawful and authorized profit from any venture.

(iv) Loans from authorized sources for any approved activity.

(d) Termination or Cessation of Membership. The Governing Body of IESM shall have the power to expel/ terminate a member or/ and member/ veteran organisation from the membership of the above IESM, on any of the following grounds:-

(i) On death

(ii) On written resignation

(iii) If found to be involved in any anti-social activities

(iv) If judged by any court of law to be a criminal offender

(v) If found guilty by means of anti propaganda of the Aims and Objectives of the IESM

(vi) If Veteran Organisation/ he/ she disregard(s) Rules & Regulations or disobey(s) the decisions of the Governing Body

Note: The decision of the Governing Body regarding the termination from the membership of the IESM, which will be final, shall be communicated to the member concerned.

(e) General Body Defined. All members of the IESM will constitute the General Body of IESM. Each veteran Organisation will be represented by any two persons, preferably from President, Vice President, Gen Secy, Treasurers and Joint Secy.

(f) General Body

(i) Meeting: General Body meeting shall be held at least once in every year.

(ii) Quorum: The quorum of General Body Meeting shall be One Third of the total strength of General Body Members of the IESM. If quorum is not complete the meeting will be adjourned for 30 minutes. On reassembly, quorum will be taken to be complete.

(iii) Notice: Minimum 15 days notice shall be given to the members, before the date of General Body meeting endorsing agenda specifying Date, Time, Place and Agenda to be discussed. Emergency meetings may be held giving three days notice.

(g) Amendments. All amendments to the Memorandum of Association will be approved by the General Body by Two Thirds majority of the members present. Amendments to be made will be circulated as specific agenda point for the General Body Meeting.

(h) Composition of the Governing Body. The composition of the Governing Body shall be as under:-

National Level

(i) Chairman - One

(ii) Vice Chairman - One

(iii) General Secretary - One

(iv) Joint Secretary - One

(v) Treasurer - One

(vi) Governing Body Members - 12 (Besides above five officials. Total Governing Body Members not to exceed 17 (Seventeen).

State Level

(vii) State Convener - One

(viii) State Governing Body - 9 – 11

District Level

(ix) District Convener - One

(x) District Committee - 9 – 11

City Level

(xi) City Convener - One

(xii) City Committees - 7 – 9

(j) Decision Making by Governing Body. All decisions by the Governing Body will be taken by Majority Vote. The quorum of the Governing Body at each level will be 50% of the total members of the Governing Body at that level.






(k) Powers and Duties of Office Bearers

(i) Chairman

(a) The Chairman shall preside over all the meetings of the IESM. In the absence of Chairman, the Vice Chairman will preside the meeting. However, in the absence of both Chairman and Vice Chairman, the remaining members of the Governing Body at the meeting will nominate or elect with voice vote one of the members of the Governing Body present there, as the Chairman of the Meeting. The Presiding Officer so elected shall also have an extra costing vote if necessary for taking a decision.

(b) At the time of voting on any matters/ subject (except Election), if the total votes of the groups of members happen to be equal in number, the Chairman has the power to cast an extra vote to decide the matter/ subject.

(c) The Chairman shall have the power to allow inclusion of any subject/ matter in agenda for the discussion in the course of proceeding/ meeting.

(ii) Vice Chariman

(a) He will function as second in command of the Association.

(b) He shall have all the powers of the President in his/her absence.


(iii) General Secretary

(a) General Secretary will summon and attend the meeting of the Governing Body and General Body.

(b) General Secretary will prepare the Membership Register as well as the Proceeding Register to record the minutes of the proceedings of the Governing Body Meeting and the General Body Meetings and have them duly signed by the members who attend the meeting.

(c) He will function as the staff officer of the Association and carry out all duties and its functions. He will maintain all records of the Association.

(iv) Joint Secretary

(a) He will assist the General Secretary in the duties.

(b) He will function as General Secretary in his absence and will have all powers of the General Secretary.

  1. Treasurer

(a) All funds of IESM shall remain under the care and management of Treasurer.

(b) Treasurer shall maintain the accounts of all money which is received and/ or paid by him/ her on behalf of the IESM.

(c) Treasurer shall make disbursement in accordance with the direction of Governing Body.

(d) He will maintain all records pertaining to the finances of the Association.

  1. Governing Body Members. They will function as the eyes and ears of the Association and will take part in all decision making. Each member will have one vote in the decision making process of the Association.

(vii) Re-Admission. In case any member of the IESM is expelled by the Governing Body on the reason of nonpayment of subscription, the member can be re-admitted, provided the member concerned pays all outstanding dues, with permission of the Governing Body.

(viii) Appeals. All the appeals shall be preferred to the Governing Body of the IESM and the decision of the Governing Body shall be final.

(ix) Filling Up of Casual Vacancies. Any casual vacancy amongst the Governing Body shall be filled by a resolution passed by the Governing Body. Such appointment(s) shall be confirmed by the General Body in its coming General Body Meeting.

(x) Election. General Body in its annual Meeting will elect its Chairman and all the office bearers and also the Executive Members of the Governing Body, after every TWO years by secret ballot papers or by show of hands as the election officer may decide. If required the General Body may also modify the composition of members of Governing Body.

(xi) Sources of Income. All income of the IESM shall be utilised only for the promotion and uplift of the Aims & Objectives of the IESM. Sources of Income of the IESM are as under:-

(a) Admission Fee & Subscription from the members of the IESM,

(b) Donations and Special Contributions.

(xii) Financial year. Financial year of IESM shall start from 1st April to 31st March every year.

(xiii) Audit. The accounts of IESM shall be audited by a qualified auditor (Chartered Account) every year.

(xiv) Management of funds and accounts operation. Bank account shall

be jointly operated by Chairman, Vice Chairman and the Treasurer. Minimum two of the above three must sign for making any transaction. All expenditure will be duly approved by the Governing Body. By the seventh of every month the receipt and expenses of the previous month and the current balance would be intimated to all Governing Body. The accounts must be counter signed ever month by the Chairman and Vice Chairman.


(xv) Annual List of Governing Body. On a change of any Office Bearers/

Governing Body shall be filed in the office of the Registrar of Societies,

as required under Section 4 of Societies Registration Act, 1860.

(xvi) Dissolution. If the IESM needs to be dissolved, it shall be dissolved as

per provisions laid down under Sec. 13 & 14 of the Societies

Registration Act, 1860, as applicable to National Capital Territory of

Delhi.

(xvii) Legal Proceedings. IESM may sue and/ or be sued in the name of

Chairman as per provisions laid down under Sec 6 of the Societies

Registration Act, 1860.

(xviii) Amendment. Any amendment in Memorandum, Rules and

Regulation will be carried out in accordance with Section 12 & 12-A of

the Societies Registration Act, 1860.

(xix) Application of the Act. All the provisions under all the Sections of the

“Societies Registration Act, 1860” shall be applicable to IESM.
